R2001-0113 08-27-01 RESOLUTION NO. R200i-113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO A CONTRACT WITH DONALD R. WARD & ASSOCIATES TO COORDINATE ACTIVITIES UNDER THE FEMA BUYOUT PROGRAM. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section i. That certain contract by and between the City of Pearland and Donald R. Ward & Associates, a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest a contract with Donald R. COKER CITY ATTORNEY Exhibit "A" R200'1-'!'13 AGREEMENT FOR PERSONAL SERVICES STATE OF TEXAS COUNTY OF BRAZORIA THIS AGREEMENT is made and entered in to, and executed by and between the City of Pearland, a body corporate and politic under the laws of the State of Texas, hareinafter called the "City", and Donald R. Ward, hereinafter called the "Consultant", and is as follows: I. Job Description: Buyout Consuliant A. Primary Purpose: The primary purpose 0f this position Will be to assist and advise the City in the aequisitinn of flooded properties in connection with a Grant funded under Section 404 from the Federal Emergency Management Agency and/or the State o£Texas. B. Major responsibilitias: 1. Contracting for Title Company Services 2. Contracting for Appraisals 3. Review and Oversight of Title Company Activities 4. Review of Appraisals 5. Development of Data for Determining Compensation 6. Preparatinn of Determination of Compensatinn and Offer to Sell 7. Presentation of Offers 8. Preparation of Deeds 9. Oversight and coordination of closings 10. Preparation and maintenance of Hard Copy Case Files 11. Determining Relocation Benefits for Eligible Tenants See attached detailed statement of work for each task. II. Term of Agreement: This contract is tarminable at the will of either party. III. Compensation: The cost per parcel will be $800.00 per parcel for parcels that close and $600.00 for parcels where offers are made and closing does not take place. Where a parcel is purchased and there are eligible tenants that are antitled to relocation benefits, there will be an additional charge of $500.00 per parcel for task 11. Should the City require consulting services in connection with Grant preparation or Grant management and reporting, the charge for such services will be $95.00 per hour. The Consultant will contract for title services and for appraisals on behalf of the City and will be responsible for overseeing the title company and appraisal contractors to ensure that they meet the requirements of the Grant. The City will pay the appraiser(s) and title company(les) directly for their services. The Consultant will obta'm information for each parcel relating to duplication of benefits from the State of Texas or from the Federal Emergency Management Agency, as appropriate. The City will provide space and necessary equipment for on-site work in connection with the project. The above costs include all direct cost, overhead, profit, travel and other miscellaneous costs. Consultant will invoice the City for services from the Contractor as each task or group of tasks are performed. PASSED AND APPROVED this 27'1;h day of August ,2001. DONALDR.
