A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING A CONTRACT AMENDMENT FOR ENGINEERING
DESIGN SERVICES ASSOCIATED WITH THE BAILEY ROAD PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract amendment for engineering design services
associated with the Bailey Road Project, a copy of which is attached hereto as Exhibit "A@
and made a part hereof for all purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest a contract amendment for engineering design services
associated with the Bailey Road Project.

Amendment No. 6 for TxDOT/FM 1128 Revisions and Environmental Services
Dear Cara:
Recommendations
Bailey Road improvements between FM 1128 and Veterans Road recently received 80 percent
federal funding. After meeting with TxDOT representatives, it was determined that NEPA
process is now required. Due to the fact that this is an added capacity project, a full
Environmental Assessment (EA) will be required to comply with Federal funding
requirements.
Bailey Road completed plans and specifications were provided to the City of Pearland in May,
2011. The sealed plans were then sent to TxDOT for formal review and comments.
Comments were received from TxDOT on the Bailey Road plans that had a significant impact
on the design and construction cost of the project. A meeting was held with the City of
Pearland on July 2, 2013 to discuss alternatives. It was decided in the meeting that the team
would pursue design changes that would remove any FM 1 128 widening and limit the work
performed in State ROW to the minimum.

Supplemental Work Justification
Changes to the plans are required to remove requirements for the work along FM 1128 and to
modify drainage plans at Veterans Drive.
CDM Smith team members respectfully request extra hours and compensation to fully cover
these services which include the following additional work in scope and fee for project re -start:
o Revisions to the intersection of FM 1 128 to avoid widening and improvements
along that corridor
o Environmental/NEPA work- CDM Smith included Klotz Associates on team to
assist with EA
o Modify drainage improvements at the eastern limit to reflect property
acquisition on southwest comer of Veterans Drive intersection
o Construction of 10' mixed use sidewalk on north side of Bailey instead of 8'
sidewalk included in current plans per TxDOT criteria
o Update of Noise Study completed by CDM Smith to comply with current
standards
o Attend DCC meeting to confirm design standards meet State/Federal
requirements
o Update TxDOT standards that have evolved over the interim
o Address TxDOT 90% and Final comments
o Revise signal at FM 1128 to match revised intersection plans
o Field visits to update visual survey of driveways along Bailey Road
Supplemental Work Scope
Refer to Appendix 'A' for the additional scope of services.
Supplemental Work Fee
The original contract was signed on August 20, 2008 and approved by the Pearland City
Council on August 25, 2008. Notice to Proceed came September 15, 2008. The CDM Smith
team respectfully requests supplemental compensation of $ 393,775 be added to the amended
total fee of $1,848,685 for this additional work (See Contract Summary).

September 30, 2016 to address the additional work and include construction phase services.

Management Services (CDM Smith)
The following services will be added to the contract for the oversight of work by sub
consultants in Supplemental Number 6.
Additional overall management including: daily coordination, team meetings, FTP site,
project scheduling, review progress reports/invoices. Review QC/QA plans, QC/QA
audits, status payments. This includes total management of all sub consultants. Also,
management services for coordination with TxDOT, city of Pearland and environmental
subconsultant which include attending external meetings including public meeting. The
meetings will include two for design changes and six additional progress meetings
concerning the environmental effort. Additional work for plan assembly for 90% and
final submittals and coordinating signing of the revised mylars. Additional management
of the design phase services which include revising Project Manual, address comments
by TxDOT and City, revise construction cost estimate, update standards and coordinate
submittals with other entities.

