R2001-0013 01-22-01 RESOLUTION NO. R200'1-t3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING A TREE PROPAGATION PROGRAM FOR THE PURPOSE OF PURCHASING, GROWING, AND/OR MAINTAINING TREES WITHIN THE CITY LIMITS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain tree propagation program, a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute any and all documents necessary for the establishment and maintenance of the tree propagation program. COKER CITY ATTORNEY City of Pearland Parks and Recreation Department Tree Trust The City of Pearland adopted Ordinance No. 772, Tree Protection and Preservation Ordinance, to manage and maintain the urban forest within the City's boundaries. The Ordinance authorizes' a Tree Trust Capital Project Fund for the purchasing, growing, and/or maintaining trees and associated plants within the City limits. Funding for the Tree Trust is derived from public donations and mitigative measures outlined in the Tree Protection and Preservation Ordinance Criteria Manual. A developer seeking to build on a site that has trees must modify his plans to comply with the Ordinance; if this is not feasible and trees are removed, the developer must replace the caliper inches removed on a one-for-one basis. Should the developer decide that replacement is not feasible, a monetary contribution must be made to the Tree Trust equal to the purchase of the number of caliper inches removed. Monies from the Tree Trust must be used to: · Establish and maintain a tree farm · Purchase specimen trees to be planted in the City's parks, rights-of-way, and easements. · Purchase of irrigation systems for the maintenance of trees. Establishment of the tree farm includes the purchase of bare rootstock, planting media, containers, the construction of an irrigation system, and any items necessary to maintain the tree farm in a productive state. The Pearland Parks and Recreation Department shall operate the tree farm. The Park Superintendent, or his designee, shall recommend the appropriate species grown in the tree farm and shall be responsible for selecting, purchasing, and planting of trees on all City grounds.
