A RESOLUTION ADOPTING RATEMAKING AND OTHER
STANDARDS REQUIRED TO BE CONSIDERED BY THE
PUBLIC UTILITY REGULATING POLICIES ACT OF
1978 APPLICABLE TO ELECTRICAL SERVICE PRO-
VIDED BY HOUSTON LIGHTING & POWER COMPANY
AND COMMUNITY PUBLIC SERVICE COMPANY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS:
1. The City of Pearland, Texas, having conducted hearings as
required by Title I of the Public Utility Regulating Policies
Act of 1978 (the "act"), has made the following determinations
with respect to ratemaking and other standards required to be
considered by the act with respect to electrical service pro-
vided by Houston Lighting and Power Company and Community Public
Service Company, within the City limits of the City of Pearland,
Texas, to-wit:
1. A determination as to electric utility ratemaking
standards~, described in Section lll(d) of the act will be made in
accordance with Section 112 of the act, during the final rate
proceeding to commence after November 9, 1981.
2. The City of Pearland hereby makes the following determina-
tions regarding Electric Utility Service standards described in
Section 115 of the act and lifeline rates described in Section
114 of the act.
(a) The City finds that Standards for master metering
contained in Article 1446d of Vernon's Texas Civil Statutes and
in the Rules and Regulations of Houston Lighting and Power Company
and Community Public Service Company, a copy of which is on file
with the City, are consistant with the purposes of the act and are
hereby adopted by the City.
(b) The City finds that the Standards for treatment
automatic fuel adjustment clauses are adequately subject to review
by the City, pursuant to its Charter, and the Public Utility
Commission of TeXas, pursuant to Article 1446c, of Vernon's
Texas Civil Statutes, and are consistant with the purposes of
the act and are hereby adopted by the City.
(c) The City finds that the Standards for Consumer
information contained in the Rules and Regulations of Houston
Lighting and Power Company and Community Public Service Company,
a copy of which is on file with the City, and the applicable
substantive Rules of the Public Utility Commission of Texas, are
consistant with the purposes of the act and are hereby adopted
by the City.
(d) The City finds that the Standards for Termination
of Service contained in the Rules and Regulations of Houston
Lighting and Power Company and Community Public Service Company,
a copy of which is on file with the City, are consistant with the
purposes of the act and are hereby adopted by the City.
(e) The City finds that the Standards for advertising
contained in the Rules and Regulations of Houston Lighting and
Power Company and Community Public Service Company, a copy of
which is on file with the City, and the Standards and Regulations
heretofore approved and adopted by the Public Utility Commission
of Texas, are consistant with the purposes of this act and are
hereby adopted by the City.
2. That nothing contained in this Resolution shall be construed
now or hereafter as limiting or modifying, in any manner~ the right
and power of this City, under its Charter and applicable law, to
regulate the future rates, charges, and standards of Houston Light-
ing and Power Company and Community Public Service Company within
the Corporate limits of this City.
3. That it is hereby officially found and determined that the
meeting at which this Resolution is passed was open to public and
held and called pursuant to law.
