A RESOIITEION URGING THE TEXAS T~GISLATURE TO PLACE AN
AMENDMENT TO ARTICLE XVI, SECTION 40 OF THE TEXAS
CONSTITUTION ON THE ET~CTION B~T~OT FOR THE PURPOSE OF
AUTHORIZING PUBLIC SCHOOL TEACHERS TO RECEIVE
COMPENSATION FOR SERVING AS M~MBERS OF THE GOVERNING
BODIES OF CITIES, TOWNS OR ~ LOCAL GOVERNMENTAL
DISTRICTS.
WHEREAS, in 1972 the voters of the State of Texas approved an
amendment to Article XVI, Section 40 of the Texas Constitution
which prohibits individuals receiving compensation from funds of
the State of Texas from serving as members of the governing bodies
of school districts, cities, towns or other local governmental
districts unless the individuals renounce the salary for serving as
members of such governing bodies; and
WHEREAS, the Attorney General's Office has interpreted such
constitutional provision to prohibit public school teachers from
receiving a salary for serving as members of such governing bodies;
and
WHEREAS, the language of Article XVI, Section 40 of the Texas
Constitution and the Attorney General's interpretation thereof has
extended the scope of such constitutional provision beyond that
which was intended by the voters of this state; now, therefore,
BE IT RESOLVED BY THECITYCOUNCIL OFT HE CITY OF PEARLAND, TEXAS:
Section 1. That the City Council of the City of Pearland,
Texas, hereby urges the Texas Legislature to place an amendment to
Article XVI, Section 40 of the Texas Constitution on the election

ballot for the purpose of authorizing public school teachers to
receive compensation for serving as members of the governing bodies
of cities, towns or other local governmental districts.
