R2000-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO AN INTERLOCAL AGREEMENT WITH THE CITY OF ALVIN FOR PARTICIPATION IN A WATER STUDY FOR THE MID-BRAZORIA COUNTY AREA. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain interlocal agreement by and between the City of Pearland and the City of Alvin, a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest the original of the attached agreement for and on behalf of the City of Pearland, for participation in a water study for the Mid-Brazoria County Area. COK~R CITY ATTORNEY INTERLOCAL AGREEMENT BETWEEN THE CITY OF ALVIN AND THE CITY OF PEARLAND FOR COMPLETING A WATER STUDY FOR THE MID-BRAZORIA COUNTY AREA This Agreement is entered into by and between the City of Alvin (hereinafter referred to as "Alvin"), a home-rule City located in Brazoria County, Texas, and the City of Pearland (hereinafter referred to as "Pearland"), a home-rule City also located in Brazoria County, Texas. WITNESSETH: WHEREAS, it is the desire of the parties to assure that the Mid-Brazoria County area has an adequate long-term supply of high-quality drinking water; and WHEREAS, the several agencies in Mid-Brazoria County have agreed to participate in a common study to define cost-effective solutions to the long-term water needs of the area; and WHEREAS, an application was filed with the Texas Water Development Board for financial assistance in completing the study; and WHEREAS, the Texas Water Development Board has agreed to pay for one-half the costs of the study in an amount up to $66,921.00; and WHEREAS, the City of Alvin has agreed to be the lead agency in the study with the full participation of all other 3arties; NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth herein the parties hereby agree as follows: A. GENERAL 1. This Agreement shall be effective for a period of one year from and after November 15, 2000. This Agreement may be extended by mutual agreement of the parties for additional one-year periods. Page 1 of 4 2. The participants in the study will mutually agree, by majority vote of the representatives present at called meetings, to major decisions such as the selection of an engineering consultant and acceptance of the consultant's recommendations. 3. Participation in this study will not commit the parties to any actions past the completion of the study. B. CITY OF ALVIN 1. Alvin agrees to be the lead agency including, but not limited to, issuing requests for qualifications from engineering firms for preparation of the study, subject, however, to the parties' financial participation. 2. Alvin agrees to establish and participate in a steering committee of the participants to obtain input into the study. 3. Alvin agrees to keep all participants informed on development and progress of the study. 4. Alvin will coordinate all work with the Texas Water Development Board. 5. Alvin assigns Dick Carter, the Director of Public Works and Engineering, as the primary contact for this Agreement. C. CITY OF PEARLAND 1. Pearland agrees to participate in the cost of preparation of the study in the amount of $5,000.00 in cash. The cash contribution will be paid to Alvin upon the selection of an engineering consultant. 2. Pearland agrees to appoint ~/;"/~/. _ ,4¢2~.~ as the primary contact for this Agreement and to serve as a representative on the steering committee. 3. Pearland agrees to promptly provide available needed information. Page 2 of 4 D. APPROVAL This Agreement has been duly authorized by the governing bodies of each party as expressed in the official minutes at which authorization was given. E. CURRENT REVENUES The contractual obligations required by this Agreement shall be payable from current revenues available to the respective city.
