CALL TO ORDER The Joint Public Hearing was called to order at 6:40 p.m. II. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Heavy Industrial District (M-2) on the following described property, to wit: Zone Change Application No. 992 Legal Description: 11.447 acres out of Lots 32 & 33, Allison Richey Gulf Coast Home Co. Subdivision and H. B. & T. R.R. Co. survey, A-504, according to the map or plat thereof, recorded in Vol. 2, pg 23-24, of the 1.56 IV. plat records of Brazoria Co., TX (1854 Garden Road) Owner: F. F. & E. Family Limited Partnership P.O. Box 1462 Delano, CA 93216 Agent: Arthur Val Perkins The purpose of the public hearing was read into the record by P&Z Chairman Charles Viktorin. Executive Director of Community Services Tobin Maples, AICP, presented the location of the proposed zone change by showing slides of the property and gave a brief description of the surrounding properties. He stated that the business is surrounded by Suburban Development with the exception of two properties located to the east which are zoned Heavy Industrial District (M-2). He stated that they received two public comment forms, one was in support of the request and one was against the request. Mr. Maples stated that the Comprehensive Plan calls for Low Density, however, once the area was annexed several zoning cases came through for "Industrial" zoning, which set a precedent therefore staff is recommending approval. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Arthur Val Perkins, attorney for F.F.&E. Family Limited Partnership, stated that the property was annexed in 1989 and it this property is not just a raw piece of land, it is a facility that exists and produces well and seal products. He stated that there are at least three Heavy Industrial classifications that are extremely close to this property and a fourth Industrial classification is located to the south of this property. He stated that he is in support of the request. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Stephen Pappas, 6926 Sharon, Pearland, TX, stated that while everyone else is worried about the property values of their homes decreasing, they need to be worried about the small road that will hold the traffic. He stated that the owner showed up to the City Council meeting last year and introduced his self and then left. He stated that the owner is going to do what he pleases and he is worried that he may get into a position where they won't be able to sell their homes. Fred Bailey, 6622 Sharon, Pearland, TX, stated that the place was built three feet higher and it floods into his place. He stated that during the last flood he received 8 inches of water. He stated that the owner said he would build a ditch. He finished by stating a very small ditch was built and the owner wanted him to pay for it. 2 V. Ray Whaley, 7106 Robin Sound, Pearland, TX, stated that there was an error in the presentation given by staff. She stated that Raintree is not just a "trailer park", it is an area for modular homes and it holds over 248 families. She then stated that Robin Cove Subdivision is also near the property and it is "R-1" sized lots with very nice homes and 1500 feet to the north is Lawhon Elementary School. She stated that if there were any more traffic they would be in trouble. She finished by pointing out that there is also a beautiful subdivision being built over on Max Road. Roy Allison, 7118 Robin Sound, Pearland, TX, stated that he has a new family and asked if there is anything they can do to stop the Industrial zoning throughout the City. He stated that he doesn't like having to come up to the meetings every 2-3 months to speak against the Industrial zoning. He asked what does it take to defend the integrity of their homes and he pointed out that he is trying to live in a Master Planned Community. Jerald Landis, 1913 Robin Spur, Pearland, TX, stated that he would make it short and stated that they don't want Industrial there. Mike Whaley, 7013 Robin Sound, Pearland, TX, stated that he is begging City Council to not let this application be approved. Braun Thompson, 7122 Robin Meadow, Pearland, TX, stated that his family moved there a year ago and there is a school very close to the property in request. He stated that they have a 19 -month old baby and he asked them to please deny the request. Kim Little, 7128 Robin Sound, Pearland, TX, stated that she has a six-year old son that does attend the elementary school, and she also have two small children in her household. She stated that there would be more traffic and you never know what could happen if this request is approved. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Wilkins asked if staff could answer the gentleman's question it there is any way Industrial zoning could be stopped, and City Attorney Darrin Coker replied that there is no way to freeze any type of zoning. Mr. Coker stated that any individual property owner can request any type of zoning as many times as he would like. Mayor Tom Reid stated that he did receive three public comment forms from the following people: 3 157 158 1W 1. Connie L. Schield and David B. Schield at 6918 Sharon Dr. 2. Ruth Harrington at 7034 Robin Sound Dr. P&Z Chairman Viktorin asked when the other Heavy Industrial zonings were approved, and Executive Director of Community Services Tobin Maples stated that he did not have an exact date, however it has been since they were annexed in October of 1998. Executive Director of Community Services Tobin Maples, AICP, presented the location of the proposed zone change by showing slides of the property and