Traffic Signal Plans (CDM Smith)
The proposed modification to the roadway plans at the intersection of Bailey Road and
FM 1128 would impact the temporary and permanent traffic signal plans for this
intersection. This supplemental would update the following traffic signal plans:
• Temporary Signal Plan Layout (Bailey Rd at FM 1128) — 12 sheets
• The temporary signal plans will be revised to reflect the updates to the traffic
control at this intersection.
• Permanent Signal Plan Layout (Bailey Rd at FM 1128) — 3 sheets
• The permanent signal plans will be revised to reflect the updates to the roadway,
utility and drainage plans.
• Quantities and estimates — 1 sheet
• The quantity summary sheet for the traffic signal plans will be updated to reflect

Roadway Design Services (IDC)
Roadway Design Services
Modify final design to eliminate proposed roadway improvements for FM 1128. FM
1128 will remain as asphalt pavement with widening at the radius of return areas only.
Existing pavement of FM 1128 within the right-of-way will then have the asphalt
overlay. Permanent traffic signal and wheelchair ramps in ADA compliance are
proposed at the FM 1128 and Bailey Road intersection. Modify roadway design to revise
sidewalk from 8 ft to 10 ft. This impacts the proposed typical sections, roadway P&P
sheets, street lighting plans, and earthwork cross sections. Because of these changes, the
following drawings are impacted and need to be modified, and the quantities have to be
reviewed, checked, and updated:

Preliminary Engineering Services
FHWA rules will require an environmental document be prepared, to include 2
alternative alignments in addition to the preferred alignment. Scope includes preparing 2
new geometric alignments, and updating the existing schematic. These alignments will be
included in the ENV document. A public meeting will be conducted to support the ENV
process. Scope includes preparing exhibits, attending 1 preparation meeting with TxDOT
and City staff, and attending 1 public meeting and setting -up exhibits for the meeting.
Drainage Design Services (DEC)
Due to comments from TxDOT at the intersection of FM 1128 and Bailey Rd, The City
of Pearland decided to minimize work around the intersection. In summary, the concrete
paving for Bailey Rd will stop at the west and east ends of the curb radii. Particular for
drainage, it is our understanding that the existing storm sewer layout at the intersection
will be modified as little as practicable. Also, the sidewalk is going to be expanded from
8 ft. to 10 ft. The proposed roadside ditch will be affected along the road. Once, the
current drainage plan is modified, it will have a ripple effect on the other calculations/
drainage including pipes and drainage quantities, temporary drainage/traffic control,
hydraulic data sheets, and plan and profile sheets.

Landscape Architectural Services (CCA)
Revise planting and irrigation sheets to reflect the revised limits of work. Adjust
irrigation plans to reflect independent electrical service drop to feed proposed irrigation
controller.
Environmental Report Services (Klotz Associates)
The work to be performed by Klotz Associates, Inc. (Engineer) under this contract
consists of providing engineering services required for the preparation of an
Environmental Assessment (EA) and public involvement for approximately 2.5 miles of
Bailey Road from FM 1128 to Veteran's Drive in the City of Pearland. The project
consists of widening Bailey Road from a two lane undivided roadway with open ditches
to a four lane divided curb and gutter roadway with open ditches and a sidewalk.
A. Environmental Document
The services to be provided by the Engineer include preparation of an EA document and
public involvement.
The EA will be prepared in accordance with current Texas Department of Transportation
(TxDOT) and Federal Highway Administration (FHWA) regulations, guidelines,
standards, and criteria as of the date of this Scope of Services.
All work on the project shall conform to the applicable requirements of TxDOT and
FHWA. All work to be performed shall be subject to review and approval by the City of
Pearland, TxDOT and FHWA.
The work required is described below according to each task to be performed.
Task 1 — Data Collection
The Engineer shall collect and review available data pertaining to this project and the
project area. The Engineer shall gather information for the existing conditions such as
existing facility and roadway network, land use and demographics.
The Engineer shall collect, review and evaluate available and appropriate data pertaining
to the project area, including but not limited to, land use maps, aerial photography as
available, demographic maps, census information, historical and archeological site
listings, Potential Archeological Liability Map (PALM), digital orthophoto quadrangle
maps, national wetland inventory maps, floodplain maps, Brazoria County Soil Survey,
hazardous materials database information, traffic data for existing year and proposed
design year, proposed letting schedule, accident data, design study report, drainage
report, and any other pertinent information related to this proposed project. The

