2000-05-08 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESP:.. MINUTES - JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD MAY 8, 2000, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS A series of Joint Public Hearings was called to order at 6:35 PM with the following present Mayor Mayor Pro -Tem Council Member Council Member Council Member Council Member P&Z Chairperson P&Z Commissioner P&Z Commissioner P&Z Commissioner P&Z Commissioner Director of Community Development & Services Secretary Zoning Application No. 917 CALL TO ORDER Tom Reid William Berger Helen Beckman Klaus Seeger Richard Tetens Larry Wilkins Mary Starr Emil Beltz Donald Glenn Russ Selemon Charles Viktorin Gene Tumlinson Mona Ann Phipps The meeting was called to order at 6:35 PM. II. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Commercial District (C) on the following described property, to wit: Legal Description: Tract I: 1 acre being Lot 3, Gabriel Enterprises and Tract II: 1.78 acres being Lot 361-13 out of the H.C. Johnson 99 acre tract, A-219, Brazoria Co., (2617 Lazy Bend Drive) Owner: Stan Leslie 2617 Lazy Bend Drive Pearland, TX 77581 Agent: Charlie Eason of Hardcastle Real Estate -1- X. Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Community Development and Services Gene Tumlinson showed the location map. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Stan Leslie, owner of LesCon & Leslie Plumbing, explained that his business requires outside storage of equipment and supplies. He stated that this business was existing prior to annexation. He added that he will clean up the back of the property and the building if the zone change is approved. Charlie Eason of Hardcastle Real Estate, stated that this is an existing plumbing business on the property. He explained that they need a zone change to expand the business. He also stated that later this evening they will be considering a zone change request on the front portion of this property to be changed to General Business. Suzanne Elliott, 6614 Broadway, explained that LesCon & Leslie Plumbing has been in business since 1993. She stated that they employ Pearland people and run a good business. Pat O'Day, 2401 O'Day Road, spoke in support of this zone change request. He explained that Mr. Leslie has done work for him and does excellent work. He added that he employs good people. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Michael Cotter, 2549 Lazybend, explained that several years ago Mr. Gabriel tried to rezone this property to Commercial. He stated that if the property is zoned Commercial, he would be concerned about the safety of the fourteen (14) children who live in the area. He added that he would appreciate the property being mowed since it has not been mowed in the last four (4) years. He also expressed concern about lighting, noise and negative impact on homes. Mr. Cotter stated that Commercial would allow too many different types of businesses to come in. He added that the last time this zone change was requested, Council denied it because they did not allow Commercial businesses on residential streets even if grandfathered. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Council Member Klaus Seeger asked what is on the property to the East. Director of Community Developmentand Services GeneTumlinson stated thatan equipment rental company is located to the East of this property. Council Member Helen Beckman asked if the business currently operates on both lots. Mr. Tumlinson explained that the business is currently located on the front lot with a portion of the second lot being used for storage. He added that the Comprehensive Plan shows this property as "Retail, office and services". VI. ADJOURNMENT -2- ME The Joint Public Hearing adjourned at 6:47 PM. Zoning Application No. 918 1. CALL TO ORDER The meeting was called to order at 6:47 PM. II. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to General Business District (GB) on the following described property, to wit: Legal Description: 1.103 acres being Lot 1 of Gabriel Enterprises, H. T. & B. R.R. Co. survey, A-219, Brazoria Co., TX (5915 Broadway) Owner: Stan Leslie 2617 Lazy Bend Drive Pearland, TX 77581 Agent: Charlie Eason of Hardcastle Real Estate Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the record. Director of Community Development and Services Gene Tumlinson showed the location map. He stated that the building on this property was previously a daycare. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Stan Leslie stated that he needs zoning in order to lease the building. Suzanne Elliott explained that the business fronts FM 518. She added that this is an 8:00 -5:00 business. She also stated that sometimes the businesses are there prior to the homes surrounding it. Pat O'Day, 2401 O'Day Road, spoke in support of the zone change request. He also mentioned that his son, Michael O'Day, could not be at the meeting, however, he asked his father to speak in support of the request on his behalf. Charlie Eason of Hardcastle Real Estate clarified that they are going to lease the building, not sell the back property. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST none -3- N, V. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Single Family Dwelling District (R-1) on the following described property, to wit: 1. Zoning Application No. 919 Legal Description: The West 2 acres of the South '/z of Lot 9, Allison Richey Gulf Coast Home Co. Subdivision, Section 10, H. T. & B. R. R. Co. survey, A-505, Brazoria Co., TX according to the plat as recorded in Vol. 2, pg 24, plat records of Brazoria Co., TX (13535 Stone Road) Owner: Victor and Michelle Patterson 13535 Sagebluff Pearland, TX 77581 2. Zoning Application No. 920 Legal Description: 2.5 acres out of the South '/z of Lot 46, Allison Richey Gulf Coast Home Co.'s Subdivision, Section 9, H. T. & B. R.R. Co. survey, A- 234, Brazoria Co., TX, according to the plat thereof in Vol. 2, pg 23, Brazoria Co., TX (1630 Roy Road) Owner: Rex and Mary Leppala 1630 Roy Road Pearland, TX 77581 IrIl Planning and Zoning Chairperson Mary Starr read the purpose of the hearing into the ^-. record. Director of Community Development and Services Gene Tumlinson showed the location map. He stated that these are mostly large tracts of land.
