ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD MAY 8, 2000, AT 6:30

The meeting was called to order at 6:35 PM.
II. PURPOSE OF HEARING
Request of owners for an amendment to the Land Use and Urban Development
Ordinance of said City from classification Suburban Development District (SD) to
Commercial District (C) on the following described property, to wit:
Legal Description: Tract I: 1 acre being Lot 3, Gabriel Enterprises and Tract II: 1.78
acres being Lot 361-13 out of the H.C. Johnson 99 acre tract, A-219,
Brazoria Co., (2617 Lazy Bend Drive)

Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the
record. Director of Community Development and Services Gene Tumlinson showed the
location map.
III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Stan Leslie, owner of LesCon & Leslie Plumbing, explained that his business requires
outside storage of equipment and supplies. He stated that this business was existing
prior to annexation. He added that he will clean up the back of the property and the
building if the zone change is approved.
Charlie Eason of Hardcastle Real Estate, stated that this is an existing plumbing
business on the property. He explained that they need a zone change to expand the
business. He also stated that later this evening they will be considering a zone change
request on the front portion of this property to be changed to General Business.
Suzanne Elliott, 6614 Broadway, explained that LesCon & Leslie Plumbing has been in
business since 1993. She stated that they employ Pearland people and run a good
business.
Pat O'Day, 2401 O'Day Road, spoke in support of this zone change request. He
explained that Mr. Leslie has done work for him and does excellent work. He added that
he employs good people.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST
Michael Cotter, 2549 Lazybend, explained that several years ago Mr. Gabriel tried to
rezone this property to Commercial. He stated that if the property is zoned Commercial,
he would be concerned about the safety of the fourteen (14) children who live in the
area. He added that he would appreciate the property being mowed since it has not
been mowed in the last four (4) years. He also expressed concern about lighting, noise
and negative impact on homes. Mr. Cotter stated that Commercial would allow too
many different types of businesses to come in. He added that the last time this zone
change was requested, Council denied it because they did not allow Commercial
businesses on residential streets even if grandfathered.
V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Council Member Klaus Seeger asked what is on the property to the East. Director of
Community Developmentand Services GeneTumlinson stated thatan equipment rental
company is located to the East of this property. Council Member Helen Beckman asked
if the business currently operates on both lots. Mr. Tumlinson explained that the
business is currently located on the front lot with a portion of the second lot being used
for storage. He added that the Comprehensive Plan shows this property as "Retail,
office and services".

General Business District (GB) on the following described property, to wit:

survey, A-219, Brazoria Co., TX (5915 Broadway)

Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the
record. Director of Community Development and Services Gene Tumlinson showed the
location map. He stated that the building on this property was previously a daycare.
III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST
Stan Leslie stated that he needs zoning in order to lease the building.
Suzanne Elliott explained that the business fronts FM 518. She added that this is an
8:00 -5:00 business. She also stated that sometimes the businesses are there prior to
the homes surrounding it.
Pat O'Day, 2401 O'Day Road, spoke in support of the zone change request. He also
mentioned that his son, Michael O'Day, could not be at the meeting, however, he asked
his father to speak in support of the request on his behalf.
Charlie Eason of Hardcastle Real Estate clarified that they are going to lease the
building, not sell the back property.