schematic design and other design drawings needed to complete the EA will be collected
from others.
Task 2 — Right -of -Entry Letters
Any needed right -of -entry for this project will be provided by others.
Task 3 — Agency Coordination Letters
The Engineer shall prepare and send coordination letters to Texas Parks and Wildlife
Department and Brazoria County Historical Commission.
Task 4 — Project Scope for Environmental Review Documents
The Engineer shall complete the Project Scope for Environmental Review Documents
and attend up to two meetings with TxDOT/Pearland regarding this checklist. This task
shall include revising the checklist per four sets of comments from TxDOT.
Task 5 — Alternatives Analysis
The Engineer shall prepare an alternatives analysis of the no -build alternative and the
following three (3) possible build alternatives: 1) Acquiring all of the proposed ROW
from the north side, 2) Acquiring all of the proposed ROW from the south side, and 3)
Acquiring varying amounts of ROW from both sides.
The alternatives will be evaluated using data collected under Task 1, accident data (if
available) and property ownership information from the Brazoria County Appraisal
District. The alternatives analysis will consider the following: hazardous materials,
National Wetlands Inventory (NWI) wetlands, cultural resources, floodplains, residences,
businesses, utilities, and threatened and endangered species habitats. In addition, the 2010
Census data shall be collected pertaining to population, ethnicity, income levels, and
Limited English Proficiency (LEP) down to the lowest level available (census, block,
group) for the three build alternatives. This data shall be used to evaluate and assess any
differentiable impacts to minority, low income, and LEP populations from the
alternatives.
The Alternatives Analysis section of the EA shall be prepared to document the data
sources, methodology, and potential impacts for each alternative.
An evaluation of the feasible alternatives shall be performed using the following criteria:
• Need and Purpose for the Project
• Costs
• Impacts to environmental resources
The three (3) build alternatives shall be evaluated at an equal level of detail and a
preferred build alternative will be selected and carried forward for detailed analysis in the
EA along with the no -build alternative. Only the one preferred alternative will be carried
forward for detailed analyses in the EA.

Task 6 — Noise Analysis
A noise analysis for the proposed Bailey Road widening project has been previously
conducted by CDM Smith. CDM Smith will update the noise analysis based on FHWA's
noise regulation changes under 23 CFR 772 that went into effect on July 13, 2011,
TxDOT's "Guidelines for Analysis and Abatement of Roadway Traffic Noise" dated
April 2011 and TxDOT's Standards of Uniformity (SOU) for Traffic Noise Analysis
dated October 2011. CDM will also update the TNM 2.5 files with recently updated
traffic volumes. Klotz Associates work under this task includes performing QA/QC
review of the TNM 2.5 files.
Task 7 — Mobile Source Air Toxics Analysis
Since the existing traffic volumes and the projected design year traffic volumes do not
exceed 140,000 vehicles per day, this project is not likely to meaningfully increase
Mobile Source Air Toxics (MSAT) emissions. Therefore, a quantitative MSAT analysis
shall not be conducted but a qualitative MSAT analysis shall be conducted and the results
documented in the EA in accordance with TxDOT's 2006 Air Quality Guidelines, Air
Quality Guidelines MSAT addendum dated October 3, 2011, Air Quality SOU dated
August 31, 2011, and Air Quality Standard Operating Procedure dated September 1,
2011.
Task 8 — Air Quality Analysis
Since the existing traffic volumes and the projected design year traffic volumes do not
exceed 140,000 vehicles per day, a Traffic Air Quality Analysis shall not be required.
Standard recommended template language per TxDOT's Air Quality SOU shall be used
in the EA.
Task 9— Indirect and Cumulative Impact Analyses
Perform an Indirect Impacts Analysis and Cumulative Impacts Analysis in accordance
with TxDOT's Revised Guidance on Preparing Indirect and Cumulative impact Analyses
dated September 2010. The analysis and results will be documented in the EA.
Task 10 — Cultural Resources
Archeological Resources
Terracon will prepare text discussing pertinent information with respect to the
Archaeological Survey performed by Terracon and Archaeological Survey Report written
by Terracon in 2009. Terracon will also incorporate all necessary information as outlined
in TxDOT's SOU for Archeological Resources for EAs. The text will include
information regarding the survey methodology and findings, Texas Historical
Commission (THC) coordination, and THC approval. Terracon will additionally prepare
the Project Coordination Request (PCR) for Archeological Studies form required by
TxDOT for EAs. It is Terracon's understanding that the area previously surveyed for the
presence of archeological resources is the same area for the proposed Bailey Road
Widening Project. The THC has approved the survey and has stated that the project may
proceed. Therefore, additional archeological surveying is not anticipated and is not
included as part of this scope.

