1997-09-08 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES-71 MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON SEPTEMBER 8,1997, 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The hearing was called to order with the following present: Mayor Mayor Pro -Tem Councilmember Councilmember Councilmember Councilmember Vice -Chairperson Commissioner Commissioner Commissioner P&Z Secretary Tom Reid Helen Beckman Larry Wilkins Kevin Cole William Berger Richard Tetens Emil Beltz Mary Starr Tommy Scott Jack Mathis Judy Highburger Others in attendance: Project Coordinator Alan Mueller; City Engineer John Hargrove; Planning and Development Director Dennis Smith; City Attorney Amy McCullough; City Manager Paul Grohman; Chief Mike Hogg; Senior Intern Ruby Perez; and City Secretary Young Lorfing. I. CALL TO ORDER The joint public hearing was called to order at 6:30 p.m. and the purpose of the meeting was read into the record by Vice Chairman Emil Beltz. II. PURPOSE OF HEARING- APPLICATION NO. 224 Request of Mark and Robyn Smith, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Single Family Dwelling District (R-1) on the following described property, to wit: Lot 7, Block 3, Section 2 of the Garden Acres Subdivision of the H.C. Johnston 99 Acre Tract, also being the south 99 acres of section 7 of the H.T.&B.R.R. Company Survey, A-219 in Brazoria County, Texas. (2628 Lazy Bend Street) Planning and Development Director Dennis Smith, presented the location of the proposed zone changes. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Ms. Robyn Smith of 2628 Lazy Bend, was present and requesting approval of the application. She was advised to zone her property to R-1 but is unclear on the meaning, and asked for more information. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mayor Reid explained the R-1 category to Ms. Smith, and told her it was to her benefit to zone her property R-1, as she had a single family dwelling. He went on to say that R-1 carries the highest category rating in the community. Mayor Reid advised Ms. Smith to contact Mr. Smith after the meeting for further clarification. VI. ADJOURNMENT The joint public hearing adjourned at 6:44 p.m. APPLICATION NO. 137 AND 138. I. CALL TO ORDER The joint public hearing was called to order at 6:45 p.m. The purpose of the hearing was read into the record by Vice Chairman Beltz. Mayor Reid suggested joining the two applications under one heading. 11. PURPOSE OF HEARING Request of owner for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Multi -Family Dwelling District (MF) on the following described property, to -wit: Located in the Sandoval Subdivision, a part of Section 15 in the H.T.&B.R.R. Co. Survey, A-241, Brazoria County, Texas: 1. Zoning Application No. 137 Owner: Linda A Halsey Agent: None Legal Description: .620 acres in the west 1/2 of the northwest 1/4 of the northeast 1/4 of section 15, H.T.&B.R. Co. Survey, A- 241, Brazoria County, Texas. Address: None 73 2. Zoning Application No. 138 Owner: Linda A Halsey Agent: None Legal Description: 1.285 acres out of Lots 10 & 11 of a partition of the east 1/2 of the northwest 1/4 of Section 15, H.T.&B.R.R. Co. Survey, A-241, Brazoria County, Texas. Address: None Mr. Smith presented the locations of the proposed zone changes. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST. Ms. Linda A. Halsey Bracewell of 308 W. Thomas, Pasadena, Texas, was present. She wished to change her request from MF on Application No. 137, to Single Family Residence (R-1) and divide out a portion of the property for an access drive. Ms. Halsey Bracewell said the other property was not part of the subdivision. Houston Lighting and Power informed her that the property is an easement and is egress onto the property on Application No. 138. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Mr. Sam Willits of 2735 Morenci Street, explained he moved here 25 years ago, and they built and maintained the street. He is opposed to the idea of apartments or condos, and the increased traffic that would create. Mr. Rudy Sandoval, 1421 Morenci Street, is against apartments being built there and feels it should be R-1. Ms. Alice Sandoval Gutierriz, 6600 Broadway, said the property in question was owned by her family, and it is not in the best interests of the surrounding residents to have apartments there. Mr. Juan Vega, 2750 Morenci Street, is opposed to apartments being built on the property. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Councilmember William Berger asked the width of the strip of land on Application No. 138, and Ms. Halsey Bracewell replied that it was 72' wide by 800' long. Mr. Berger asked if she was the owner of the entire section, and she said she was except for the easement owned by Houston Lighting and Power for power lines. Mr. Berger asked if there was an existing residence on the property, and Ms. Halsey Bracewell said yes and the other lot (Application No. 138) was vacant. Mr. Smith said the existing home on Application 137 should be rezoned to R-1, and he needs additional information from Ms. Halsey Bracewell. She said she spoke to the Planning Department to explain that the property was offset and she wanted access to the back of the property, and was advised to zone it MF. Councilmember Kevin Cole asked if 72' is enough space to develop a residence according to the Subdivision Ordinance. Mr. Smith replied he will check into it and get back to the Council and Commission. VI.
