2001-02-05 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON FEBRUARY 5, 2001, AT 6:30 P.M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. ZONING APPLICATION NO. 964 I. CALL TO ORDER The Joint Public Hearing was called to order at 6:35 P.M. II. PURPOSE OF HEARING Reauest of owners for an Development Ordi Development Dist described property, ri nance of ct (SD) to to wit: Zoning Application No. 964 amendment to the Land Use and Urban said City from classification Suburban Commercial District (C) on the following Legal Description: Lots 4-10, Detenbeck & Barnhart Subdivision, Brazoria Co., TX, according to the map or plat thereof recorded in Volume 15, Page 10, plat records of Brazoria Co., TX (5902 Bardett) Owner: Arthur Partain 6806 Broadway Pearland, TX 77581 016 The purpose of the public hearing was read into the record by P&Z Chairman Charles Viktorin. Manager of Administrative Support Tobin Maples, AICP, presented the location of the proposed zone change by showing slides of the property and gave a brief description of the surrounding properties. He then stated that the Comprehensive Plan recommends General Business, and the proposed request is not consistent, therefore staff recommends denial. He stated that staff would recommend approval of General Business. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Arthur Partain, 6806 Broadway Street, Pearland, TX 77581, stated that the property has been used for the last 10 years as "Commercial". He stated that it has been a machine Shop, a plumbing Shop, and a diesel Shop. Mr. Partain stated that there is not one neighbor who objects, and he has visited them all. He asked City Council to accept this request and that he has plans that cannot be done with out the proper zoning. Dave Miller, 3603 W. Pine Orchard Dr, Pearland, TX, business address is 3077 Broadway, Pearland, TX. He stated that he is for the request. He stated that even though the Comprehensive Plan is for "General Business", he asked the City Council to take a look at the existing land use south of the property. He then stated that he feels there should be some "Commercial' zoning in this area. He pointed out that there is generally more automotive/construction type of businesses in this area. He stated that there is a minute difference between "Commercial" and "General Business" and he would like to stick with the request of "Commercial' zoning for this property. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST NONE V. COUNCIUPLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Manager of Administrative Support Mayor Reid stated that he would like to enter into record the fact that he did receive 18 forms that were marked in support of the request, and 2 forms that were unmarked. Council Member Marcott stated that they received a request on lot 76 to go for a different zoning, and there was a lot of opposition, and they ultimately turned the request down. He then pointed out that this is a mixed-use area. P&Z Commissioner Beltz asked if there is any other "Commercial" zoning around, and Manager of Administrative Support Tobin Maples replied that there is a lot of automotive business, however, a lot of property remains "unzoned." 017 Council Member Beckman stated that she remembers the Elks Lodge being zoned, and she thought it was zoned "Commercial". VI. ADJOURNMENT The Joint Public Hearing adjourned at 6:47 P.M. ZONING APPLICATION NO. 968 CALL TO ORDER 11. PURPOSE OF HEARING Request of owners for an amendment Development Ordinance of said City Development District (SD) to General following described property, to wit: Zoning Application No. 968 to the Land Use and Urban from classification Suburban Business District (GB) on the Legal Description: 3.1092 acres of land out of Lot 46, Allison Richey Gulf Coast Home Co. Subdivision, Section 8, H. T. & B. R.R. Co. survey, A-504, according to the plat recorded in Vol. 2, pg 24, plat records of Brazoria Co., TX (Broadway Street @ Garden Road) Owner: Orlen O'Day, Executor P.O. Box 149 Pearland, TX 77588 Agent: C. L. Davis The purpose of the public hearing was read into the record by P8Z Chairman Charles Viktorin. Manager of Administrative Support Tobin Maples, AICP, presented the location of the proposed zone change by showing slides of the property and gave a brief description of the surrounding properties. He then stated that the request is compliant with the Comprehensive Plan, and staff does recommend approval. He added that a Traffic Impact Analysis might be required before permitting. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST AR Chuck Davis, 1500 Winding Way, Friendswood, TX, stated that he is the agent for this request and he is asking to utilize this property as "General Business", and the developer will be conscious of the surrounding properties. Dave Miller, 3603 W. Pine Orchard Dr, Pearland, TX, business address is 3077 Broadway, Pearland, TX, stated that he is in favor of the request. He then stated that he has a question and asked why they did not request "Commercial' Zoning. He stated that he realizes that it would be beneficial to have either "Commercial" or "General Business" as zoning, but he feels that it would be better to have "Commercial". He then stated as a citizen he is in favor of the request. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST NONE V. COUNCILIPLANNING COMMISSIONISTAFF DISCUSSION Mr. Tobin Maples, Manager of Administrative Support Mayor Reid stated that out of the 15 public comment forms, he received 1 back that was in support of the request providing that there are no metal buildings and that the landscaping plans are upscale. VI. ADJOURNMENT The Joint Public Hearing adjourned at 6:55 P.M. ZONING APPLICATION -NO. 969 I. CALL TO ORDER The Joint Public Hearing was called to order at 6:56 P.M. II. PURPOSE OF HEARING Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Single Family Dwelling District (R-2) on the following described property, to wit: Zoning Application No. 969 Legal Description: 31.1548 acres located in the W.D.C. Hall survey, A-23, Harris Co., TX (Villa Verde, Section II & 111) Owner: Villa Verde, Section 11 & III, L.P. 6302 Broadway, Ste 250 4 019 Pearland, TX 77581 Agent: Renee L. West The purpose of the public hearing was read into the record by P&Z Chairman Charles Viktorin. Manager of Administrative Support Tobin Maples, AICP, presented the location of the proposed zone change by showing slides of the property and gave a brief description of the surrounding properties. He then stated that the request is compliant with the Comprehensive Plan, which calls for Low Density Residential. He stated that staff recommends approval with a note to the developer that a Traffic Impact Analysis will be required. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Terry Brooks, 6302 Broadway, Pearland, TX, stated that this is adjacent to Section One, and they are requesting this zone change so that they may finish their development. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST NONE V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mr. Tobin Maples, Manager of Administrative Support Mayor Reid stated that there were no public comment notices returned. VI.
