R79- 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT BY AND BETWEEN THE CITY OF PEARLAND AND SOUTHWESTERN APPRAISAL COMPANY, INC. BE IT RESOLVED by the City Council of the City of Pearland, Texas, that the Mayor be, and he is hereby, authorized to execute for and in behalf of the City an Agreement by and between the City of Pearland and Southwestern Appraisal Company, Inc. regarding tax appraisal work. D., 1979. d Mayor, City of Pearland, Texas ATTEST: THE STATE OF TEXAS COUNTY OF BRAZOR I A ALL MEN By THESE PRESENTS: THAT WHEREAS, the City of Pearland, Brazoria County, Texas, has determined the need and advisability of employing skilled appraisers and/or valuation experts for the purpose of an appraisal of real properties and improvements thereon and personal properties; within the boundaries of the City of Pearland, for the use of the Tax Assessor -Collector and the Board of Equalization in equalizing all property assessments for the year 1979; and, WHEREAS, the Board of Equalization of the City of Pearland has heretofore, and will in the future, have submitted to it, by the Tax Assessor -Collector of the City of Pearland, for inspection, correction or equalization and approval, renditions of or assessments against personal and real properties, and in the performance of the duties imposed by law upon such Board in the inspection, correction, equalization and approval of such renditions or assessments will have need for technical data and expert testimony pertaining to such properties requiring scientific knowledge, technical skill and experience in analyzing and appraising the value of such pro- perties; and; WHEREAS, it has been ascertained and determined that the South- western Appraisal Company, Inc., of Austin, Travis County, Texas, is skilled in such matters and has scientific and technical knowledge and many years experience in the matter of appraisals and valuations of such properties for ad valorem tax purposes, and it is the pur- pose of the City Council of the City of Pearland to employ the services of Southwestern Appraisal Company, Inc., for said purposes; IT IS THEREFORE AGREED by and between the City of Pearland, Brazoria County, Texas, acting herein by and through its Council, known hereafter as the City, and Southwestern Appraisal Company, Inc., of Austin, Travis County, Texas, referred to hereafter as the Company, as follows: The Company agrees and obligates itself to make an analysis and survey as of January 1, 1979, which shall include all available' information pertaining to the character, quality and quantity of any and all real property, improvements thereon, industrial properties, and personal properties within the boundaries of the City that have been constructed within the City or added to the boundaries of the City after January 1, 1978. This applies only to new construction and/or new business personal property, or to such other properties that may be designated by the Tax Assessor -Collector for review, so as to enable the Company to prepare and file with the Board of Equalization a complete tabulation of technical data and appraised values pertaining to such properties as are duly rendered to or assessed by the Tax Assessor -Collector, for the Board of Equalization's use in reviewing and equalizing the renditions and assessments against such properties submitted to it by the Tax Assessor -Collector for said Board's approval, and fo r'the purpose of furnishing the testimony as herein specified. 2. It is with the express agreement and understanding that the Company does not agree, nor will the City require, that such inven- tory and appraisal show an increase in valuation generally, but such inventory and appraisal is being prepared solely for the use of the Tax Assessor -Collector and the Board of Equalization in equalizing all properties for tax purposes, nor is the preparation of such inventories and appraisals intended in any way to preclude the duties, responsibilities or authority of the Tax Assessor - Collector. 3. The Company further agrees to furnish necessary and qualified appraisers of real estate and improvements to obtain the measure- ment, classification and appraisal of all real property referred to in Paragraph 1 and to show on permanent record forms, which shall become the property of the City, each lot or parcel of land and its appraisal, and the character of construction, materials used, condition, classification, sketch of dimensions and appraisal of each building located thereon. 4 • The Company further agrees that personal property will be listed, al5praised and reported as found. Stocks of merchandise will be appraised to the extent information is made available. It is expressly understood and agreed that the Company will not be required to make an appraisal of pipelines, utilities, railroads, household goods, automobiles, livestock, farm implements, tools and implements of trades and professions, and personal libraries. 5. The Company further agrees to furnish competent and experienced personnel to meet with the Board of Equalization, qualified to fur- nish such expert testimony as may be required by the Board of equal- ization while in formal session, at an additional fee of $225.00 per day, per man, if desired by the City. (Fees for attendance at the Board of Equalization will be separately billed.) 6. The Company anticipates that the City Council will make avail- able all of its tax records, maps and abstract books for the use of the Company, under proper supervision of the Tax Assessor -Collector. 7. The Company does further agree to complete said survey on or before July 1, 1979, and to present its appraisal to the Board of Equalization for its action in 1979. 8. FOR AND IN CONSIDERATION of the skilled services, technical knowledge and experience of the Company in performance of the obli- gations devolving upon them hereunder, the City agrees and oblicates itself to pay the Company an amount equal to Twelve and 75/100ths ($12.75) Dollars per unit appraised for the year 1979, as full compensation for services rendered under the terms of this contract. A unit is defined as any parcel of property, either real or personal, for which an appraisal card is made. Payments in the form of warrants legally drawn against the Maintenance Fund of the City shall be made on this contract upon completion and delivery of the appraisal cards to the Tax Assessor -Collector of the City. «a 9 Recognizing that the cooperation of the Parties hereto is of special importance in agreements of this character, the City, acting by and through its Council, as a further consideration expressly agrees that it will use all of its lawful powers in carrying out the purposes of this agreement: 10. The Company further agrees that in no way will the City. be obligated to the Company, or its assistants for salaries, expenses, or materials, except"as above stated.