gave a brief description of the surrounding properties. He stated that the owner is required to re -zone the existing building because he wants to least the business to a tenant. Mr. Maples explained that the City of Pearland's codes required that 4 159 all codes for the business are up to date and this is why the owner is required to apply for the requested zoning. Mr. Maples stated that the Comprehensive Plan does call for "Industrial" zoning; therefore staff is recommending approval of the request. III. Box 1462 Delano, CA 93216 5 160 Agent: Arthur Val Perkins The purpose of the public hearing was read into the record by P&Z Chairman Charles Viktorin. Executive Director of Community Services Tobin Maples, AICP, presented the location of the proposed zone change by showing slides of the property and gave a brief description of the surrounding properties. He stated that they sent out eleven Public Comment Forms and did not receive any until today, and they received one. He stated that the property owner would like to utilize the area for Commercial use and staff recommends approval. Ill. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Arthur Val Perkins, attorney, stated that this is a building which is used as an office and a residence and is in conjunction with Zoning Application No 992, in which the owner applied for Heavy Industrial (M-2). He stated that each and every property on Garden Road has been re -zoned to reflect what their use is for. He stated that the people and their comments sound real sincere, however, the owner is not seeking to change his what is his existing business on the current land. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Stephen Pappas, 6926 Sharon, Pearland, TX, stated that he feels the same as he did with Zoning Application No. 992, and assuming that they will have water in their area some day, he is worried about what could happen to their water. Ray Whaley, 7106 Robin Sound, Pearland, TX, stated that he is also against this request for the same reasons he listed on the other application. He stated that at this point it is grandfathered and the owner should be able to conduct his business without changing his zoning. Jerald Landis, 1913 Robin Meadow, Pearland, TX, stated that he is also against this application. He stated that he is concerned that somebody else could move in and change the business. Roy Allison, 7118 Robin Sound, Pearland, TX, stated that he feels that this is a family oriented community. He stated that he would really appreciate it if the City would leave it that way. He is against this request also. Bruce Hornsby, 7121 Robin Meadow, Pearland, TX, stated that the area already does not have sidewalks for the children to walk to school on. He asked to please take into consideration their children. D est Michael Wayley, 7013 Robin Sound, Pearland, TX, stated that he does not have a problem with Anthony Products it's what could happen after they sell their property. Peter Locke, 7126 Robin Meadow, Pearland, TX, stated that when he moved to this area it was residential, and he does not want a Heavy Industrial Community located across the street. He stated that he has children and the present roads are not for this kind of business. He stated that he against the request. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Marcott asked about Mr. Perkins statement regarding their being a residence on the property, and he pointed out that in the Land Use Ordinance it states that you cannot have a residence in "Commercial' zoning. Executive Director of Community Services Tobin Maples stated that he could continue to live there because it would be a non -conforming use. Council Member Owens asked what types of trucks would be on the road, and Executive Director of Community Services Tobin Maples replied that just from the various trips he has taken out to Garden Road he has seen several different types of trucks. Mr. Maples reminded City Council that there is currently truck traffic out in that area. Council Member Owens asked if the business would have to comply with the current city codes, and Mr. Maples replied that they would not have to comply until they apply for any permits, then the updated codes would kick in. VI. ADJOURNMENT The Joint Public Hearing adjourned at 7:16 p.m. ZONING APPLICATION NO. 990 1. CALL TO ORDER The Joint Public Hearing was called to order at 7:18 p.m. II. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Multi -Family Dwelling District (MF) on the following described property, to wit: 7 Zone Change Application No. 990 Legal Description: Tract I: 8.7125 acres, out of and part of Lot 6, Block 10; and Tract It: 10.2571 acres, out of and part of Lot 6 and 7, Block 10; both out of the Allison Richey Gulf Coast Home Co., Suburban Gardens Subdivision, Section 4, T.C. R.R. Co. survey, A-675, recorded in Volume 2, pg 99, Brazoria Co., TX (Shadow Creek Parkway/McHard Road) Owner: Pleasant Grove Missionary Baptist Church and New Bethlehem Missionary Baptist Church P.O. Box 15256 Houston, TX 77220 Agent: Wayne Dalcin of Altra Asset Co., Inc. The purpose of the public hearing was read into the record by P&Z Chairman Charles Viktorin. Executive Director of Community Services Tobin Maples, AICP, presented the location of the proposed zone change by showing slides of the property and gave a brief description of the surrounding properties. He stated that the property is generally located at the south side of Shadow Creek Parkway and he pointed out that Shadow Creek Ranch is a "PUD". He stated that the Comprehensive Plan calls for low density; therefore