Historic Resources
AmaTerra shall prepare a Non -Archeological Historic Resources Project Coordination
Request (October 2009 version) for review and comment by TxDOT-ENV.
If required by TxDOT, AmaTerra shall prepare a research design for review and
comment by TxDOT-ENV. The research design shall conform to TxDOT Research
Design SOU: Non -Archeological Historic -Age Resource Research Designs Review
Checklist (October 2009 version).
AmaTerra shall perform a reconnaissance survey conforming to the methodology
outlined in Appendix B of the Draft CRM Guide for Accurately Identing Non -
Archeological Cultural Resources (Texas Department of Transportation, April 2006).
The survey shall document each historic -age resource (defined by TxDOT as a building,
structure, object, historic district or non -archeological site at least 45 years old at the time
of letting) within the Study Area. The Study Area shall consist of the Area of Potential
Effects (APE) plus all parcels that are wholly or partially within the APE.
AmaTerra shall provide a report detailing the results and findings of the reconnaissance
survey including effects to historic properties and the need, if any, to conduct intensive
survey efforts. The report shall have sufficient detail and clarity to provide THC with the
basis for making determinations of National Register of Historic Places (NRHP)
eligibility or shall have sufficient detail and clarity to make recommendations concerning
the scope of the intensive survey. The report shall conform to the TxDOT Standards of
Submission for Non -Archeological Historic -Age Resource Reconnaissance Survey
Reports Review Checklist (October 2009 version).
Task 11 — Socioeconomic and Environmental Justice
The 2010 Census data collected under Task 1 will be used for population, ethnicity,
income levels, and Limited English Proficiency (LEP) down to the lowest level available
(census, block, group). This data shall be used to evaluate and assess any impacts to
minority, low income, and LEP populations.
The Engineer shall also prepare a baseline inventory consisting of existing community
conditions in order to address social effects on the project area encompassing any effects
on neighborhoods and communities, including travel patterns and accessibility, impacts
on schools, places of worship, businesses and recreation and social (public) groups.
Neighborhood cohesiveness shall be identified through physical features and
socioeconomic profiles in order to complete a community impact analysis.
Task 12 — Other Environmental Studies, Analyses and Investigations
Conduct other environmental studies, analyses and investigations in accordance with
FHWA/TxDOT requirements. The other environmental studies, analyses and
investigations are shown below:
a) Land Use:
The Engineer shall conduct a field visit to document and confirm land use.

