R91-35 10-14-91 R~SOLUTION R91-35 A RESOLUTION EXPRESSING THE DESIRE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, TO HAVE BRAZORIA COUNTY REACTIVATE ROAD DISTRICT NO. 3 AND TO DEFINE NEW BOUNDARIES THEREFOR TO INCLUDE ALL OF BROOKSIDE VILLAGE. WHEREAS, Tex. Rev. Civ. Stat., Art. 6702-1, Section 4.413(a) provides, in part: "The county commissioners courts in their sole discretion may, after a public hearing for which notice is given as provided herein for notices of elections, establish one or more road districts as governmental entities and bodies politic pursuant to Article III, Section 52, of the Texas Constitution in their respective counties and may or may not include within the boundaries and limits of the districts, villages, towns, and municipal corporations or any portion of a village, town and municipal corporation and may or may not include previously created road districts and political subdivisions or precincts that have voted and issued road bonds pursuant to Article III, Section 52, of the Texas Constitution, by entering an order declaring the road district established and defining the boundaries of it"; and WHEREAS, there has heretofore been created within Brazoria County, Texas, one certain Road District No. 3 which includes a portion of the City of Pearland, Texas; and WHEREAS, it is the desire of City Council that there be established and reestablished, pursuant to the grant of authority contained above, a new and reactivated Road District No. 3 to include that area of Pearland and Brookside Village according to the desire of its governing body in accordance with the annexed map and field notes, designated collectively Exhibit "A" hereof and incorporated herein for all purposes; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: ~. That the City Council expresses its approval and requests reactivation of Road District No. 3 to be created and recreated in accordance with the annexed map and field notes, designated collectively Exhibit "A" hereof: and the dissolution of the existing boundaries; ~ That the City Council of the City of Pearland requests inclusion of all of the area of Brookside Village if that inclusion is confo~able with the intent of Brookside Village's governing body.