the request is not compliant. He stated that a Traffic Impact Analysis might be required. Mr. Maples then gave a brief history of the property and how it was inadvertently zoned at one time as part of the PUD when it should have been Suburban Development (SD). III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Bob Keener, 11214 Montebello, stated that maybe there has been a misconception that this property is located in Pearland Independent School District, however, it is not. He stated that it would Alvin Independent School District. He asked City Council to recognize that they would put in a left turn lane to help with traffic. He stated that it would be a "Class A" project and HUD would consider this a medium density project. He stated that they would follow any city regulations and he asked for proper consideration for this request. Gerald Teal, Real Estate, stated that he was requested by the landowner to give an opinion for the best use for this property. Mr. Teal briefly explained his four tests and stated that his result was that "Multi -Family" would be the best use for this property. 163 Richard Bowe, Graduate of Rice University, was hired as a consultant to determine the highest and best use for this property. He stated that when he first saw the property he thought, "Multi -Family". He then asked why this property owner was not properly notified when the "PUD" zoning was requested. He stated that adjacent to the site and to the Northwest of the property is Multi - Family zoning. He stated that there would be approximately 10.9 units per acre, which is considered medium density. He also stated that this would be a "Class A" project. Sheldon Jackson, 8114 Twelfth Fairway, Humble, TX, stated that he will also be purchasing some of the land and they currently have the best developers to make their visions come become a reality. He stated that they want to add to Pearland and not subtract from Pearland. He asked for them to please consider their request and he thanked the City for it's time. Melvin Louis, pastor for New Bethlehem Church, and he stated that GOD has shown him this land and by faith he was able to purchase a portion of the property. He stated that they have a great team and they are ready to develop this property and he hopes that City Council's minds have not been made up already. Mr. Gentry, 1618 Inverness Ln, Pearland, TX, stated that he supports the development and he thinks it would be a great project. He asked them to please consider the zoning request. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Stephen Pappis, 6926 Sharon, Pearland, TX, stated that he read in the paper that not too long ago, the City of Pearland was trying to limit apartment facilities. He stated that that would be that many more people using city facilities. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Council Member Owens asked if this is going to be a HUD project, and Mr. Keener replied that it would be a HUD 2 — 21134 project and it would not be a "low income" project and it would have market rate rents. Council Member Owens asked about how many units there would be, and Mr. Keener replied approximately 200 units. Executive Director of Community Services Tobin Maples added that the owner has 18 acres and is allowed to do 18 units per acre. E 161 Council Member Owens stated that he was under the impression that there would be 10 acres of water, and Mr. Maples responded that he has not seen any plans at this time. P&Z Commissioner Scherrer stated that St. Andrews Apartments has 30 units per acre, and this development would just be a bit shorter by having 22 units per acre. P&Z Commissioner McDonald asked if the owners were with the Sustainable Community Project Association, and Mr. Keener replied that they are not. VI. ADJOURNMENT The Joint Public Hearing adjourned at 7:40 p.m. SPECIFIC USE APPLICATION NO. 95 I. CALL TO ORDER The Joint Public Hearing was called to order at 8:00 p.m. II. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City for a Specific Use for a church on the following described property, to wit: Specific Use Application No. 95 Legal Description: Lot 16 & 17, Block 2, McGinnis Subdivision, as recorded in Vol. 8, pg 7, plat records of Brazoria Co., TX (2410 Dixie Farm Road) Owner: Avery and Pamela Germany 2410 Dixie Farm Road Peariand, TX 77581 Agent: Avery Germany The purpose of the public hearing was read into the record by P&Z Chairman Charles Viktorin. Executive Director of Community Services Tobin Maples, AICP, presented the location of the proposed zone change by showing slides of the property and gave a brief description of the surrounding properties. He stated that the owner is requesting to go from Single Family Dwelling District to Single Family Dwelling 10 165 District with a specific use to allow for a church on his property. He stated that if the owner leaves the property for any reason the property still could only be used for a residence or a church. He stated that a Traffic Impact Analysis might be required. Mr. Maples then explained that there were 3 or 4 people within the 200 -foot buffer who were not notified due to the fact that the City uses the Brazoria County Appraisal District's tax rolls, which were not up to date. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Avery Germany, 2410 Dixie Farm Rd, Pearland, TX, stated that he is the homeowner/agent for this property. He stated that right now Dixie Farm Rd is only a two-lane road, but it is proposed to be a five -lane road therefore traffic would not be a problem. He stated that he cannot see why people would be upset about growth in the community and he referred to the American Flag and how it represents growth. He then stated that he does not know why anyone would oppose a Christian development and asked City Council to please make the right decision. