B.R. Co. Survey, Abstract 242. Brazoria County, Texas, (generally located
north of Fite Road, east of Old Chocolate Bayou Road, Pearland, TX),
Zone Change 2015-09Z, a request of Chad Thuman, applicant; on behalf of
Meli the Estate of Earl M. Onitsuka, owner; for approval of a change in
zoning from the General Business (GB) and Single Family Residential — 1
(R-1) zoning districts to the Single Family Residential (R-2) zoning
district; on approximately 12.4033 acres of land, providing for an
amendment of the zoning district map; containing a savings clause. a
severability clause, and an effective date and other provisions related to the
subject.
WHEREAS, Chad Thuman, applicant; on behalf of the Estate of Earl M.
Onitsuka, owner; is requesting approval of a change in zoning from the General
Business (GB) and Single Family Residential — 1 (R-1) zoning districts to the Single
Family Residential - 2 (R-2) zoning district; on approximately 12.4033 acres of land;
said property being legally described in the legal description attached hereto and made
a part hereof for all purposes as Exhibit "A," and more graphically depicted in the vicinity
map attached hereto and made a part hereof for all purposes as Exhibit "B," and
WHEREAS, on the 28th day of September, 2015, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the City,
the affidavit of publication being attached hereto and made a part hereof for all
purposes as Exhibit "C," said call and notice being in strict conformity with provisions of
Section 1.2.2.2 of Ordinance No. 2000T; and
WHEREAS, on the 28th day of September, 2015, the Planning and Zoning
Commission submitted its report and recommendation to the City Council regarding the
proposed zone change application of Chad Thuman, applicant; on behalf of the Estate
of Earl M. Onitsuka, owner; for approval of a change in zoning from the General
Business (GB) and Single Family Residential — 1 (R-1) zoning districts to the Single
Family Residential - 2 (R-2) zoning district: on approximately 12.4033 acres of land said
recommendation attached hereto and made a part hereof for all purposes as Exhibit
"D"; and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission. City Council considered this application and the recommendation of the
Planning and Zoning Commission at regular meetings on the 12th day of October 2015
and the 26th day of October 2015; and
WHEREAS, the City Council having fully heard the testimony and argument of all
interested parties, and having been fully advised in the premises. finds that in the case
of the application of Chad Thuman, applicant; on behalf of the Estate of Earl M.
Onitsuka, owner; for approval of a change in zoning from the General Business (GB)
and Single Family Residential — 1 (R-1) zoning districts to the Single Family Residential
- 2 (R-2) zoning district; on approximately 12.4033 acres of land, presented which, in
the judgment of the City Council, would justify the approval of said application; now,
therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section I. The following described property located within the corporate City
Limits of the City of Pearland, Texas, and presently classified as General Business (GB)

and Single Family Residential — 1 (R-1), is hereby granted a change in zoning to Single
Family Residential - 2 (R-2), in accordance with all conditions and requirements of the
current Unified Development Code and incorporated for all purposes, such property
being more particularly described as:
LEGAL DESCRIPTION: Tract 1 - Being a tract of land containing 10 acres, more
or less, situated in the southwest 1/4 of the northwest 1/4 of Section 17, H.T. & B.R.
Co. Survey, Abstract 242, Brazoria County, Texas.
Tract 2 — Being a tract of land containing 2.4033 acres, more or less, situated in
the southwest 1/4 of the northwest 1/4 of Section 17. H.T. & B.R. Co. Survey,
Abstract 242, Brazoria County. Texas.
GENERAL LOCATION: The property is located north of Fite Road, east of Old
Chocolate Bayou Road, Pearland, Pearland, TX
Section II. The City Council of the City of Pearland finds and determines that the
recitations in the preamble hereof are true and that all necessary prerequisites of law
have been accomplished and that no valid protest of the proposed change has been
made. The City Council further finds and determines that there has been compliance
with the mandates of law in the posting and presentation of this matter to the Planning
and Zoning Commission and to the City Council for consideration and decision.
Section III. The City Council of the City of Pearland finds and determines that
the amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
Section IV. If any section, subsection, sentence, clause, phrase, or portion of
this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining
portions thereof.
Section V. AH rights and remedies, which have accrued in the favor of the City

