1995-07-31 CITY COUNCIL REGULAR MEETING MINUTES - 7:00PM41 r MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TERAS, HELD ON JULY 31, 1995, AT 7:00 P. M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TERAS. The meeting was called to order with the following present: Mayor Pro Tem/Councilmember Councilmember Councilmember Councilmember Councilmember City Manager City Attorney City Secretary Richard Tetens Jerry Richardson Randy Weber Kevin Cole Helen Beckman Paul Grohman Amy McCullough Yolanda Benitez Others in attendance: Assistant City Managers Richard Burdine and Glen Erwin; Police Chief Mike Hogg; Parks Director Ed Hersh; Director of Administrative Services Mary Hickling; and City Engineer John Hargrove. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was given by Councilmember Weber. The Pledge of Allegiance was led by Councilmember Cole. APPROVAL OF MINUTES It was moved by Councilmember Weber, seconded by Councilmember Beckman, that the minutes of the regular meeting of June 19, 1995, 7:00 p.m., be approved as submitted. Motion passed 5 to 0. MAYOR'S ACTIVITY REPORT Mayor Pro Tem Tetens announced that the following people were being presented with certificates of appreciation for their service on various boards and commissions: James Gilbert/Civil Service Commission David Beckman/Library Board Nancy Sallee/Library Board Charles Phillip/Planning & Zoning Commission Jeff O'Brien/Zoning Board of Adjustment Terrie Morgan/Zoning Board of Adjustment Bob Lewis/Zoning Board of Adjustment Those not in attendance, Nancy Sallee, Charles Phillip, and Bob Lewis will be mailed their certificates of appreciation. Mayor Pro Tem Tetens, assisted by Councilmember Weber, issued a r proclamation to Matt Zepeda in observance of the 12th Annual "National Night out" which will be held throughout the city of Pearland on August 1, 1995. Mayor Pro Tem Tetens commended Matt Zepeda for his work with the crime prevention program, as well as the National Night out observance. ,Mf Matt Zepeda noted that this is the sixth year that the City of Pearland has taken part in this endeavor and encouraged continued participation on the part of all citizens. He then noted some crime statistics as follows: 1992 1995 Residential Burglaries 122 26 Stolen Vehicles 136 20 He noted that for a city the size of Pearland, the crime rate is extremely good, but that there is still work to be done and requested that the citizens not hesitate to report any suspicious behavior in their neighborhoods or anywhere throughout the city immediately upon observing it. COUNCIL ACTIVITY REPORTS Councilmember Beckman reported that she had attended the Brazoria County Cities Association meeting in Clute, Texas on June 21st and noted that the new legislation passed had been discussed. She also reported that on June 28th, she attended the Houston -Galveston Area Council workshop for newly -elected officials and noted it was a good training session. Councilmember Beckman reported that she attended the Association of Mayors, Councilmembers and Commissioners on June 27-30. She noted that there were excellent speakers and she gained some very useful information. She also spoke about the literacy program. Councilmember Cole reported that he also had attended the HGAC newly -elected officials workshop on June 28th, and noted that he had some questions for which he would be seeking answers in order to effectively perform his duties as an elected official. He also attended the Brazoria County Cities Association meeting in Danbury, Texas on July 19th and noted that they were given a tour of the fish farm. Councilmember Cole reported that he had attended the TML Association of Mayors, Councilmembers and Commissioners training in Austin on July 27-30 and felt that Pearland is ahead of some cities in a lot of ways. Councilmember Weber reported that he attended the June 21st BCCA meeting in Clute, Texas, just as had Councilmember Beckman and that he attended the July 19th BCCA meeting in Danbury, Texas, along with Councilmember Cole. He also noted that the citizens of Pearland should take a drive to Danbury to see their central park and then come back and give thanks for Independence Park and Centennial Park because of our terrific park system in comparison to the city of Danbury. Councilmember Weber, along with the rest of the Council, attended the Association of Mayors, Councilmembers and Commissioners meeting in Austin on July 27-30. He also commended the city staff for their outstanding work, after having heard from City Attorneys, City Managers and others at the meeting in Austin. Councilmember Richardson reported he also attended the TML Association of Mayors, Councilmembers, and Commissioners training session in Austin on July 27-30. He noted that he felt this was a "first" for the City of Pearland (for at least several years) to have the entire Council attend a training session together. He also commented that he was grateful for the City and feels that we do have a professional staff that is doing a good job. Mayor Pro Tem Tetens noted that he felts it had been at least 6-7 years since the entire Council had attended a meeting such as the TML meeting in Austin and commended them for their commitment of their time and efforts in attending the training session. CITY MANAGER'S REPORT City Manager Paul Grohman reported that the city staff had prepared for the tropical storm which passed the city by and were ready should the city not be as lucky the during the next storm warning. R CITIZENS 1. L. B. Lyons - 5013 Apple Springs - Mr. Lyons thanked City Secretary Yolanda Benitez for her assistance in addressing one of his