b) Water Resources:
The Engineer shall document compliance with Section 402 of the Clean Water
Act (CWA): Texas Pollutant Discharge Elimination System (TPDES),
Construction General Permit (CGP) requirements. The Engineer shall identify any
impaired waters using the Texas Commission on Environmental Quality (TCEQ)
2010 Section 303(d) Clean Water Act list (approved November 18, 2011) of
impaired waters.
c) Floodplains:
The Federal Emergency Management Agency's (FEMA) Flood Insurance Rate
Maps (FIRM) for Brazoria County shall be analyzed with respect to the proposed
project and the information documented in the EA. This task includes preparing
an exhibit to include any 100 year floodplain locations.
d) Vegetation Inventory:
The Engineer shall assess the proposed project vegetation. The vegetation
discussion shall include a general description of the vegetation types as described
in the Texas Parks and Wildlife Department (TPWD) Vegetation Types of Texas
(TPWD, 1984). The vegetation discussion shall also comply with the
Memorandum of Agreement (MOA) and the Memorandum of Understanding
(MOU) between TxDOT and TPWD.
e) Visual:
A field investigation shall be conducted to determine the potential visual impacts
resulting from the proposed project.
f) Construction Impacts:
The Engineer shall assess the proposed project for construction detours and
temporary construction impacts.
g) Invasive Species and Beneficial Landscaping Practices:
Executive Order 13112 on invasive species and executive memorandum on
beneficial landscaping practices shall be addressed in the EA.
h) Migratory Bird Impacts:
The Engineer shall address compliance with the Migratory Bird Treaty Act.
i) Threatened and Endangered Species:
The Engineer shall conduct threatened and endangered species habitat
assessments using the U.S. Fish and Wildlife Service (USFWS) and TPWD
threatened and endangered species list and shall conduct a Natural Diversity
Database (NDD) search. The EA shall include revising the USFWS and TPWD
lists up to three times.

It is assumed that the following tasks shall not be performed: analysis of soils, prime
farmlands, U.S. Coast Guard Section 9 and U.S. Army Corps of Engineers Section 10,
the Texas coastal management program, coastal barriers, Section 4(0 Evaluation, or U.S.
Department of Interior's National Inventory of River Segments in the National Wild and
Scenic River System.
Task 13 — Wetland Determinations
Wetland determinations and delineations were previously performed by Terracon for the
proposed widening of Bailey Road that was part of the Cowart Creek Diversion Project
which also included a new 3.2 mile long drainage channel that began at Bailey Road and
extended south and east on new location to a new detention pond. The U.S. Army Corps
of Engineers (USACE) issued a Nationwide Permit (NWP) 43 on December 2, 2009
which authorized the entire Cowart Creek Diversion Project (including the widening of
Bailey Road) and impacts to 0.2 acre of jurisdictional waters of the U.S. that were located
along the new drainage channel. In addition, during the evaluation and issuance of NWP
43, the USACE determined that the existing open drainage ditches along both sides of
Bailey Road are non jurisdictional and the conversion of these drainage ditches to
enclosed underground storm sewers did not require a permit. Terracon will provide the
necessary documentation to show that proposed widening of Bailey Road does not
require any Section 404 permits from USACE and will prepare the wetland section of the
EA.
Task 14 — Hazardous Materials
The Engineer shall conduct an initial hazardous materials assessment for the proposed
project to identify sites within the project area that may have experienced soil and/or
groundwater contamination by hazardous materials. The assessment shall consist of a
review of regulatory/governmental agency database records and an onsite investigation.
The regulatory database search should occur within the minimum search distances set by
American Society for Testing and Materials (ASTM) E 1527-97. The results of the
hazardous materials investigation shall be included in the EA. The Engineer shall also
prepare the State's Hazardous Material Initial Site Assessment Form.
Task 15 — Prepare Draft EA
The Engineer shall prepare the Draft EA, including preparing exhibits. Copies of the
Draft EA shall be prepared and submitted to the City of Pearland, TxDOT and FHWA on
paper and a digital pdf file for review and comment.
Task 16 — Revisions to Draft EA
The Engineer shall revise the Draft EA in accordance with two sets of comments from
the City of Pearland, four sets of comments from TxDOT and two sets of comments from
FHWA.
Deliverables:
Draft EA Document (3 hard copies plus electronic copy).

