BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City Council hereby approves application for Texas Water
Development Board Funding for the construction costs related to the Reflection Bay Water
Reclamation Facility Expansion and the design build costs for temporary wastewater
treatment package plant in the amount of S61.200.000.00. a copy of which is attached
hereto as Exhibit '`A" and made a part hereof for all purposes.
Section 2. The City Manager or his designee is hereby authorized to execute an
amended application for Texas Water Development Board Funding for the construction
costs related to the Reflection Bay Water Reclamation Facility Expansion and the design
build costs for temporary wastewater treatment package plant.

management purposes; and, to carry out appropriate portions of an area wide water quality
management plan;

This memo will provide an update on the status of the Reflection Bay Water Reclamation
Facility (RB WRF) Expansion, and the status of the Temporary Wastewater Treatment Package
Plant, being delivered via Design Build method. P
Memoranda dated 5/27/14 (3), 6/18/14, 7/24/14, 8/8/14 and 10/30/14 (2), 1/8/15, 3/4/15, 5/6/15
and 7/22/15.
Design Update for Facility Expansion — Update to 7/22/15 Memorandum
The Design effort for the expansion to a 6 MGD facility is at the 90% review status with plans
due for submittal September 25th. Equipment selection has been made and staff and the
engineer are working on the criteria set for use in the bid documents. A series of plan review
workshops is planned to conduct concurrent staff review. The current schedule is to bid the
project in late November. Staff and the engineer continue to monitor construction cost trends
for this particular type of work and the upward trend has not changed. The list of add/deduct
alternates and reductions in scope estimated at of $600.000. have been retained to provide
flexibility if necessary.
As discussed in the 7/22/15 memorandum. there will be a contract amendment in the amount of
$120.000 submitted for Council review that encompasses two items: the revision in building
materials from block/brick to pre -fabricated masonry ($70.000) and the change in UltraViolet
Disinfection equipment manufacturer ($50,000). The change in building material, while
requiring a $70,000 contract amendment will ultimately provide a cost savings of $480,000
(inclusive) in construction costs. The change in the UltraViolet Disinfection manufacturers is
driven by continued performance issues with the existing equipment. and a lack of support by

the manufacturer. The Contract amendment is being finalized and will be presented to Council
in October for consideration.
Current Facility Status — Update to 7/22/15 Memorandum
Facility flows continue to be over 100%. and the extent of variation of flows is affected by rain in
addition to population growth. This has been documented by staff and TCEQ will continue to be
notified in accordance with all appurtenant regulations. Improved performance from re-
programming and aeration basins improvements and this has improved treatment quality.
Temporary Wastewater Treatment Package Plant Update
The construction of the package is on schedule. Since the delivery of the aeration and clarifier
tanks for Phase 1, piping has been installed from the new influent pump station location to the
new headworks location and tanks.
• Civil/sitework construction is 90% complete.
• Installation of process piping is 50% complete.
• Welded effluent flanges of package plant aeration basins.
• Installed dewatering in preparation for the 42 in pipe tie in installation that will connect
the package plant to existing UltraViolet disinfection
• Electrical installation is underway and is 8% complete
• Installation of structural fill for equipment foundations
• Approved bids for concrete equipment foundations
Expected work in the next 2 months:
• Complete major piping installation
• Installation of foundation and new influent pump slab base
• Delivery of RAS/VIAS/Scum tankage. package plant filter
• Delivery of interior components of the clarifier for Phase 1
• Delivery of blowers
TWDB Funding for the Facility Expansion and Package Treatment Plant
The Texas Water Development Board (TWDB) funding assistance application was reviewed by
TWDB staff. and City staff provided some clarifications. Notification was received that the
application is to be considered by the TWDB in October 2015. and an estimated loan closing
timeframe is January 2016.
TCEQ Enforcement Action
The City has completed the Supplemental Environmental Project (SEP) agreement associated
with the Agreed Order (AO) and this has been documented with the TCEQ. The City has sent
a report regarding an updated schedule for both design and construction progress to the TCEQ.
There are provisions within the AO that do allow for amendments to the scheduling of the
projects. The City's update documents the current schedule for the package plant and plant
expansion and the extension request per the AO.

This letter is submitted on behalf of the City of Pearland (the "City") with regard to the
above -referenced Agreed Order (the "Order") to certify compliance with part of Ordering
Provision 3.a. and to request an extension for compliance with the remaining part of Ordering
Provision 3.a., Ordering Provision 3.b., and Ordering Provision 3.c. Included as Attachment A is
a memo from CDM Smith ("CDM") detailing the status of the City's efforts to achieve
compliance with the Order and showing that the design of the Emergency Capacity is 100%
complete, part of the requirement for Ordering Provision 3.a.
In addition to requiring the completed design of the Emergency Capacity, Ordering
Provision 3.a. also requires the City to have completed design of the New Facility. The deadline
for compliance with Ordering Provision 3.a. is September 1, 2015. Ordering Provision 3.b
requires the City to commence construction of the New Facility by November 2, 2015. Ordering
Provision 3.c. requires the City to complete construction of the Emergency Capacity by January
2, 2016.
To achieve compliance with Ordering Provision 3.a., the City contracted with CDM
Smith ("CDM") as discussed in Attachment A. After the design of the New Facility was 60%
complete, CDM estimated that construction of the New Facility would cost approximately
$43,000,000. This was $4,000,000 over the 30% design cost estimate, so CDM's focus over the
last few months has been on developing value engineering ideas to carry forward in the 90%
design submittal in order to keep the overall project construction costs within the City's budget
constraints. This effort delayed design progression to 90% complete, but resulted in the project
team identifying approximately $1,000,000 in construction cost savings. Final design of the
New Facility is now scheduled to be complete by the end of December 2015 and construction to
commence in March 2016.

