R81-18 7-6-81 RESOLUTION NO. R81-)8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS ESTABLISHING THE CITY'S POSITION RELATIVE TO THE CREATION OF A CLEAR CREEK DRAINAGE AUTHORITY. WHEREAS, the City Council of the City of Pearland feels that it is in the best interest of the citizens of Pearland and Brazoria County to oppose the creation of a Clear Creek Drainage Authority which would include Brazoria County; and WHEREAS, the tax payers within the City of Pearland as well as the voters located in Brazoria County Drainage District No. 4 have invested considerable time and tax funds since 193l in acquiring equipment and experienced personnel to insure that the area's drainage problems are properly dealt with; and WHEREAS, the Brazoria County Drainage District No. 4 has been working under the Master Corps Plan for a 25 Design Flood which is of greater protection than the current Corp Plan; and WHEREAS, this legislation will provide no advantage to citizens of Brazoria County Drainage District No. 4 because all drainage efforts would cease while the new Board and Staff study the watershed drainage problems and then commence appropriate action; and WHEREAS, local tax dollars will be used in areas that have not tried to alleviate their own drainage problems which in effect means that we pay to solve their problems; and WHEREAS, the watershed drainage work would start at the mouth of Clear Creek utilizing local tax dollars and equipment resources which would effectively shut down drainage work within the Pearland area and would cause deterioration in the present level of service; and WHEREAS, there are also ~ number oF concerns, such as, the reallocation to other areas of equipment purchased by our citizens, -1- and the possible loss of the full time, trained staff of drainage employees, and many other similar concerns; and WHEREAS, other taxing units in the Clear Creek Watershed have had both the opportunity and the authority to solve their drainage problems and have not seen fit to act which now places the full burden on all of the citizens in the watershed area; and WHEREAS, the Pearland City Council is opposed to any legislation creating a new taxing authority which would include the citizens of the City of Pearland and Brazoria County Drainage District No. 4. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. That the Pearland City Council feels that there is no advantage for the citizens of Pearland and Brazoria County Drainage District No. 4 to be included in the Clear Creek Drainage Authority legis- lation as presently drawn. This does not mean that we are against joining with other Clear Creek neighbors in solving the watershed problems. II. That the Pearland City Council is opposed to the expenditure of tax dollars to hold a local option election that is not wanted, nor is it in the best interest of the citizens of Pearland and Brazoria County Drainage District No. 4. After meeting with representatives of Pearland Drainage District 94 and other residents of Brazoria County and Pearland, I um~erstood their concern and problem with a watershed district that would take in a small area of Brazoria County. Accordingly, I placed within the bill a provision that would call for an election in each or.the three counties: Brazoria, Galveston, and Harris; and that would require a majority of the people in ~nch county to vote in favor of the project before that county becama a part of the project. After doing so, the elected officials agreed to support the legislation with the idea that if it did in fact pass, they would let the citizens of their area decide if they wanted to participate in the program. The bill did in fact pass the Senate, but failed to get the ~o-thirds vote necessary to suspend the rules in the House to take it up for consideration. I will continue to word toward solving the problem of Brazoria County and the Clear Creek Watershed, and I appreciate your concern and your help in working toward that end.
