2000-07-24 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES-241 MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 24, 20009 AT 6:30 P.M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The Joint Public Hearing was called to order with the following present: Mayor Tom Reid Mayor Pro -Term tarry Wilkins Councilmember Helen Beckman Councilmember Larry Marcott Councilmember Woody Owens Councilmember Klaus Seeger Councilmember. Beltz P & Z Commissioner Donald Glenn P & Z Commissioner- Todd locco Others in attendance: Manager of Administrative Support Tobin Maples, AICP, Planning and Zoning Secretary Jennifer Gonzales. APPLICATION NO. 934 I. CALL TO ORDER The meeting was called to order at 6:31 P.M. II. PURPOSE OF HEARING — APPLICATION NO. 934 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Heavy Industrial District (M-2) on the following described property, to wit: 1. Zoning Application No. 934 Legal Description: 9.469 acres of land situated in the East 1/2 of the Northwest % of the Northeast % of Section 15, H.T.&B. R.R. Co. Survey, A-241, Brazoria County, TX (6614 Broadway Street) Owner: Orlen W. & Michael P. O'Day P.O. Box 149 Pearland, TX 77588 r-- The purpose of the public hearing was read into the record by Chairperson Mary Starr. Manager of Administrative Support Tobin Maples, AICP, presented the location of the proposed zone change. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS 1 24Z Orlen W. O'Day, P.O Box 149, Pearland, TX 77588, stated that he is out on the western side of Pearland, which back in the old days was considered the "poor side". He stated that he is one of the oldest companies in Pearland and they are here to better serve the community. He then stated that they are very proud of their company and they are here to stay, and he would very much appreciate the requested zoning of M-2 (Heavy Industrial). Michael P. O'Day, P.O. Box 149, Pearland, TX 77588, stated that their company is more of an "Industrial" supplier, and they do handle piping up to 14 inches. He stated that their main objective is to keep the business going and in order to this they will need the requested M-2 Zoning. Suzanne Elliott, 1812 Washington Irving, Pearland, Texas, 77581, President of O'Day Rentals and Supplies, stated that there are number of reasons to have Heavy Industrial Zoning and gave examples such as cementing, and storing pipes outside. She is very proud of their company and they have done a fine job in the past and would like to continue. She is in support of the requested zoning. Gill Allison, 1855 Cullen, Pearland, Texas 77581 stated that he is very supportive of the O'Day's and their request. He stated that he has never seen or heard of any problems since the O'Days have been in business. He then stated that he does not agree with the master plan that City Council has created and stated that he thinks they should rethink the overall plan. He also stated that you can actually purchase supplies that you cannot purchase at Home Depot. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS Linda Bracewell -Halsey, 308 W. Thomas, Pasadena, TX stated that she owns a house on Morenci Street, and her concerns are what exactly are they going to do, and she wants to know what all will fit in an Industrial zoning. She then stated that she is concerned about "dusty" situations and she knows of a lot of areas that are zoned "light industrial" and are very dusty. She then stated her concern for what will happen to the property values of surrounding areas. V. COUNCIL/PLANNING COMMISSION/ STAFF DISCUSSION Councilmember Helen Beckman asked Mr. O'Day if they plan to do anything different, and Mr. O'Day replied that they do not. He then reminded the Council Members to look at the pictures he has passed around and nothing is going to change. Council member Helen Beckman stated that her concern is with the Heavy Industrial, and she asked if staff had any answers for the lady's questions. Manager of Administrative Support Tobin Maples stated that he believes the main reason for the request of heavy industrial zoning is for the outside storage element for the piping and other materials. 2 243 Council Member Klaus Seeger stated that a concern is in order for the business to continue what they are doing, do they will need this heavy industrial zoning. Mayor Tom Reid pointed out that there a lot of homeowners near the property in question and they have never received any complaints from these residents. Executive Director of PEDC Mike Chance stated that the M-2 Zoning in this situation is for pipe storage, and he added that all of the oil type yard are listed under the M-2 Zoning. Mayor Tom Reid also pointed out that he is also concerned about what could happen if anyone else buys the property, and Mr. O'Day assured Mr. Reid that they have no intentions in selling the property and they are here to stay. Council Member Larry Marcott stated that he has been by the company several times in the past few months and the pictures that are shown tonight show exactly what the company has looked like. Council Member Klaus Seeger stated that he would like staff to research other alternatives. VI. ADJOURNMENT The meeting for Zone Change Application No. 934 adjourned at 6:50. SPECIFIC USE APPLICATION NO. 89 CALL TO ORDER The meeting to consider a Specific Use Application No. 89 called to order at 6:51 P.M. It. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City form classification Suburban Development District (SD) to Suburban Development District -Specific Use (SD -S) for a Specific Use for a school on the following described property to wit: (Current Suburban Development zoning would allow for agricultural use) 1. Specific Use No. 89 Legal Description: 79.5168 acres being all of lot 17, Section 12, H.T. & B. R.R. co. survey, A-508, Brazoria County, TX (McLean Road) Owner: Pearland Independent School District 2337 Galveston Road Pearland; TX 77581 Agent: Kenneth R. Black of Coboum Linseisen & Ratcliff, Inc. 3 244 The purpose of the public hearing was read into the record by Chairperson Mary Starr. Manager of Administrative Support Tobin Maples, AICP, presented the location of the proposed zone change. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS Kenneth R. Black of Cobourn Linseisen & Ratcliff, stated that he works with the company that is the architect/engineer/surveyor and they have been with the school district for 5 years. He explained that this is a new project that they are only requesting a specific use permit for the school because they plan to have an agriculture facility on the property and this is not allowed in any other zoning. Mr. Black then stated that this school would be an asset to the community, and an asset to any persons living around the school. He then stated that he believes it will enhance the surrounding property values. David Holland, P.O. Box 7, Pearland, TX 77588, representative for PTSD, stated that he is supportive of the request for the specific use permit. Roger Berry, 6301 Palm, Pearland, Texas, 77581 stated that he is the contractor for the facility and with the ever growing population in Pearland he is very supportive of the school. VI. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS None VII. COUNCIL/PLANNING COMMISSION/ STAFF DISCUSSION Council Member Larry Marcott asked how close is the detention pond to the school. Mr. Black showed a map of the proposed detention pond will go and explained that pond that is out there for the residents. VI.