under this Ordinance and its amendments thereto, shall be and are preserved for the
benefit of the City.
Section VI. The City Secretary is hereby directed to cause to be prepared an
amendment to the official Zoning District Map of the City, pursuant to the provisions of
Section 2.3.2.2 of Ordinance No. 2000-M and consistent with the approval herein
granted for the reclassification of the herein above described property
Section VII. This Ordinance shall become effective after its passage and
approval on second and final reading.

Earl M. Onitsuka, owner; for approval of a change in zoning
from the General Business (GB) and Single Family Residential
— 1 (R-1) zoning districts to the Single Family Residential — 2 (R-
2) zoning district; on approximately 12.4033 acres of land in
Pearland, TX., located North of Fite Road, east of Old Chocolate
Bayou Road, Pearland, TX.
The applicant is requesting approval of a change in zoning from the General Business
(GB) and Single Family Residential — 1 (R-1) zoning districts to the Single Family
Residential — 2 (R-2) zoning district on approximately 12.4033 acres located along Fite
Rd and Old Chocolate Bayou. The property is currently zoned for commercial use along
Old Chocolate Bayou and Residential along Fite Rd. The applicant is seeking a zone
change for the entire parcel to allow for a single family residential development that will
consist of individual lots with minimum widths of 70 feet. The current R-1 zoning has a
minimum lot area of 8,800 square feet and a minimum lot width of 80 feet. The larger lot
size allows for greater landscape and buffer areas from adjacent incompatible uses.
The GB zoning district is intended to permit a wide variety of commercial uses, including
retail trade, personal and business establishments, offices and commercial recreation
uses. When a GB use is adjacent to a property zoned for single-family use, there must
be a 25 foot landscaped buffer with a masonry fence along the property line that is
adjacent to the single family use or district.
At the Pre -development meeting on July 1, 2015, the applicant had proposed 85' wide
lots with a minimum area of 10,625 square feet which would exceed the requirement of
the R-1 zoning district.

Recommendation
Staff is unable to recommend approval of the request to change the zoning of the
approximately 12.4033 acre site from GB and R-1 to R-2 for the following reasons:
1. The change in zoning is not in conformance with the Comprehensive Plan. The
Comprehensive Plan calls for this area to be Retail, Offices, and Services. The
existing GB portion of the property is a zoning designation that would meet the
requirements of the Comprehensive Plan.
2. Character of the area - The proposed change in zoning will impact surrounding
properties by allowing additional residential development to abut existing and
future commercial and light industrial uses. Small lots leave little room for buffers
and screening from incompatible uses. A high amount of lot coverage also
means greater density and can affect the overall appearance of the
neighborhood.
Site History
The subject property is currently undeveloped. The L-shaped property has frontage
along Fite Rd. but will need to extend and improve Old Chocolate Bayou south to gain
the required second point of access.
The site is surrounded by commercially zoned properties and uses, with the exception
of the detention lake to the east which is zoned Multi -Family. The below table identifies
surrounding uses and zoning districts:

The subject property has frontage along Fite Road; a major collector, which requires a
minimum of 80 feet of right-of-way. The current road is platted with 60 feet of right-of-
way. The second point of access will be along a required extension of Old Chocolate
Bayou Road, which will require a minimum right-of-way of 50 feet.

The subject property has not yet been platted. Platting will be required prior to the
issuance of any building permits.
Conformance with the Unified Development Code
All proposed developments on site will be required to be in compliance with the Unified
Development Code (UDC). The proposed development will have 2 access points in
order to ensure compliance with the access management section of the UDC. All lots
will be platted in conformance with the approved zoning for the property.
The below table compares the development requirements of the proposed R-2 zoning
designation, with the existing R-1 zoning designation.

