A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS
DESIGNEE TO EXECUTE AN ENGINEERING CONTRACT
AMENDMENT WITH WALSH/FREESE AND NICHOLS, INC. FOR
ENGINEERING SERVICES ASSOCIATED WITH THE DIXIE FARM
ROAD PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
.Section 1. That certain contract amendment by and between the City of
Pearland and Walsh/Freese and Nichols, Inc., a copy of which is attached hereto as
Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to
execute and the City Secretary to attest a contract amendment with Walsh/Freese and
Nichols, Inc. for engineering services associated with the Dixie Farm Road Project.

Dear Alan:
As you know as a result of Crossland Acquisition's title search for the referenced project, they
have estimated that an additional 25 parcels over the 40 parcels included in their original
proposal needs to be added to their scope of work. Some of the parcels out of the additional 25
parcels are in the Harris County which were not part of their original contract. As you know the
preparation of R.O.W. map and title search in Harris County portion of the work is now being
done by the City of Pearland (See Contract Change Order No. 2). It is our understanding that
Harris County will negotiate the R.O.W. acquisition outside Pearland City limits.
Their break down of cost is attached. For our effort to coordinate work with the County and
them, we propose the following fee be added to our prime contract:.

Dear Mr. Bavarian:
In regard to our ongoing conversations and in response to Walsh/Freese-Nichols having chosen
Baseline Corporation, based on our qualifications, to provide Professional Land Surveying
services on the above referenced project and furthermore after consultation with Ms. Carol Letz
of TxDOT and Mr. Michael D. Wilson, RPLS of Walsh Surveying, Inc., Baseline Corporation
is pleased to offer the following scope-of-services and cost breakdown by task.
SCOPE OF SERVICES
Update the survey performed for the existing Dixie Farm Road Right-of-Way Maps prepared by
Baseline Corporation on July 31, 1998 for current certification and preparation of deliverables to
conform to current TxDOT Standards. This will also include extending our survey to Clear
Creek, and will involve performing the following tasks:
1) Review the most current ownership and easement documents for the entire
project length. It is our understanding all abstracting required, including
easements, recorded plats, roadway dedications and other record
instruments deemed pertinent, will be supplied to Baseline Corporation
by the City of Pearland through your current contract with Crossland
Acquisitions, Inc. There are numerous petroleum pipelines. Perform
computations, supervision, and quality control checks.

2) Perform reconnaissance for our existing control points and tie in Baseline
Corporation's right-of-way and control points to aerial panel point control
supplied by Waish Surveying, Inc. Perform traversing to verify the
Walsh aerial control points and extend our previous control traverse to
Clear Creek. Rotate and translate Baseline Corporation right-of-way map
bearings and coordinates to conform to the Control Recovery Data Sheets
supplied to Baseline. Corporation by Walsh Surveying, Inc. Perform
computations, supervision, and quality control checks.

occupied) of the tracts adjoining Dixie Farm Road in both the Hoidale
Coffman Subdivision recorded on August 9, 1909, and the George W.
Jenkins Subdivision recorded on July 16, 1908. These are very old
subdivisions which contain some very large lots. The back comers range
b~tween 26002- and 1026-*- feet from Dixie Farm Road. Location of any
back comers found must be shown and called for on the right-of-way
maps, parcel plats, and metes and bounds descriptions in order to have a
monumented Point of Commencement (P.O.C.) per TxDOT Standards.
Cut line as required. Perform computations, supervision, and quality
control checks.

4) Update tbe existing pianimetrics shown on our maps by referencing in the
planimetric background prepared from aerial mapping to be supplied by
Walsh Surveying, Inc. It is our understanding a 2D MicroStation file,
· using the proper Seed file, which is fully compatible .with TxDOT
Standards (symbology, text, level structure, color assignment, global
origin, and scale, etc) will be supplied to Baseline Corporation by Walsh
Surveying, Inc. within 30 days of flight completion. This file should also
contain the design centerline which must be shown on the right-of-way
maps. Baseline Corporation will ground truth the new aerial planimetric
by a combination of field inspection and making comparisons with our
previous ground survey in order to identify unlabeled objects. Perform
computations, supervision, and quality control checks.

5) Convert our existing Right-of-Way Maps from AutoCAD to MicroStation
and make the necessary changes to conform to TxDOT Standards. This
will entail: perform the required software conversion; change scale of
right-of-way maps as required; perform drafting clean up for symbology,
text, level structure, and color assignment. Compute and draft parent
tract parcel insets for each parcel taking.. Prepare a cover sheet and an
index sheet. It is our understanding the final scale to be used on the
drawings will be determined by Walsh Surveying, Inc. and supplied to
Baseline Corporation. Perform computations, supervision, and quality
control checks.

It is our understanding the City of Pearland will obtain right-of-entry to survey and trim brush for
line of sight on all tracts adjoining Dixie Farm Road and supply confirmation of such to Baseline
Corporation.
It is further understood this proposal is based on the assumption the proposed right-of-way
alignment, as shown on Baseline Corporation's existing right-of-way maps, will not be changed.
Any revisions to the alignment (except rotation and translation of coordinates) will be considered
over and above the scope of services contained herein.

