MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, HELD ON SEPTEMBER 15, 1997, AT 7:00 P.M., IN THE
COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS.
The meeting was called to order with the following present:

City Manager Paul Grohman is absent because he is attending the I.C.M.A Annual
Conference.
PROPOSED ANNEXATION (COUNTY ROAD 89/COUNTY ROAD 91 AREA)
To consider the proposed annexation of approximately 452 acres south of the current
City Limit in the vicinity of County Road 89 and County Road 91 in Brazoria County,
Texas; read into the record by Mayor Reid.
STAFF REVIEW OF PROPOSED SERVICE PLAN
City Attorney, Amy McCullough, presented the location of the proposed annexation
and explained the Service Plan in detail.
CITIZEN COMMENTS
Nancy Milstead, 2408 County Road 89, addressed Council and stated that she did
not like being annexed. She further stated that she enjoys living in the country and
has a concern for her animals. She feels people ought to be able to vote if they want
to be annexed or not. Mrs. Milstead asked why the City is encouraging growth? She
said there already is flooding problems, and asked if the residents have to pay for the
water and sewer line from their house to the City line and also wanted to know what a
TIFF is?
E.R. Milstead, 2408 County Road 89, addressed Council and stated he was asking for
mercy. He said the annexation will only give people water and sewer. He also
expressed his concerns about flooding, and with additional growth the problem could
be worse.
Lonnie Turner, 2414 County Road 89, stated he enjoys country life and he is not in
favor of the annexation at this time. He said he had a question and concern and
asked Council if he would receive water and sewer service form the M.U.D. across the
street or from the City of Pearland?
Lily Gray, 2150 County Road 89, stated she is not in favor of the annexation at all
because she enjoys the country and the animals. She had concerns that her
grandchildren could not enjoy the country life, and asked if the City could go another
direction and leave them out of the annexation?
COUNCIL/STAFF DISCUSSION
Mayor Reid stated that he would try and see that all of the concerns and questions
that the speakers have would be answered during this section of the meeting.
City Attorney, Amy McCullough, stated that the animals that are currently on these
tracts of land are grandfathered, and they are protected as long as the number of
animals do not increase. She further stated that the only exception would be a
legitimate health problem that would be addressed at that time.
City Attorney, Amy McCullough, explained that a TIFF is financing by which the City
will issue bonds to pay for infrastructure for a certain area. The financing is done on
a long term basis, and only the area the TIFF is in will pay back the bonds.
Councilmember Cole stated that the citizens at the hearing tonight are not in a TIFF
area.
City Attorney, Amy McCullough, stated that the City is annexing these areas to have
control of the development and the use. She further stated that the City has zoning,
and any development is subject to zoning. Therefore, regulating the development of
the property will insure the best use that is compatible for that area.
City Attorney, Amy McCullough, stated that it is the responsibility of the property
owner to pay for the water and sewer line from their property to the utility easement.
Councilmember Wilkins asked the City Attorney if the Impact Fee has to be paid all at
one time?
City Attorney McCullough stated the fee has to be paid in full at the time that service
is requested. She further stated that a payment plan is not available.
City Attorney, Amy McCullough, addressed the procedure for requesting water and
sewer service from the City when it is available, or possibly, a resident could get
service from a M.U.D. if there is one in that area.
Mayor Reid stated that the City is encouraging growth in low polluting, high valued,
industrial facilities. He stated that is what the Pearland Economic Development
Corporation has been established for.
City Attorney, Amy McCullough, stated that it is a privilege of the City to annex
property unilaterally and that the statutes does not require the annexation to go
before the voters.