The proposed change in zoning from GB and R-1 to R-2 is not in conformance with the
Comprehensive Plan. The Comprehensive Plan calls for this area to be Retail, Offices,
and Services. The existing GB portion of the property is a zoning designation that would
meet the requirements of the Comprehensive Plan.
Availability of Utilities
The property has access to utilities. GIS data indicates that there is an existing 24 -inch
sewer line and 12 -inch waterline located along Fite Road in front of the subject parcel.
The applicant did not indicate that annexation into a MUD district would be pursued at
the pre -development meeting and the City has not received a request from the
applicant.

Impact on Existing and Future Development
The proposed change in zoning will impact surrounding properties by allowing additional
residential development to abut existing and future commercial and light industrial uses.
Majority of the parcel is bounded by commercial zone and future commercial
development to the north and south, especially around the area proposed to be rezoned
from GB to R-2, will have the added burden of dealing with residential adjacency
requirements in the future if this zone change is approved.
Additional Comments
The request has been reviewed by the City's Development Review Committee (DRC),
and there were no additional comments from other departments at the time of this
report.
Public Notification
Staff sent public notices, comment forms and a vicinity map to the applicant, the owner
of the property and to property owners within 200 feet of the subject property under
consideration for the zone change. Additionally. a legal notice of the public hearing was
published in the local newspaper, and a notification sign was placed on the property by
the applicant.
Opposition to or Support of Proposed Request
Staff has not received any returned notices in opposition to or in support of the
proposed change in zoning request.

This Letter of Intent is to serve as an indication of our interest in establishing
a R-2 Single Family Development on the below -referenced property. The
general terms are as follows:
PROPERTY: A Vacant Tract of land consisting of 12.4033 acres located on Fite
Rd Pearland, TX 77581 (see exhibit for current land condition).
PURPOSE: Establish a R-2 single family residential development as outlined in
the UDC.
SCOPE: The planned development is currently consistent with current zoning
district regulations, except lot width. In order to provide optimal spacing to the
planned development, width requirements, could not be achieved through the

Application and checklist filled out completely and signed by the owner of the property.

the property owner authorizing the agent to file the application on his behalf. Section 1.2.1.1
(a) of the Unified Development Code (UDC).

1 Parcel map, printed from the City of Pearland website, indicating the location and boundaries
of the subject property.
'Letter of Intent explaining the zone change request in detail, why the zoning is being requested
to be changed, and the uses that are being proposed.
E "Acknowledgement of the sign to be posted on the property ten (10) days prior to the public
hearing.
Q/Provide evidence or proof that all taxes and obligations have been paid regarding the subject
property.

Posting of Notification Signs on Property under
Consideration for a Zone Change
Any person, firm or corporation requesting a zoning change, a conditional use permit (CUP),
or a variance shall be required to erect and maintain a sign(s), to be inspected by the City,
upon the property for which a variance or zoning change has been requested.
Such sign(s) shall be located as follows:
(1) One (1) sign per street frontage shall be located within thirty feet (30) of the abutting street,
or as determined by the City.
(2) So as to be clearly visible and readable from the public right-of-way and not
obstructed in any manner.
(3) So as not to create a hazard to traffic on the public rights-of-way abutting the property.
(4) On the subject property at least ten (10) days prior to the hearing of such zoning
change request by the Planning and Zoning Commission, and to remain continuously on said
property until final action by the City Council or withdrawal of the case by the applicant. Removal
of the sign by the applicant prior to a recommendation by the Planning and Zoning Commission
and/or a final decision by the City Council shall constitute a withdrawal of the request.
(5) The signs shall be as follows:
• A minimum sign size of 2 feet by 3 feet, but no larger than 4 feet by 4 feet
• At least 2 feet above the ground
• Blue or black lettering that is a minimum of 3 inches by 1/2 inch, on a white
background