Any additional surveying services requested in writing, which is not a specific TxDOT
requirement for right-of-way mapping or specifically outlined in this proposal, will be considered
"over and above" this scope of services and will be invoiced as such in accordance with the
attached Rate Schedule.
We can begin recovering control and locating the back comers as mentioned above within 48
hours of receiving right-of-entry, written notice-to-proceed, and the preliminary Control Data
Recovery Sheets.
We can complete the entire project within three (3) months of receiving the completed aerial
ground Control Data Recovery Sheets, planimetrie background and desired map scale from Walsh
Surveying, Inc.

Per City's request, we received a proposal fi.om Baseline Corporation to a provide
surveying services to prepare R. O. W. acquisition maps, parcel takings, and field notes
for the section of Dixie Farm Road outside of the City limits. Baseline Corporation is the
original surveyor who prepared preliminary R. O. W. maps for Harris County for this
section of the R. O. W., conforming to the Harris County's standards. Their task will be
to conduct field work, update topography, computations, and prepare the necessary
R. O. W. maps, etc. conforming to TxDOT's standards. It is our understanding that
Harris County will negotiate the purchase of the R.O.W. outside Pearland City limits.
Their proposal is attached with detailed scope of work. For our effort to coordinate work
with the County and them, we propose the following fee be added to our prime contract:

Description of Services Added:
Extra surveying and coordination to prepare ROW maps and parcel takings conforming to TxDOT's
standards for the section of road in Harris County. Work to be performed by Baseline Corporation(original
surveyor previously contracted by county to prepare preliminary ROW map for the same section using
county criteria) as a Subcontract to Walsh/Freese and Nichols, Inc.-Lockwood, Andrews, & Newnam. See
attached proposal from Baseline Corporation for detailed description of services added.

3) Perform reconnaissance for and field locate the existing back corners (as
occupied) of the tracts adjoining Dixie Farm Road in both the Hoidale
Coffman Subdivision recorded on August 9, 1909, and the George W.
Jenkins Subdivision recorded on July 16, 1908. These are very old
s.ubdivisions which contain some very large lots. The back cOrners range
between 2600~- and 1026~ feet from Dixie Farm Road. Location of any
back corners found must be shown and called for on the fight-of-way
maps, parcel plats, and metes and bounds descriptions in order to have a
monumented Point of Commencement (P.O.C.) per TxDOT Standards.

4) Update the existing planimetfics shown on our maps by referencing in the
planimetric background prepared from aerial mappin~ to be supplied by
Waish Surveying, Inc. It is our understanding a 2D MicroStation file,
using the proper Seed file, which is fully compatible .with TxDOT
Standards (symbology, text, level structure, color assignment, global
origin, and scale, etc) will be supplied to Baseline Corporation by Walsh
Surveying, Inc. within 30 days of flight completion. This file should also
contain the design centerline which must be shown on the right-of-way
maps. Baseline Corporation will ground troth the new aerial planimetric
by a.combination of field inspection and making comparisons with our
previous ground survey in order to identify unlabeled objects. Perform
computations, supervision, and quality control checks.

5) Convert our existing Right-of-Way Maps from AutoCAD to MicroStation
and mzke the llecessary changes to confolm to TxDOT Standards. This
will entail: perform the required software conversion; change scale of
right-of-way maps as required; perform drafting clean up for symbology,
text, level structure, and color assignment. Compute and draft parent
Iract parcel insets for each parcel talcing.. Prepare a cover sheet and an
index sheet. It is our understanding the final scale to be used on the
drawings will be determioed by Walsh Surveying, Inc. and supplied to
Baseline Corporation. Perform computations, supervision, and quality
control checks.

Our fee for this service will be invoiced on an hourly basis in accordance with the Attached "A"
Rate Schedule, NOT-TO-EXCEED $41,000 (Forty-One Thousand Dollars) without prior
authorization.

2) Mylar Certified Parcel Maps/MicroStation File.
3) Certified metes and bounds descriptions/Electronic file.
4) Hard copy area print outs for each parcel taking.
5) Copies of all record instruments obtained by Baseline Corporation.
It is our understanding the City of Pearland will obtain right-of-enUy to survey and trim brush for
line of sight on all tracts adjoining Dixie Farm Road and supply confirmation of such to Baseline
Corporation.
It is further understood this proposal is based on the assumption the proposed right-of-way
alignment, as shown on Baseline Corporation's existing fight-of-way rasps, will not be changed.
Any revisions to the alignment (except rotation and translation of coordinates) will be considered
over and above the scope of services contained herein.

Any additional surveying services requested in writing, which is not a specific TxDOT
requirement for right-of-way mapping or specifically outlined in this proposal, will be considered
"over and above" this scope of services and will be invoiced as such in accordance with the
attached Rate Schedule.
We can begin recovering control and locating the back comers as mentioned above within 48
hours of receiving fight-of-entry, written notice-to-proceed, and the preliminary Control Data
Recovery Sheets.
We can complete the entire project within three (3) months of receiving the completed aerial
ground Control Data Recovery Sheets, pIanlroetric background and desired map scale from Walsh
Surveying, Inc.
