Ord. 1358-12 2015-02-09ORDINANCE NO. 1358-12 An Ordinance of the City Council of the City of Pearland, Texas, amending non -development usage and service fees; containing a savings clause, a severability clause and a repealer clause; providing for publication and an effective date. WHEREAS, various departments of the City charge fees for usage, permits, and other services not related to development; and WHEREAS, the organization of all such non -development fees into one ordinance enhances the efficiency of the fee amendment process and improves customer service; now, therefore. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the charges and fees contained in the attached Exhibit "A" are hereby adopted. Section 2. Savings. All rights and remedies which have accrued in favor of the City under this Chapter and amendments thereto shall be and are preserved for the benefit of the City. Section 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 4. Repealer. All ordinances and parts of ordinances in conflict herewith are hereby repealed but only to the extent of such conflict. Section 5. Publication and Effective Date. The City Secretary shall cause this Ordinance, or its caption, to be published in the official newspaper of the City of Pearland. ORDINANCE NO. 1358-12 upon passage of such Ordinance. The Ordinance shall then become effective ten (10) days from and after its publication, or the publication of its caption, in the official City newspaper. Director of Finance: Lata Krishnarao, Community Development Director Date: 7 January 2015 Re: Health Permit Fees In 2012, staff proposed an increase in fees for permitting food establishments as they had not been reviewed nor updated since 1999. After Council consideration, staff was asked to make adjustments to the proposed fees in order to reduce impact and/or hardship on smaller establishments with only 1 to 10 employees. Adjustments were made and staff reviewed once again with Council. Council adopted the budget (FY2013) that included the revenue with the new fees for health permits which proposed an estimated $71,000 increase in revenue. We have reviewed the fees of surrounding cities and included the City of Houston in the new fees study. In some instances, we are below other city fees and in some instances we are a bit higher than mid -point. If the proposed increases in fees are approved and adopted, the revenue in these fees will increase by approximately $12.025. See attached revised fee study. We have added an additional 44 new restaurants to our City in 2014. This adds an additional 88 base health inspections and an estimated 176 follow up inspections to our Health officer's inspection rotation list without adding additional staff. As the City continues to grow, we anticipate a significant increase in the number of restaurants and may need to add staff in order to keep up with the City's Code of Ordinances which requires at least two health inspections per year. At this time, we recommend a nominal increase ($25 added to each type of fee) to cover the increased workload on Code Enforcement. This modest incremental increase still places us below or in the range of fees of the surrounding cities that were surveyed. Attempting higher fees to align with other cities may have an adverse impact on smaller establishments. We believe it is prudent to have small reasonable fee adjustments as necessary that recognize the costs of inspecting and/or increased workload for inspectors in Pearland.
