1999-09-13 CITY COUNCIL PUBLIC HEARING MEETING MINUTESr^ MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, TO BE HELD ON SEPTEMBER 13, 1999 AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Mayor Pro -Tem William Berger Councilmember Klaus Seeger Councilmember Richard Tetens Councilmember Helen Beckman City Manager Glen Erwin City Attorney Darrin Coker City Secretary Young Lorfing Absent: Councilmember Larry Wilkins. Others in attendance: Sr. Project Manager Alan Mueller; City Engineer John Hargrove; Chief Building Official Gene Tumlinson; Fire Marshal Larry Steed; Economic Analyst Will Benson; Purchasing Officer Gordon Island. PURPOSE OF HEARING - PROPOSED ANNEXATION To consider the proposed annexation of approximately 314.6 acres generally located north and east of the existing City limits. STAFF REVIEW OF PROPOSED SERVICE PLAN Sr. Project Manager, Alan Mueller, stated that this is a voluntary annexation based on the petition from the property owners. He further stated that the property consists of two individual tracts. The 48.75 acres are adjacent to the Green Tee Subdivision and then going to Clear Creek, and the 265.85 acres are adjacent to Clear Creek, and up against the extra territorial jurisdiction property line. He further noted that the petition does two things, one is to annex the property into the City limits and the other is to request for annexation into the Municipal Utility District, and that annexation will be done on a separate date. This hearing was advertised in the City's official newspaper on September 1, 1999, and in additional notices were provided to all of the service providers and to the Justice Department. Mr. Mueller reviewed the service plan for the 314.6 acres. In closing he announced that the second public hearing will be held on Monday, September 20, 1999 at 6:30 p.m. and the proposed second and final reading of the ordinance on October 25, 1999. CITIZEN COMMENTS Page 1 of 2 - 9/13/1999 075 076 Carol Freeman, 2902 Morris Road, stated that she had a comment. She said Mr. Mueller during his presentation stated the second public hearing will be held on September 8,1999, and that must have been an error. Sr. Project Manager, Alan Mueller, stated that this annexation public hearing was advertised on September 8, and the second public hearing will be held on September 20, 1999. COUNCIL/STAFF DISCUSSION Mayor Reid gave a brief overview of the agenda procedures for public hearings. PURPOSE OF HEARING - ABANDONMENT OF UNUSED DEDICATED ROAD RIGHT- OF-WAY. TO CONSIDER ABANDONMENT OF UNUSED ROAD RIGHT-OF-WAY. LEGAL DESCRIPTION Abandonment of unused dedicated road right-of-way, being approximately 0.475 acres, located in the H.T. & B.R.R. Company Survey, Abstract 232, in Brazoria County, Texas, and being a portion called Scott Street that lies between Mykawa Road and State Highway 35. STAFF REVIEW OF ABANDONMENT OF UNUSED ROAD RIGHT-OF-WAY City Attorney, Darrin Coker, stated that the request for abandonment was made by a PEDC prospect. The City has water and sewer lines located in the right-of-way, therefore, the requestor has agreed to execute a utility easement to the City for the existing lines. PURPOSE OF HEARING - PURPOSE OF HEARING - CREATION OF PEARLAND PUBLIC IMPROVEMENT DISTRICT, NUMBER ONE, SHADOW CREEK RANCH UNDER CHAPTER 372, LOCAL GOVERNMENT CODE. To consider the Proposed Improvements: Public improvements include the construction of water distribution and wastewater collection lines, storm water drainage facilities, water and sewer impact connection fees, financing costs (including reserve funds, interest and cost of issuance) and creation, organization and administration cost of District. Estimated cost of the proposed improvements. $76,215,000. STAFF REVIEW OF PROPOSED CREATION OF PEARLAND PUBLIC IMPROVEMENT DISTRICT, NUMBER ONE, SHADOW CREEK RANCH UNDER CHAPTER 372, LOCAL GOVERNMENT CODE. Sr. Project Manager, Alan Mueller, stated that the City has received a petition to create the Public Improvement District, and this public hearing is for the creation of the district only. It does not involve the levying of any assessments. Mr. Mueller introduced Lynn Humprhies with Vinson & Elkins. Lynn Hymphires, Vinson & Elkins, addressed Council and stated that this district is similar Page 1 of 2 - 9/13/1999 to a water district, It is being created for the purpose of providing water, sewer, and drainage facilities to the property in order for development. She further explained that a PID does not have taxing authority, and the responsibility for the management of the PID is the City's, ratherthan a separate elected board and body. Ms. Humprhies further explained how a PID operates. CITIZEN COMMENTS George Fishman, 9917 Summerland, addressed Council and stated that he owns a lot in Section 81, Abstract 300, and further stated that he is concerned that it will be a taxing district. He also stated that he may not fully understand what he had read. Carol Freeman, 2902 Morris Road, addressed Council and stated that the comment was made, that there was written notification of this change, and she has not received any notification of this change. COUNCILISTAFF DISCUSSION Mayor Pro -Tem Berger stated that he would like the issues addressed that were concerns of the citizens that had addressed Council. Sr. Project Manager, Alan Mueller, stated that Mr. Fishman's and Ms. Freeman's property are not located within the boundaries of the Public Improvement District.