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Delma Schriever, 1801 McGinnis, Pearland, TX, stated that she is the Vice - President of the civic club for the subdivision and she is there to represent the civic club. She stated that the property is surrounded by residencies that have 1- 3 acre lots. She stated that they live in an older establishment that has seen Pearland grow and they agree with the progress, however, this project needs to be studied very carefully. She stated that she is voicing her opinion as well as all the other surrounding properties and this area needs to remain residential. She pointed out that they already have drainage problems and this could be classified as a potential traffic jam. She then stated for the record that she is submitting a petition with the entire civic clubs signatures (containing 30 signatures). Earl Jackson, 2413 Creekridge, Pearland, TX, stated that he is in opposition of the change and he desires to keep the area residential. He stated that the civic club goes by the Deed of Restrictions for their subdivision, which has been active since August of 1967. He stated that the majority of the residents are senior citizens and when it comes time for them to leave their homes they want their property to be at the highest value possible. He stated that Mr. Germany told them, "It is inevitable that Dixie Farm will become "Commercial", and he hopes that Mr. Germany is wrong. He asked City Council to please place themselves in their shoes and consider this enormous interruption to their subdivision. He asked for this not to become a "reality" and thanked them for their time. Robert Hall, 2403 Taylor, Pearland, TX, stated that there is already a problem due to flooding and Dixie Farm is closed quite often and it does get worse every year. 11 166 Mrs. Balshaw, 2414 Creek Ridge, Pearland, TX, stated that the property she lives on once belonged to her husband's grandfather, which was purchased in 1958. She stated that this is now a quiet residential area, and the traffic on Dixie Farm is horrible, the flooding is impossible (there is still water in the ditches from Friday) and she is already at the grace of Pearland asking for all the dirt she can get. She stated that the church would require concrete being poured which will cause more flooding and the noise level would increase. She wants to grow old in this subdivision, so please keep it residential. Mr. Leonard, 2406 Dixie Farm Rd, Pearland, TX, stated that he is lot number 15, which is adjacent to the two lots in question and it has been a pleasure to have Mr. Germany as a neighbor. He stated that Mr. Germany at the current time has study groups, but to actually build a building is out of the question. He is totally opposed. Barbara Webber, 1807 Taylor, Pearland, TX, stated that she moved here from Bellaire and has a two -acre lot with a house from $200,000 to $250,000. She stated that Pearland needs these types of large lots. She stated that she had trees in her front yard that were over 100 years old and due to the flooding problem that already exists they have fallen. She stated that she is also worried about the retail value of her home. Helen Schadler, 2407 Creekridge, Pearland, TX, stated that she just moved in and she lives directly behind Mr. Germany and her whole yard was like a lake during the last flood. She stated that the Lord led her to this house, she is retired, this is her first house, and she has no desire for any kind of church or any building near her home. She stated that she has no desire to move, this is her dream home, and she is very much opposed. M. C. Balshaw, 2414 Creekridge, Pearland, TX, stated that he has been listening to everyone talk and he helped build his home in 1962 with his grandfather and he has rebuilt the house since his grandfather died. He stated that he cherishes his neighbors, they don't bother one another but they do talk occasionally. He is against the request. John Hill, 2402 Creekridge, Pearland, TX, stated that no one in their community is opposed to a church coming to their neighborhood, however, they are opposed to one being built on this small lot. He stated that this should have been planned better. V. COUNCIL/PLANNING COMMISSIONISTAFF DISCUSSION Mr. Tobin Maples, Executive Director of Community Services Mayor Tom Reid stated to the people that they did notify everyone within the 200 -foot buffer on the most recent tax rolls. 12 167 Council Member Marcott stated that Dixie Farm Road would not be a 54ane road; it'll only be a 4 -lane road with no turning lanes. He stated that there would be a traffic problem, and noise would also be a problem. Mayor Reid reminded Council that they are zoning property and not trying to do a traffic analysis at this time. P&Z Commissioner McDonald asked what the time frame is for this project and Mr. Germany replied that it should take about two years to be built. VI. Mr. Maples gave a brief explanation of the five lots and how they have already been platted and they were left as "Commercial". zoning. He stated that they are applying for R-3 zoning to be consistent with the rest of the subdivision. He stated that they sent out 8 Public Comment Forms, and none were returned, and staff is recommending approval because the request is consistent with what has already been developed and platted.
