R91-25 07-08-91 RESOLUTION NO. R91-25 A RESOLUTION GRANTING A MORATORIUM ON THE IMPOSITION OF IMPACT FEES ON THE CAPITAL IMPROVEMENTS PLAN FOR THE CITY OF PEARLAND, TEXAS, AND PROVIDING FOR SEVERABILI- TY. WHEREAS, pursuant to Ordinance No. 471, adopted the 9th day of April, 1984, the City Council authorized the imposition of capital maintenance and recovery fees for the purpose of defray- ing future capital costs for construction and maintenance of distribution, transmission, and treatment facilities of water and sanitary sewers; and WHEREAS, in accordance with and pursuant to said Ordinance No. 471, the city Council did, by motion, adopt a fee schedule for recovery of capital maintenance and recovery costs; and WHEREAS, by virtue of Article 1269j-4.11, Texas Revised civil Statutes, adopted by the 70th Legislature, Regular Session, 1987, the City Council has found it necessary and appropriate to adopt a new capital improvements plan and capital recovery fee schedule to comply with the provisions of said Article 1269j- 4.11; and WHEREAS, the City Council has implemented an impact fee schedule by Resolution on October 10, 1988 to be effective April 10, 1989; and WHEREAS, the city Council by Resolution No. R89-21 approved on June 12, 1989, granted a moratorium on the implementation of these impact fees for a period beginning June 15, 1989 and ending June 15, 1991; and WHEREAS, the City Council now desires to continue this moratorium on the implementation of the impact fees; now, there- fore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. A moratorium of the impact fees approved by Resolution No. R88-30 which took effect on April 10, 1989 is hereby granted from JUNE 16 , 19 91 to JUNE 15 , 19 93 PASSED, APPROVED, and ADOPTED this ~ day of  , A.
