R2015-180 A Resolution of the City Council of the City of Pearland, Texas, approving a change order with Crain Group, LLC in the amount of $834,620.75 associated with the Sports Complex at Shadow Creek Ranch Project. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain change order associated with the Sports Complex at Shadow Creek Ranch Project, a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest the change order associated with the Sports Complex at Shadow Creek Ranch Project. Clay RE: Sports Complex at Shadow Creek Ranch — Construction Update This memo provides an update on the Sports Complex at Shadow Creek Ranch construction project and planned activities. The last memo was dated May 28, 2015. Construction Update Work continues on the pavilion building as well as the ballfields and plazas. The restroom/concession building construction has begun under the pavilion. Final grades on fields 1-7 are being reached and irrigation is being installed. Final grading of the detention ponds and the remainder of the site is also in progress. Installation of sidewalks and plazas between the fields continues. Pedestrian lighting will be installed by MUSCO Sports Lighting once walkways and plazas between fields have been completed. Agreements have been signed with Centerpoint for power to the park and installation of the overhead service poles has been completed. We are continuing to work with Centerpoint Major Underground to finalize the agreement for the underground portion of the service which includes setting our pad mounted transformer. Despite the lack of a final agreement, we have held the underground electric pre -construction meeting with the Centerpoint representative and have been cleared to begin construction on our portion of the infrastructure. Reliable Traffic Signal has relocated the power service for the traffic signal at Trinity Bay and Shadow Creek Parkway. Reddico Construction Co. was contracted to perform the bore across Kingsley in order to tie in the water service at the park to the existing water line on the east side of Kingsley. They have completed this work. Kinder Morgan has also begun installation of the 3 inch gas pipeline that runs adjacent to the park along Kingsley. The traffic signal contract was let in June. A contract was entered into with Traftex, Inc. in July and they have since begun work. The foundation and pull box for the new signal have been installed at the southwest corner of the intersection. Poles and mast arms are on order. Summary of activities: • Detention pond excavation is 87% complete • Restroom/concession building walls are up. Plumbing is being installed. Overhead area is being constructed. • Driveway connection to Shadow Creek Parkway (FM 2234) has not been installed. SBC needs to make adjustments to their facilities in order for this work to be accomplished. Their parts are on order and this work should be complete in the next few weeks. • Electrician continues to run power conduit across the site to the fields. Will begin runs to the pavilion and restroom buildings. Will also be installing underground service infrastructure. • Ballfield irrigation is going in. Once power and water are established and irrigation is complete. turf will be installed. • Traffic signal installation has begun. Three Month Look Ahead: • Complete detention pond excavations. • Complete electrical work. • Final grade fields/site and install sod/hydromulch. • Rework stabilization and subgrade at driveway connection to Shadow Creek Parkway entrance and install driveway. • Complete walkways and plaza's between fields. • Complete installation of the traffic signal modifications at Trinity Bay intersection. • Continue to coordinate with Kinder Morgan pipeline installation along Kingsley Dr. • Complete tie in to water service connection across Kingsley. Test lines and put them into service. • Finalize underground agreement with Centerpoint Energy and complete site power installation. • Complete items added back to the project scope via MUD Funds received (see "Other Items of Interest" below) • Take contract for Kompan, Inc.to Council on September 141h for installation of playground equipment. Issue NTP and complete the installation. • Prepare for Grand Opening in January 2016. Schedule The contract includes 300 calendar days for substantial completion with an additional 30 days to achieve final completion. Our contract also allows for 40 Rain Days per year to be built into each construction contract. The length of this contract allows for 36 rain days to be built into the schedule, at which time days over this amount will be added to the contract time as an extension. The 36 day threshold was reached on December 31, 2014. So far a total of 57 days through the month of June have been approved and added to the contract via change order. An additional six (6) days are pending approval for the months of July and August. This agreement provided an additional $685,000 from each organization to supplement the funding for water, sewer and drainage items related to construction of the park facilities. The priorities of amenities to be added back with the $1.37 million contribution per the interlocal is as follows: • Crushed granite trail around detention pond • Clear and grubbing Ph 2 open space • Playground • Lawn Amphitheater • Volleyball courts • Maintenance Building • 4'h lighted softball field • Scoreboards for softball fields. The playground equipment contract has been negotiated with Kompan, Inc. and is planned to be purchased via the U.S Communities government purchasing alliance pending approval by Council at the September 14' Council meeting. The maintenance building will be repackaged and advertised for bids in late September. Staff is currently in