Ord. 0450-28 10-08-01ORDINANCE NO. 450-28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 450 AS THE SAME MAY HAVE BEEN, FROM TIME TO TIME, AMENDED, FOR THE PURPOSE OF ESTABLISHING AND REESTABLISHING CLASSIFICATIONS AND NUMBER OF AUTHORIZED POSITIONS IN THE CLASSIFIED SERVICE OF THE CITY OF PEARLAND, PURSUANT TO SECTION 143.021 OF THE LOCAL GOVERNMENT CODE OF THE STATE OF TEXAS; PROVIDING A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A REPEALER CLAUSE, AN EFFECTIVE DATE AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY BECAUSE THE NEED TO UPDATE THE NUMBER OF AUTHORIZED POSITIONS IN THE CLASSIFIED SERVICE OF THE CITY AND UPDATE THE PAY CLASSIFICATION PLAN FOR CIVIL SERVICE EMPLOYEES INURES TO THE BENEFIT OF THE PUBLIC AND, THEREFORE, BEARS DIRECTLY UPON THE HEALTH, SAFETY AND WELFARE OF THE CITIZENRY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That Ordinance No. 450 as the same may have been, from time to time, amended, is hereby further amended and, pursuant to the requirements of Section 143.021 of the Local Government Code of the State of Texas, there are hereby established the following classifications for employees with the City of Pearland Police Department, with the number of authorized positions for each of the classifications, all of which shall be subject to the provisions of said Municipal Civil Service under the Local Government Code, to wit: No. of Authorized Positions Classification 62* Police Officer 7 Corporal 5 Sergeant 2 Lieutenant Total of 76 Civil Service Classified Positions * includes 2 grant funded School Resource Officers (See Pay Classification Plan for Civil Service Employees attached hereto as Exhibit "A" and incorporated herein for all purposes) 1 ORDINANCE NO. 450-28 Section 2. Declaration of Emergency. The Council finds and determines that the need to update the number of authorized positions in the classified service of the City and update the pay classification plan for civil service employees inures to the benefit of the public and, therefore, bears directly upon the health, safety and welfare of the citizenry; and that this Ordinance shall be adopted as an emergency measure, and that the rule requiring this Ordinance to be read on two (2) separate occasions be, and the same is hereby waived. Section 3. Severability Clause. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause of this Ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective of the facts that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section 4. Repealer Clause. All ordinances or part of ordinances in conflict herewith are hereby repealed to the extent of such conflict; otherwise, the provisions of Ordinance No. 450 as it may have been, from time to time, amended, shall remain in full force and effect. Section 5. Savings Clause. All rights and remedies which have accrued in favor of the City of Pearland under Ordinance No. 450, and its amendments, shall be and are preserved for the benefit of the City. 2 ORDINANCE NO. 450-28 Section 6. Effective Date. This Ordinance shall become effective immediately upon its passage and approval by the City Council.
