1997-09-15 CITY COUNCIL PUBLIC HEARING MEETING MINUTES 6:30PMMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON SEPTEMBER 15, 1997, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Mayor Pro Tem Councilmember Councilmember Councilmember Councilmember City Attorney City Secretary Tom Reid Helen Beckman Larry Wilkins Richard Tetens William Berger Kevin Cole Amy McCullough Young Lorfing City Manager Paul Grohman is absent because he is attending the I.C.M.A. Annual Conference. PROPOSED ANNEXATION (MANVEL ROAD/COUNTY ROAD 101 AREA) To consider the proposed annexation of approximately 2097 acres south and west of the current City Limit in the vicinity of FM 1128 (Manvel Road) and County Road 101 in Brazoria County, Texas; read into the record by Mayor Reid. STAFF REVIEW OF PROPOSED SERVICE PLAN City Attorney, Amy McCullough, presented the location of the proposed annexation and explained the Service Plan in detail. CITIZEN COMMENTS George Contes, 16035 Lea Lane, addressed Council regarding his concerns for the east and west, and north and south roadway. He also inquired as to who will receive water and sewer services first. Bob Shear, 5210 Spring Circle Drive, addressed Council and stated that he understands that property tax rate is .6950/$100. and asked Council what property owners will receive for the tax money, what tract of land SWEC is on, and what is it going to do? Vincent Campo, 6616 Confederate, addressed Council and stated that he understood that if you already have water and sewer you will not have to tie onto the City. He also had concerns, that approximately 20 years ago, where he used to live they had an outside water district. He said the water district was talking about running a sewer and water line, and if the residents were within 200 to 300 feet of the property, they had to tie on to the system whether they wanted to or not. Terry Jacobs, County Road 554, addressed Council and stated that he had a meeting schedule that was wrong. He stated he did not know what the annexation can give him and no one at City Hall can answer any questions except Alan Mueller. He also asked Council if there is a fee for the annexation, and further stated that he was against this annexation. Tom Sullivan, 5418 West Lea, addressed Council and stated he was with the Drainage Committee and he has been working with the Drainage District. He further stated that he has concerns regarding flooding in his area. Mr. Sullivan encouraged more public input for the Clear Creek Drainage Project and ask for support from the City. Pat Swear, 3611 Wingtail, addressed Council and stated that West Lea's water and sewer is a nightmare. She said when there is a problem they pump sewer into the ditches, and she further stated that when she had company over they could not take a bath because they did not have enough water pressure. She also said that their water bills are not being figured right, and they have black water. Ms. Swear stated that they need City water. COUNCIL/STAFF DISCUSSION Mayor Reid stated that he would try and see that all of the concerns and questions that the speakers have would be answered during this section of the meeting. Mayor Reid addressed the concern regarding drainage and stated that the City has passed a Resolution to encouraging the continuation of the Clear Creek Project and the City is supporting the Project. Mayor Reid addressed the requirements to tie onto water and sewer and deferred the question to City Attorney, Amy McCullough. Ms. McCullough said that her comment stands as stated earlier, that you do not have to tie onto the water and sewer system. She further stated with one caveat there is a 100 foot requirement, and unfortunately, she can not address that at this time. She said she would research it and respond to Mr. Campo's question at a future date. Mayor Reid stated that a Home Rule City has the ability to annex in its extraterrialtorial jurisdiction. Therefore, the City does not have to have an election concerning annexation. The City is trying to square off its boundaries and control the type of businesses and construction in the City. City Attorney, Amy McCullough, addressed the question regarding a schedule with an incorrect date on it. She stated the City had drawn up some in-house preliminary schedules, and unfortunately he must have gotten one of those schedules. However, at the last Public Hearing it was announced that the second Public Hearing would be held today. 9 i�' City Attorney McCullough stated that there are not any annexation fees that the residents have to pay. City Attorney, McCullough stated she wanted to publicly apologize to Mr. Jacob if he was unable to get his questions answered. Mr. Mueller did have an emergency in his family and was not available. She also said for anyone whose questions do not get answer at this meeting, she would like to get their telephone number so that staff can research those questions and respond to them in a timely manner. City Attorney, Amy McCullough presented the location of the Southwest Environmental Center (SWEC) and stated that its purposes is for a water and sewer treatment plant, water wells, a regional detention facility, and a regional training center. Councilmember Cole addressed the concerns regarding the roadways. He said the City does have a thoroughfare plan as called for in the Charter, and those plans are available for public inspection. Councilmember Cole also stated that the City would offer water and sewer service in populated areas first. He stated usually a developer will take care of the needs for newly developed property. City Attorney, McCullough confirmed that the property tax rate for the City is $.6950 per $100 of value. Mayor Reid stated that we are not annexing rapidly. We are doing a planned annexation for purposes of protecting the roadways and the City. He also stated if anyone else has any concerns please contact staff.
