A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE
A CONTRACT BY AND BBTg/EEN THE CITY OF PEARLAND
AND HUGH LANDRUM AND ASSOCIATES.
BE IT RESOLVED by the City Council of the City of Pearland,
Texas, that the Mayor be, and he is hereby authorized to execute for and
in behalf of the City, a Contract by and between the City of Pearland
and Hugh Landrum ~ Associates for the purpose of appraising personal
property in the City of Pearland for tax purposes.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF HARRIS X
THAT WHEREAS: The Mayor and City Council of the City of Pearland have
determined that it would be wise and to the best interests of said City that
said City employ expert consultants skilled in the matter of appraisal and
valuation of industrial plants and utilities in said City; to compile appraisals
and furnish data and information to the City of Pearland's Tax Assessor-Collector
and Board of Equalization for the determination of equalized values of such
properties as compared with other property valuations in said City for the year
1981; said data and information to be made available in respect to all of such
properties properly and lawfully coming before the Board of Equalization for said
year for consideration in the equalization of values upon renditions made by the
owners thereof and/or upon renditions and/or assessments made by the Tax Assessor-
Collector of the City of Pearland, Texas, where the owners may fail to render the
same; and
WHEREAS: The Mayor and City Council find, adjudicate and determine that the
firm of Hugh L. Landram and Associates, Inc., of Houston, Texas, is skilled in such
matters and has scientific and technical knowledge in respect to appraisals and
valuation of such properties; and many years experience in the matter of appraising
and valuing such properties; and
WHEREAS: Hugh L. Landrum, President of the firm of Hugh L. Landrum and Associates,
Inc., of Houston, Texas, has proposed to the Mayor and City Council of the City of
Pearland, Texas, that his firm will gather and compile information relating to the
values of the properties shown on the attached list as of January 1, 1981, and make
this information available to the Tax Assessor-Collector of the City of pearland,
Texas, and to the City of Pearland's Board of Equalization for the year 1981 to be
used by such Tax Assessor-Collector and Board of Equalization as they may see fit in
determining the values which should be assigned to said properties properly coming
before them for consideration and within their jurisdiction in Pearland, Texas, for
the year 1981.
IT IS THEREFORE AGREED by and between the City of Pearland, Texas, acting
herein by its duly authorized Mayor and City Council, FIRST PARTY, and
Hugh L. Landrum and Associates, Inc., of Houston, Harris County, Texas, SECOND PARTY,
as follows:

SECOND PARTY agrees to compile a complete list of appraised values for
commercial and industrial properties as shown on the attached list, and all
related personal and other properties used and employed therewith; said appraised
values to be as of January 1, 1981, and it is hereby understood and agreed by
both parties that the appraisals will be available by May 1, 1981.

SECOND PARTY also agrees to compile and make available to the City of
Pearland's Tax Assessor-Collector and Board of Equalization information showing
the proposed values of said properties above identified, to be used by them as
they may deem fit and for the best interest of said City in determining the proper
values for ad valorem taxes for the year 1981 to be assigned to such properties
as may come before the City of Pearland's Board of Equalization for consideration
of the renditions made by the owners thereof or upon renditions and/or assessments
make by the Tax Assessor-Collector of the City of Pearland, Texas, where the owner
or owners fail to render same.

SECOND PARTY also agrees to prepare a summary report for the City Tax
Assessor-Collector after the Boardof Equalization meetings; said report to
show each industry's final value for improvements, personal property, and a brief
explanation of the property and any changes that may be useful in the operation
of the City Tax office.

SECOND PARTY further agrees to cooperate with the City Tax Assessor-Collector
and his Deputies in other areas of technicalproperty valuations where he may
have expertise that would be valuable to them inmaking a more accurate appraisal.

IT IS ALSO FURTHER AGREED that in the event SECOND PARTY'S proposed values
are protested by the owners or representatives of the property, SECOND pARTY
will at his own expense furnish expert testimony in ~the District Court of
Brazoria County, Texas, to defend his proposed values.

SECOND PARTY agrees that the City of Pearland, Texas, will in no way be
obligated or indebted to said SECOND PARTY, or his agents, servants, or
employees, for salaries, expenses, materials, or other charges except only as
herein specifically otherwise provided.
VI.I
IT IS FURTHER DISTINCTLY UNDERSTOOD AND AGREED by both parties hereto,
that if any word, phrase, sentence, paragraph, or provision of this contract
shall be for any reason, declared or adjudicated to be invalid, such declaration
or adjudication shall not affect the validity of the remaining portion thereof.

FOR AND IN CONSIDERATION of the skilled services, technical knowledge,
and experience of SECOND PARTY in the performance of the obligations devolving
upon such PARTY hereunder; and in consideration of the information given and
assistance furnished by SECOND PARTY to the Tax Assessor-Collector and the
Board of Equalization of the City of Peartand, Texas, in their capacity of
undertaking to value and equalize the value of utilities and industrial pro-
perties coming before the Board of Equalization for the year 1981 for considera-
tion at its equalization hearings; FIRST PARTY agrees and obligates itself to
compensate SECOND PARTY by payment to SECOND PARTY, the sum of FOUR THOUSAND
THREE HUNDRED AND FIFTY DOLLARS ($4,350.00) for the calendar year 1981.
THE EXECUTION OF THIS CONTRACT is authorized by proper resolution duly
adopted by the City Council of the City of Pearland, Texas, and entered upon
the Minutes of such Council.
EXECUTED IN DUPLICATE by order of the Mayor of the City of Pearland, Texas,
