II. PURPOSE OF HEARING - ZONING APPLICATION NO. 229
Request of Mr. Trinh Dang Bui, owner, for an amendment to the Land Use and
Urban Development Ordinance of said City from Classification Suburban
Development (SD) to Single Family Dwelling District (R-1) on the following
described property, to -wit:
Being a tract of 10.00 acres, and being known as Lot 24 of the Allison -Richey Gulf
Coast Co. Subdivision, section 7, of the H.T. & B.R.R. survey, A-219 of the Deed
Records, Brazoria Co., TX.
Director of Planning and Development Dennis Smith, presented the location of
the proposed zone change.

APPLICATION NO. 234
Request of owners for an amendment to the Land Use and Urban Development
Ordinance of said City from Classification Single Family Dwelling Unit (R-2) to
General Business (GB) on the following described property, to -wit:
Being several tracts of land bordering F.M. 518 (Broadway) and Pearland
Parkway us evidenced by the metes and bounds of the Deed Records, Brazoria
Co. TX.

A 4.5925 acre tract of land out of a 44.7362 acre tract of land, recorded in the
-- County Clerk's File No. 95-002978 of Brazoria County, Texas and being situated
in the Thomas J. Green Survey, Abstract 198, Brazoria County, Texas.
A 9.883 acre tract (Called 9.8895) out of the Thomas J. Green Survey, Abstract
198, Brazoria County, Texas, being the same tract described in a Partition Deed
known as Lot 3 and denoted as Tr. D-18 of the April 3, 1959 revised partition of
the J.J. Settegast Estate.

Brazoria County, Texas.
Mr. Smith presented the location of the proposed request.
111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Mr. Bob Lewis, 2905 Country Club Drive, said that he feels Pearland Parkway will
be the signature road into Pearland.
Mr. Lewis noted that upon reading the legal description by the Commission in
paragraph 4, the date was April 3, 1959; and in paragraph 5 the tract is C-17, and
the date was April 3, 1959.
Mr. Dave Miller, 2706 Shady Creek, said he thinks this proposed usage is the
best for the land.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
None.
V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Mr. Smith stated in response to Mr. Lewis' concern regarding the legal
description, that the agenda had the correct information; however, was misread.

APPLICATION NO. 235.

11. PURPOSE OF HEARING
APPLICATION NO. 235
Request of owners for an amendment to the Land Use and Urban Development
Ordinance of said City from Classification Suburban Development (SD) to Multi -
Family -Planned Unit Development (MF -PUD) on the following described property,
to -wit:
22.16 acres out of a subdivision of the West'/2 of the northeast '/a of Section 15,
H.T. & B. R.R. survey, A-241, recorded in Volume 297, Pg. 98 Brazoria County,
TX.
The purpose of the hearing was read into the record by Chairman Lopez.
Mr. Smith presented the location of the property and said the Ordinance has
specific requirement, and applicants must provide plans of reasonable
assurances of the project that locks it into definite specifications. Mr. Smith said
the partnership has met all the requirements.
111. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Mr. Matthew Dilick of West Lake Residential Management Company gave a formal
submission of the property, and distributed notebooks detailing the project.
The following individuals addressed Council and the Planning & Zoning
Commission stating that they were in favor of the apartment project:
Charles Vatterott, 2702 W. Oaks Circle East; Tom Alexander, 3208 Nottingham;
Michael O'Day, 5949 Dublin Lane; Orlen O'Day, 1405 Garden Road; Suzanne
Elliott, 1812 Washington Irving; Judy Bishanti, 3902 I1ed Stem Court; Tom
Alexander, Sr., 1803 Washington Irving; Paul Henry, architect of the project; Jim
Nelson, 4511 Ingersol, Houston; Monica Vatterott, 2702 W. Oaks Circle East; and
Raymond Meraz, 3420 Robinson Drive.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
None.
V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Councilmember Larry Wilkins was impressed with the project, and asked if the
rendering in the notebook was the actual design of the units. Mr. Dilick replied
they would be similar and compatible. Councilmember Wilkins also asked the
monthly rental of the units, to which Mr. Dilick replied $700-$750.
Councilmember Richard Tetens commented there did not seem to be anything
in the notebook that tied the project down. Mr. Smith said the PUD requirements
ties the project down. Mr. Dilick said the notebook shows floor plans with square
footage, and explained the units are built in clusters. Mr. Vatterott, a member of
the development team said Section 2 of the notebook shows surveys, maps,
renderings, dimensions of the buildings, floor plans, and a site plan. Mr. Dilick
said the units are to scale.
Commission member Tommy Scott stated the plans show that two buildings
(Nos. 8-9) are not delineated. Mayor Reid asked will there be procedures
followed, to which Mr. Smith said the project will go into development with a site
plan that gives dimensions and floor plans.
Councilmember Kevin Cole said the Ordinance will tie the project down.
Chairman Lopez said the P&Z Commission will make other attachments to ensure
compliance.
Architect Paul Henry said that buildings 8,9 & 11 are not dimensioned out but are
within the range of plans in the notebook, and the buildings are 80'X 80' X 40'.
Commission member Jack D. Mathis inquired as to who is responsible for the
landscaping and maintaining the lake. Mr. Dilick said West Lake Residential is
the management company and they will be responsible for maintaining the
landscaping and the lake.

11. PURPOSE OF HEARING - APPLICATION NO. 237
Request of Mr. Dave Miller, agent, for Mr. Robert Fournet, owner, for an
amendment to the Land Use and Urban Development Ordinance of said City from
Classification Multi -Family Dwelling (MF) to Light Industrial (M-1) on the following
described property, to -wit:
2.31671 acres out of a 3.322 acre tract of a portion of the H. Stevens survey,
Abstract 594, adjacent to and east of State Highway 35, Brazoria Co., TX (16800
Block, South Main St.)
Mr. Smith presented the location of the property.
III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Mr. Dave Miller, 2706 Shady Creek, said the property is a triangle piece that
needs to be zoned the same as the rest of the property.
Mr. Reed Leistad, 3914 Greenwood Drive, said the property could not be built on
without all of it being zoned the same.

Commission member Mathis questioned if the property was located near Piper
Pipe Company, and Mr. Smith replied yes.
Councilmember Wilkins asked what is behind the property, and Mr. Smith said
it was vacant land.

SPECIFIC USE NO. 59
1. CALL TO ORDER
The hearing was called to order at 7:38 p.m.
II. PURPOSE OF HEARING - SPECIFIC USE NO. 59
The purpose of the hearing was read into the record by Chairman Lopez.
Request of Peter Thompson, Agent, for Thomas P. Alexander, owner, for an
amendment to the Land Use and Urban Development Ordinance of said City for
a Specific Use Permit for a Telecommunications Remote Terminal Building on the
following described property, to -wit:
Being a tract containing 2,000 square feet (0.0459 acres) in the W.D.C. Hall
Survey, A-23, out of a 1.052 acre tract conveyed unto Thomas P. Alexander, et
al, by deed Volume 156, pg. 682 of the Deed Records, Brazoria Co. Texas (not
assigned).
Mr. Smith presented the location of the property.
III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Mr. Peter Thompson of SWB, 14575 Persidio, Houston, said pictures were sent
representative of the type of building that will be placed on a concrete pad.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
None.
V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Commission member Emil Beltz asked if the building would be placed over the
storm sewer, and Mr. Thompson said there would not be a conflict.
Council member Cole asked if the area would be well landscaped, and Mr.
Thompson replied SWB would comply with the requirements.
Mayor Reid asked if the building would be secure, and Mr. Thompson said it
would be brought in on a truck and placed on a concrete pad.
