MINUTES OF THE JOINT PUBLIC HEARING FOR THE CITY COUNCIL AND THE
PLANNING AND ZONING COMMISSION, CITY OF PEARLAND, TEXAS, HELD ON
NOVEMBER 17, 2014, AT 6:30 P.M.. IN THE COUNCIL CHAMBERS - CITY HALL -

City PlannerJohnna Matthews presented the public hearing process and orderofthe
agenda.
Mayor Tom Reid opened the public hearing for Zone Change Application No. 2014-06Z
at 6:50 p.m.
PURPOSE OF HEARING
P&Z Chairperson Henry Fuertes read the purpose of the hearing into the record.
Zone Change Application No. 2014-19Z
A request of Chad Thumann, applicant: on behalf of Wayne Thumann, owner: for
approval of a change in zoning from the General Commercial (GC) and General
Business (GB) zoning districts to the General Business (GB) and Single Family - 1 (R-1)
zoning districts: on approximately 2.734 acres of land. to wit:
Legal Description: Being 1.385 acres of land out of called 14.0513 acres of I4nd,
said 14.13 being all of Lots 9 and 12 and Part of Lot 7 of partition of the East of
Northwest of Section 15, HT&B RR Co. Survey, A-241, Brazoria County, Texas and
being the South 183.60 feet of Lot 8, and a portion of Lot 7 out of a called 14.0513 acre
tract being all of Lots 9 and 12 and Part of Lot 7 of partition of the East '72 of Northwest

APPLICATION INFORMATION AND CASE SUMMARY
Senior Planner Ian Clowes read the staff report stating the applicant requested a
change in zoning from the General Commercial (GC) and General Business (GB)
zoning districts to the General Business (GB) and Single Family - 1 (R-1) zoning
districts.
Mr. Chad Thumann, applicant. was present and made a brief statement. Mr. Thumann
stated he intended on using the front portion as GB and the rest of the property as
R1. Mr. Thumann also stated that a pipeline ran thru the middle of the property and
he would use that as a division point.
There was no one present to speak for or against the proposed request.
Council Member Greg Hill asked where the pipeline ran. Mr. Chad Thumann stated
it ran parallel to Broadway on the property.
Council Member Scott Sherman inquired about the differences in General
Commercial (GC) and General Business (GB). Senior Planner lan Clowes stated that
(GC)allowsfor more intense uses and (GB)was intended more for retail use.
Council Member Tony Carbone questioned the airstrip that was east of the property,
and wanted to know if the UDC addressed it if it ran into Residential. Senior Planner
Ian Clowes stated that it did not.
Mayor Tom Reid adjourned the public hearing process for Zone Change No. 2014-

Zone Change Application No. 2014-20Z
A request of BGE Kerry R. Gilbert and Associates. applicant on behalf of CL Ashton
Woods, LP., owner: for approval of a change in zoning to amend the Southern Trails
Planned Development (PD), from an overlay zoning district which allows for
Civic/Church uses to General Business (GB) uses: on approximately 0.9 acres of
land of the total 522.62 acres, to wit:

Legal Description: A certain parcel of ground together with all the buildings
and improvements being a portion of No. 2 Southern Trails Commercial No. 1, H.T.
and B.R.R. Company Survey. Section 84. A-538. City of Pearland. Brazoria County,
Texas.
General Location: South side of Broadway Street. between Windward Bay Drive to
the west and Kingsley Drive to the east, Pearland, TX

City PlannerJohnna Matthews read the staff report stating the applicant was applying
fora zone change to General Business (GB) and that staff recommended approval.
Mr. Kerry Gilbert 23501 Cinco Ranch Blvd Katy TX, stated they did not concur with the
required landscaping in the PD Mr. Gilbert stated they could not comply with the
landscape plans because they did not own the property.
There was no one present to speak for or against the proposed request.
Council Member Greg Hill stated that he was not opposed to the zone change.
Council Member Gary Moore stated he was not opposed and inquired about the space
for buffering. Mr. Kerry Gilbert stated that he had not seen the plans yet, but that they
would comply with the UDC. Mr. Gilbert stated that the plans would be shown to staff
when they were ready.
Mayor Pro Tern Keith Ordeneaux stated he would like to see a list of the uses.
Council Member Tony Carbone stated that he agreed with Keith Ordeneaux, and would
like to see a list of allowed uses. Mr. Carbone also stated that we could not enforce the
trees being planted if the client did not own the property.
P&Z Chairperson Henry Fuertes inquired about the acreage of the property and asked if
staff had sent out the notification letters. Mr. Gilbert stated the acreage was about 13
acres. City Planner Johnna Matthews stated yes. the letters had been mailed out. Ms.
Matthews stated that she received one letter in opposition and that they were present at
the meeting.
Mr. Paul Donnelly stated that he and his wife were not opposed to the zone change
anymore after finding out what itwasfortonight.
P&Z Vice Chairperson inquired about the height of the masonry wall. Mr. Ian Clowes
stated that a new 8' wall would be required to match the new CVS.
Mayor Tom Reid adjourned the public hearing process for Zone Change No. 2014-20Z
at 7:20 p.m.