questions prior to the start of the Council meeting. He then addressed City Attorney Any McCullough and noted that he had viewed some personnel forms and stated that these forms needed to be redone. In particular, he noted the Salary Adjustment Form needed to be revised. He also noted that r-- there were forms missing in the personnel files which he viewed; namely, classification forms, where changes in job titles and salaries had taken place. Mr. Lyons then thanked City Manager Paul Grohman for his efforts in getting the ditches sprayed. Mr. Lyons also mentioned that his neighborhood organization was anticipating and would welcome a newsletter from Mr. Grohman which would note the items of interest - whether they be good or bad. Mr. Lyons requested that City Manager Grohman instruct the City Council on putting out a newsletter from the Council instead of the City Manager. DOCKETED PUBLIC HEARINGS: NONE UNFINISHED BUSINESS: REMOVE FROM TABLE ORDINANCE NO. 690 (GOLF BALLS) ORDINANCE NO. 690 (GOLF BALLS) - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, DECLARING IT UNLAWFUL FOR ANY PERSON TO DRIVE, HIT, OR OTHERWISE PLAY GOLF IN ANY CITY PARK OR UPON MUNICIPALLY -OWNED GROUNDS, EXCEPT IN AREAS CLEARLY DESIGNATED FOR THAT PURPOSE; PROVIDING A PENALTY FOR VIOLATION; HAVING A SAVINGS CLAUSE, A REPEALER CLAUSE, A SEVERABILITY CLAUSE; PROVIDING FOR CODIFICATION, PUBLICATION, AND AN EFFECTIVE DATE. Councilmember Richardson made a motion to remove Ordinance No. 690 from the table and also moved for the adoption of Ordinance No. 690 (Golf Balls). The motion was seconded by Councilmember Weber. The motion passed 5 to 0. REMOVE FROM TABLE ORDINANCE NO. 691 (MODEL AIRPLANE/MODEL ROCKETS) ORDINANCE NO. 691 (MODEL AIRPLANE/MODEL ROCKETS) - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, DECLARING IT UNLAWFUL FOR ANY PERSON TO OPERATE, FLY, GLIDE, OR OTHERWISE CONTROL A POWER -DRIVEN MODEL AIRPLANE OR MODEL ROCKET IN ANY CITY PARK OR UPON ANY MUNICIPALLY -OWNED GROUNDS, EXCEPT IN AREAS CLEARLY DESIGNATED FOR THAT PURPOSE; PROVIDING A PENALTY FOR VIOLATION; HAVING A SAVINGS CLAUSE, A REPEALER CLAUSE, A SEVERABILITY CLAUSE; PROVIDING FOR CODIFICATION, PUBLICATION, AND AN EFFECTIVE DATE. Councilmember Richardson made a motion to remove from the table Ordinance No. 690. Councilmember also moved for the adoption of ^' Ordinance No. 690 (Model Airplane/Model Rockets), seconded by Councilmember Cole. The motion passed 5 to 0. AWARD OF BID NO. B95-13 - ENTRYWAY SIGNAGE Assistant City Manager Richard Burdine noted that this item had been re -bid and competitive bids had been received the second time around. Mr. Burdine also noted that the responsible bid was submitted by D. L. Meacham Construction Company and recommended that Council award the bid to them in the amount of $18,205.00. M Councilmember Cole made a motion to award the bid for the entryway signage to D. L. Meacham Construction Company in the amount of $18,205.00. The motion was seconded by Councilmember Beckman. The motion passed 5 to 0. NEW BUSINESS ORDINANCE NO. 693 (MOBILE HOMES) - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TERAS, AMENDING ORDINANCE NO. 179, ARTICLE I. IN GENERAL, SECTION 17-1, DEFINITIONS, AND ORDINANCE NO. 164, SECTION 17-2, USE OF RESIDENCE RESTRICTED, OF CHAPTER 17 OF THE CITY OF PEARLAND CODE OF ORDINANCES, MOBILE HOMES, FOR THE PURPOSES OF ADDING AND CLARIFYING DEFINITIONS AND RESTRICTIONS, HAVING A SAVINGS CLAUSE, A REPEALER CLAUSE, AND A SEVERABILITY CLAUSE; PROVIDING FOR CODIFICATION, PUBLICATION, AND AN EFFECTIVE DATE. Councilmember Beckman made a motion to approve Ordinance No. 693 (Mobile Homes), seconded by Councilmember Richardson. City Attorney Amy McCullough explained that the ordinance needed additional revisions; specifically, the addition of a penalty clause. Therefore, she asked that this ordinance be tabled in order to allow time to make the necessary revisions. She also noted that there would be a change from the ordinance that the Council had in hand; namely, the extension of the effective date to be sixty (60) days, rather than ten (10) days in order to allow residents time to make provisions for complying with the ordinance once it is passed. 1. Jeff O'Brien - 3010 Country Club Drive - On behalf of the Green Tee Homeowners' Association, Mr. O'Brien noted that they are in support of the passage of this ordinance. He then thanked Amy McCullough for her research and hard work in producing this ordinance. Councilmember Beckman withdrew her motion to approve Ordinance No. 693, and Councilmember Richardson withdrew his second. Councilmember Richardson made a motion to table Ordinance No. 693, which was seconded by Councilmember Weber. Motion passed 5 to 0. AWARD OF BID NO. B95-11 - WASHINGTON IRVING DRIVE PAVEMENT RECONSTRUCTION. City Engineer John Hargrove recommended rejection of this bid and requested permission to re -bid this project. It was moved by Councilmember Weber, seconded by Councilmember Richardson that all bids for Bid No. B95-11 be rejected. Motion passed 5 to 0. RESOLUTION NO. R95-47, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TERAS, GRANTING, ON BEHALF OF THE CITY OF PEARLAND, A RIGHT-OF-WAY EASEMENT TO BRAZORIA COUNTY FOR PURPOSES OF CONSTRUCTING AND MAINTAINING A PUBLIC ROADWAY (BRIDGE) ON COUNTY ROAD 109 AT HICKORY SLOUGH. Councilmember Richardson moved that Resolution No. R95-47 be approved, seconded by Councilmember Weber. City Attorney Amy McCullough explained the need for this resolution which will allow Brazoria County and the City of Pearland to work together in constructing and maintaining the bridge on County Road 109 at Hickory Slough.