As discussed in Attachment A, following the design of the Emergency Capacity, CUM
and the City determined that the Emergency Capacity should be built in two phases in order to
more quickly alleviate and address the loading issues at the existing Facility. Both phases are
expected to be completed by the end of June 2016.
Included as Attachment B is the Gantt chart prepared by CDM that estimates compliance
with the Ordering Provision 3.a. regarding completing design of the New Facility to be by the
end of December 2015. compliance with Ordering Provision 3.b. regarding commencing
construction of the New Facility to be in March 2016, and compliance with Ordering Provision
3.c. to be by the end of June 2016. The City therefore requests the deadline for compliance with
the part of Ordering Provision 3.a. requiring complete design of the New Facility be extended to
December 31, 2015. Given this requested extension, and the justification discussed herein, the
City also requests that the following Ordering Provisions be extended accordingly:

Plant Project & Rehabilitation and Expansion Project Progress Update
The following technical memorandum documents progress to date on the City of Pearland
Reflection Bay Water Reclamation Facility (WRF) Package Plant Project and the Reflection Bay WRF
2 MGD to 6 MGD Expansion and Rehabilitation Project.
Reflection Bay WRF Package Plant Expansion Project
The City of Pearland executed a design build contract with CDM Constructors Inc. on January 26th,
2015 for the design and construction of a 1 MGD package plant for temporary treatment at the
Reflection Bay WRF Plant. The design build project consists of installing a new step screen at the
existing headworks structure and construction of an influent pump station that will divert 1MGD of
flow through a new package plant facility. The project will tie the package plant flow into an
existing 42" pipeline prior to the existing UV disinfection system. The package plant facility is
separated into two (2) phases of work. Phase 1 will consist of eight (8) aeration basins, two (2)
clarifiers, Return Activated Sludge (RAS)/Waste Activated Sludge (WAS)/Scum pumps and tanks, as
well as new cloth disk filters. Phase 2 will consist of an additional eight (8) aeration basins, and two
(2) clarifiers. Additionally, there will be a bypass from the existing Sequence Batch Reactors (SBR's)
to two (2) new cloth disk filters. The flow from the existing SBR's will pass through the new filters
and then tie into the package plant flow prior to the existing 42" line upstream of the existing UV
disinfection facility.
The City of Pearland, CDM Smith and CDM Constructors project team commenced work in January
2015 with an anticipated completion date for Phase 1 of December 2015 and Phase 2 completion of
June 2016. Currently the project is on track for completing both phase 1 and 2 on the
aforementioned dates.
To date the team has completed 100% of design. Phase 1 aerations basins (8) and clarifiers (2) have
been fabricated and delivered. Photos 1 and 2 of the attached Exhibit A illustrate the aeration
basins and clarifiers on site. The headworks tower. RAS/WAS/Scum tank and blowers are
scheduled for delivery in the end of September 2015. The cloth disc filters are in fabrication with an
expected delivery of late September 2015. The new storm sewer has been installed and the existing
storm sewer has been demolished. Other construction activities include installation of the 30"
filtered effluent line from the SBR filters to the existing 42" tie in location, as well as the installation
of the 12" raw sewage line from the influent pump station to the package plant headworks tower.
Photos 3 and 4 in Exhibit A attached illustrates construction activity for the installation of the 30"
filtered effluent line and the 12" raw sewage line. The 42" tie in materials have been delivered. The
motor control centers for the new package plant have been fabricated, delivered and installed. The
electrical contractor has installed the direct bury cables from MCC -D to the blowers.
The project team is working diligently to compress the contract schedule and expedite the work to
complete the project ahead of schedule.
Reflection Bay WRF 2 MGD to 6 MGD Expansion and Rehabilitation Project
The City of Pearland executed a design contract with CDM Smith, Inc. on August 11, 2014 for the
expansion and rehabilitation of the Reflection Bay WRF. The project includes expansion of the
existing influent lift station, new headworks structure, new SBR trains to handle increased flow and
improvements to the existing SBR trains including a new blower facility, new tertiary filtration,
expansion and replacement of the existing UV facility equipment, new sludge holding tanks and
dewatering feed pumps, new belt press equipment installed in the existing dewatering building,
modifications to the existing dewatering building, new non -potable water system facility, new
emergency generator, SCADA improvements, and miscellaneous other improvements include yard
piping, pacing and drainage, and site improvements to accommodate increased capacity.
The project has progressed to complete 60% design and is currently scheduled to complete 90%
design by November 9, 2015. The project team has been focused over the last two months on
developing value engineering ideas to carry forward in the 90% design submittal in order to keep
the overall project construction within budget constraints which has delayed design progression to
90%. Following the 60% design submittal the Opinion of Probable Construction Cost was
approximately forty three million dollars, 4 million over the 30% design submittal Opinion of
Probably Construction Cost. Through the value engineering process the project team has identified
approximately one million dollars in construction cost savings. Final design is scheduled to
complete by the end of December 2015 and construction commence by the end of March 2016.