Task 17 — Public Meeting
a. Public Meeting Notice:
The Engineer shall prepare the Notice of Public Meeting for publication in the
Houston Chronicle and a Spanish newspaper for review and approval by TxDOT.
The Engineer shall publish the Notice in the Houston Chronicle (in English) and
the La Voz (a Spanish newspaper in Spanish) twice (30 days prior to the meeting
and approximately 10 days prior to the meeting). The Notice shall also be mailed
to all adjacent property owners and other identified interested citizens
approximately 30 days prior to the meeting. The Engineer shall prepare letters to
elected officials notifying them of the Public Meeting and submit the public
officials letter to TxDOT. TxDOT shall print the letters on TxDOT letterhead and
send to elected officials. This task shall also include identifying adjacent property
owners and developing and maintaining a mailing list for public meeting
notification.
b. Prepare Exhibits for Public Meeting:
The Engineer shall prepare exhibits to be displayed at the Public Meeting
including a project location map, need and purpose, cost and schedule. The
schematic layout and typical sections will also need to be displayed at the Public
Meeting but these will be prepared by others.
c. Conduct Public Meeting:
The Engineer shall coordinate, schedule, organize, and conduct an open house
Public Meeting. This task shall include preparing the program and sign -in sheets
for elected officials, general public, and the media. A total of two staff members
shall be provided to attend the meeting and to address questions from the public.
The Engineer shall participate in three meetings prior to the Public Meeting to
review the presentation materials and exhibits. The City of Pearland will identify,
reserve, and provide the facility for the Public Meeting.
d. Public Meeting Summary Report:
The Engineer shall prepare and submit a Public Meeting Summary Report to
TxDOT. The report shall contain the following information:
o Program;
o Sign -in sheets;
o Public meeting notices;
o Mailing list;
o Written public comments;
o Summary of the proceedings and public comments; and
o Responses to written public comments received at the meeting or by the
deadline
e. Revise Public Meeting Summary Report:

The Engineer shall revise the public meeting summary report in accordance with
one set of comments from the City of Pearland, two sets of comments from
TxDOT and one set of comments from FHWA.
Deliverables:

Task 18 — Notice Affording Opportunity for Public Hearing
Upon receiving Satisfactory for Further Processing from FHWA, the Engineer shall
prepare the Notice Affording Opportunity for Public Hearing for publication in the
Houston Chronicle, a local newspaper, and a Spanish newspaper for review and approval
by TxDOT. The Engineer shall publish the Notice in the Houston Chronicle (in English),
the La Voz (a Spanish newspaper in Spanish), and a local newspaper (in English), twice
(30 days prior to the deadline for requesting a hearing and approximately 10 days prior to
the deadline). The Notice shall also be mailed to all adjacent property owners and other
identified interested citizens approximately 30 days prior to the deadline. This task also
includes preparing the Certification of Notice Affording Opportunity for Public Hearing.
This scope and fee does not include conducting a public hearing.
Task 19 — Prepare Final EA
After the deadline for requesting a Public Hearing and assuming no requests for a public
hearing are received by the deadline, the final EA shall be prepared and submitted.
Deliverables:
Final EA Document (3 hard copies plus electronic copy).
Task 20 — Prepare FONSI Document
The Engineer shall prepare the Finding of No Significant Impact (FONSI) document for
signature by FHWA.
Deliverables:
FONSI Document (3 hard copies plus electronic copy).
Task 21 — Publication of FONSI Availability
This task shall include preparing a notice of FONSI availability. This task includes a
total of two sets of revisions (from the State) to the notice. Once approved, the notice
shall be published one time in the Houston Chronicle and La Voz (Spanish newspaper).
Deliverables:
1 copy of the notice of FONSI availability.
B. Environmental Permits Issues and Commitments (EPIC) Sheets. The Engineer
shall complete the latest version of the EPIC sheets per information provided by the
City and State.
