1995-12-11 CITY COUNCIL REGULAR MEETING MINUTES - 7:00PMMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TERAS, HELD ON DECEMBER 11, 1995, AT 7:00 P. M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Councilmember Councilmember Councilmember Councilmember City Manager City Attorney City Secretary Tom Reid Jerry Richardson Randy Weber Kevin Cole Helen Beckman Paul Grohman Amy McCullough Yolanda Benitez Others in attendance: Assistant City Managers Glen Erwin and Richard Burdine; Assistant Police Chief Chris Doyle; City Engineer John Hargrove; and Parks & Recreation Director Ed Hersh. Absent: Mayor Pro Tem/Councilmember Richard Tetens INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was given by Councilmember Kevin Cole, and the Pledge of Allegiance was led by Officer Matt Zepeda. APPROVAL OF MINUTES Councilmember Cole moved for the regular meeting of November 27, Richardson seconded the motion. Motion passed 4 to 0. MAYOR'S ACTIVITY REPORT approval of the minutes of the 1995, 7:30 p.m. Councilmember Mayor Reid asked City Manager Paul Grohman to present the proclamation to Liz Bradley, President of the Pearland Neighborhood Center and to Neighborhood Center Board Member Matt Zepeda declaring Friday, December 15, 1995, as Pearland "Share Your Christmas" Day. Mayor Reid noted his activities over the past two weeks which included: the "Tree Lighting Ceremony" on November 30th, the food drive sponsored by Jamison Middle School on December 1st, the "Light Parade" on December 2nd, a tour of the Council Chambers with Webelos Pack 463 on December 6th, the Texas Association of Regional Councils meeting in Austin on December 8th, the City employees Christmas Party on the evening of December 8th, and the dedication of the City of Friendswood's new City Hall which was held on December 10th. COUNCIL ACTIVITY REPORTS Councilmember Beckman reported that she attended the "Tree Lighting Ceremony on November 30th, the "Light Parade" on December 2nd, the "Walk on Broadway" on December 4th, the employee Christmas Party on December 8th, and the "Tour de Lites" on December 9th. Councilmember Cole noted that he attended the "Tree Lighting Ceremony" on November 30th, Jim Benson's funeral on December 1st, and the "Light Parade" on December 2nd. 126 Councilmember Weber reported that he rode in the "Light Parade" on December 2nd, and attended the City employee Christmas Party on December 8th. Councilmember Richardson reported that he attended a presentation by the PEDC on December 1st, rode in the "Light Parade" on December 2nd, and attended a Strategic Planning Committee meeting on December 6th. CITY MANAGER'S REPORT City Manager Paul Grohman reported that an award had been presented to the Parks & Recreation Department for their efforts in providing softball to the community. He also noted that the City had provided the Hyde Park Beautification Project volunteers with the materials necessary to build a planter box and a flower box around their park sign. Mr. Grohman noted that an old tombstone was discovered during the renovation of the old Settlers Cemetery which had been stolen from a cemetery in Marshall, Texas nearly 20 years ago. It has been returned to the family. City Manager Grohman reported that Scott & Company has donated ten (10) Live Oak trees to the City for use in the parks. Centennial Park is progressing nicely and should be completed around February 1, 1996. Mr. Grohman stated that Shadybend Drive is near completion, and more paving work will be taking place in the Sleepy Hollow subdivision. He also reported that the State is doing some drainage work on FM 518 on the west side of town, and this will probably cause some traffic delays during the next few weeks. City Manager Grohman noted that crime is still down throughout the City and reported that the D.A.R.E. graduations will take place tomorrow, Tuesday, December 12, 1995, at 9:00 a.m., 10:00 a.m. and 1:30 p.m. City Manager Grohman reported that Western Atlas is closing out their Houston operation and moving it to Pearland, and they will have approximately 30 employees in a 25,000 square foot building. He also noted the outstanding efforts of the Economic Development Corporation staff during the short time they have been in operation. Mr. Grohman stated that the Pearland Economic Development Council (PEDC) will hold a public hearing tomorrow night (Tuesday, December 12, 1995 - 6:00 p.m. in the Council Chambers) concerning the development of a 100 -acre industrial/commercial/business park. CITIZENS: 1. David Smith - 2714 Green Tee. Mr. Smith addressed the Council with regard to changing the name of the City from "Pearland" to "Pear Land". His suggestions on the implementation of the change were outlined in a written proposal provided to the Mayor and Council. L. B. Lyons - 5013 Apple Springs. Mr. Lyons addressed the Council concerning several suggestions he had for Council's consideration. 