negotiations with the general contractor, Crain Group, to add the trail. phase 2 clearing/grubbing, amphitheater, volleyball courts. and remaining softball field to their scope of work. If negotiations are successful. a Change Order will be presented for City Council consideration. which will add the work to the current construction contract. If there are sufficient funds remaining, we will enter into a contract with MUSCO Sports Lighting to light the 8`h field. Clay RE: Sports Complex at Shadow Creek Ranch — Construction Update This memo provides an update on the Sports Complex at Shadow Creek Ranch construction project and planned activities. The last memo was dated February 19, 2015. Construction Update Detention pond excavation is almost complete. Driveway and parking lot paving is complete with the exception of the driveway tie in at Trinity Bay. The City contracted with Reliable Traffic Signal to relocate the power service for the traffic signal at Trinity Bay and Shadow Creek Parkway. The pavilion has been erected and work will begin shorty on the restroom and concession buildings. Coordination efforts continue with CenterPoint Energy to finalize the design. agreements and schedule for site power. Power access location, overhead power routing into the park and terminal pole/transformer pad location have been determined. City Council recently granted an easement to Kinder Morgan for a new 3 inch gas pipeline adjacent to the park along the Kingsley ROW. Related work will be coordinated with park construction. MUSCO has installed precast concrete foundations and high mast sports lighting for softball fields. Pedestrian lighting will be installed once walkways between fields and plazas have been constructed. Summary of activities: • Detention pond excavation is 85% complete • The metal building of the pavilion as well as the roof has been erected and installed. • Paving for entrances from Kingsley and Shadow Creek Parkway as well as parking lot paving is complete. Driveway connection to Shadow Creek Parkway has not been installed. • Sports lighting has been installed on the fields • Electrician has begun installation of power conduit across the site. Sept 10. 2015 11 Page Sports Complex at Shadow Creek Ranch Construction Update Page 11 RESPONSIVE RESULTS -ORIENTED TRUST -BUILDERS ACCOUNTABLE Three Month Look Ahead: • Complete detention pond excavations. • Electrical work at the pavilion and fields to continue • Final grade fields and install sod/hydromulch. • Complete stabilization and subgrade as well as driveway connection to Shadow Creek Parkway entrance. • Complete walkways and plaza's between fields. • Complete traffic signal power switchover to the new service panel at Trinity Bay intersection. • Coordinate with Kinder Morgan pipeline installation along Kingsley Dr. • Install bore under Kingsley for water service connection to service line on the east side of Kingsley. • Finalize agreements with Centerpoint Energy and install site power. Schedule The contract includes 300 calendar days for substantial completion with an additional 30 days to achieve final completion. Our contract also allows for 40 Rain Days per year to be built into each construction contract. The length of this contract allows for 36 rain days to be built into the schedule, at which time days over this amount will be added to the contract time as an extension. The 36 day threshold was reached on January 10, 2015. So far a total of 24 days through the month of March have been approved and will be added to the contract via change order. An additional nine (9) days are pending approval for the month of April. Other items were modified or value engineered to reach the negotiated contract value. The Boards for BCMUD's 1 and 26 offered the City $685,000 from each organization ( a total of $1,370,000) to supplement the funding for water. sewer and drainage items related to construction of the Park facilities. On November 10, 2014. Council approved entering into an Interlocal Agreement with MUD's 1 and 26. Sept 10. 2015 21 age Sports Complex at Shadow Creek Ranch Construction Update Page 12 RESPONSIVE RESULTS -ORIENTED TRUST -BUILDERS ACCOUNTABLE On May 1, 2015 the City received notice that TCEQ approved the BCMUD.s to use these funds to construct infrastructure for the park. A second Interlocal Agreement is scheduled to go before Council on June 8. 2015 which will clarify the City's obligation regarding the use of the funds and prioritizes the amenities to be added back into the project, including: • Crushed granite trail around detention pond • Clear and grubbing Ph 2 open space • Playground • Lawn Amphitheater • Volleyball courts • Maintenance Building • 4'h lighted softball field • Scoreboards for softball fields. The current construction contract is scheduled for substantial completion within the next three months. The softball field. volleyball courts and clearing and grubbing may be change ordered into the existing construction contract. Staff plan to re -package the lawn amphitheater, maintenance building and crushed granite trail for new bids and separate contracts. The Playground equipment, lighting for the softball field and the scoreboards will be procured via the Buyboard as appropriate. Items installed under these separate contracts will not be complete at the time of substantial completion of the current contract. The City also applied for a $400,000 grant from Texas Parks and Wildlife in August 2014. Multiple requests for additional information were received by the City from TPWD, and the project was classified by the process as a Category 4, which includes projects with several adverse impacts and/or unclear elements. The final disposition of the grant was that our request was not approved.