1) Instead of the entire Council attending a retreat, they should send staffinembers who can then prepare a report to bring back to Council. 2) He also suggested that Council drop in on City operations to check on things and to let employees know that they (the Mayor and Council) are interested. 3) Mr. Lyons suggested that the Council strongly consider granting the Houston Chronicle the contract for publishing all legal notices. 4) Mr. Lyons strongly suggested that Glen Erwin provide the Council with a written report, before the next Council meeting, concerning why taxpayers money was wasted and what has been done to make sure it won't happen anymore. 127 DOCKETED PUBLIC HEARINGS: None BUSINESS: SECOND READING OF ORDINANCE NO. 709 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, WAIVING THE ENCROACHMENT OF A PRIVATE SWIMMING POOL INTO THE DEDICATED UTILITY EASEMENT ON LOT 26, BLOCK 4, OF THE GREEN TEE TERRACE SUBDIVISION, SECTION I, LOCATED AT 3015 COUNTRY CLUB DRIVE, IN THE CITY OF PEARLAND, HARRIS COUNTY, TEXAS. SECOND READING OF ORDINANCE NO. 710 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, WAIVING THE ENCROACHMENT OF A PRIVATE SWIMMING POOL INTO THE DEDICATED UTILITY EASEMENT ON LOT 7, BLOCK 1, OF THE PINESHADOWS SUBDIVISION, LOCATED AT 2007 PINEHILL DRIVE EAST, IN THE CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS. Councilmember Weber moved that Ordinance No. 709 and Ordinance No. 710 be adopted on second and final reading. The motion was seconded by Councilmember Richardson. Voting "Aye" - Councilmembers Richardson, Weber, Cole and Beckman. Voting "No" - None. Motion passed 4 to 0. SECOND READING OF ORDINANCE NO. 509-65 - AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR THE PURPOSE OF GRANTING A SPECIFIC USE PERMIT TO ALLOW FOR A DUPLEX OR SINGLE FAMILY HOMES TO BE BUILT IN A GENERAL BUSINESS DISTRICT (GB) ON LOTS 29, 30 AND 31, BLOCK 6, OLD TOWN SITE (2236 & 2240 GRAND BOULEVARD) AT THE REQUEST OF CARL E. TALBOT, AGENT FOR ESSIE TALBOT, OWNER, PROVIDING FOR AN AMENDMENT TO THE LAND USE DISTRICT MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE; AND OTHER PROVISIONS RELATED TO THE SUBJECT. Councilmember Beckman moved for the adoption of Ordinance No. 509- 65 on second and final reading. The motion was seconded by Councilmember Weber. Voting "Aye" - Councilmembers Beckman, Cole, Weber and Richardson. Voting "No" - None. Motion passed 4 to 0. NEW BUSINESS: AWARD OF BID NO. B95-29 - SIDEWALKS City Manager Grohman recommended that all bids be rejected on this item and requested that staff be allowed to rebid. Councilmember Weber moved to reject all bids on Bid No. B95-29, seconded by Councilmember Richardson. Voting "Aye" - Councilmembers Beckman, Cole, Weber and Richardson. Voting "No" - None. Motion passed 4 to 0. RESOLUTION NO. R95-74 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE, ON BEHALF OF THE CITY, A WATER PURCHASE CONTRACT BY AND BETWEEN THE CITY AND BRAZORIA COUNTY MUNICIPAL UTILITY DISTRICT NO. 16 ("DISTRICT") FOR PURPOSES OF PROVIDING POTABLE WATER TO THE DISTRICT. 128 RESOLUTION NO. R95-71 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE, ON BEHALF OF THE CITY, A WASTEWATER TREATMENT FACILITIES AGREEMENT BY AND BETWEEN THE CITY AND BRAZORIA COUNTY MUNICIPAL UTILITY DISTRICT NO. 16 ("DISTRICT") FOR PURPOSES OF PROVIDING WASTEWATER TREATMENT SERVICES TO DEVELOPMENT LOCATED INSIDE AND OUTSIDE THE DISTRICT THAT CANNOT BE SERVED BY THE CITY'S EXISTING WASTEWATER TREATMENT FACILITIES. Councilmember Cole moved for the adoption of Resolution No. R95-74 and Resolution No. R95-71. Councilmember Richardson seconded the motion. Voting "Aye" - Councilmembers Richardson, Weber, Cole and Beckman. Voting "No" - None. Motion passed 4 to 0.
