ORDINANCE NO. 2000CUP -55 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, APPROVING A CONDITIONAL USE PERMIT FOR CERTAIN PROPERTY, BEING LOT TWENTY -FIVE (25), LOT TWENTY SIX (26), LOT TWENTY -SEVEN (27), LOT TWENTY -EIGHT (28), LOT TWENTY -NINE (29), LOT THIRTY (30), AND LOT THIRTY -ONE (31), BLOCK ONE (1), OF PEARLAND TOWNSITE, AN ADDITION IN BRAZORIA COUNTY, TEXAS, ACCORDING TO THE MAP OR PLAT THEREOF RECORDED IN VOLUME 29, PAGE 41, OF THE PLAT RECORDS OF BRAZORIA COUNTY, TEXAS LOCATED AT 2246 N. WASHINGTON, PEARLAND, TX (CONDITIONAL USE PERMIT APPLICATION NO. CUP 2011 -10), TO ALLOW THE OPERATION OF AN INSTITUTION OF RELIGIOUS, EDUCATIONAL, OR PHILANTHROPIC NATURE (ADULT READING CENTER), IN THE OLD TOWNSITE RESIDENTIAL (OTR) DISTRICT AT THE REQUEST OF MRS. DALE E. PILLOW, APPLICANT AND ADULT READING CENTER, INC., OWNER, CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS RELATED TO THE SUBJECT. WHEREAS Mrs. Dale E. Pillow, applicant, on behalf of Adult Reading Center, Inc., owner, filed an application for a Conditional Use Permit to allow the operation of an Institution of Religious, Educational, or Philanthropic Nature, on certain property, said property being legally described in the original applications for amendment attached hereto and made a part hereof for all purposes as Exhibit "A and more graphically depicted in the location map attached hereto and made a part hereof for all purposes as Exhibit "B and WHEREAS, on the 19 day of September 2011, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes as Exhibit "C said call and notice being in strict conformity with provisions of Section 1.2.2.2 of Ordinance No. 2000T; and ORDINANCE NO. 2000CUP -55 WHEREAS, on the 19 day of September, 2011, the Planning and Zoning Commission of the City submitted its report and recommendation to the City Council regarding the proposed Conditional Use Permit application for Mrs. Dale E. Pillow, applicant, on behalf of Adult Reading Center, Inc., owner, whereby the Commission recommended approval of the Conditional Use Permit, said recommendation attached hereto and made a part hereof for all purposes as Exhibit "D and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application and the recommendation of the Planning and Zoning Commission at regular meeting(s) on October 10, 2011 and October 24, 2011; and WHEREAS, the City Council, having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Mrs. Dale E. Pillow, applicant, on behalf of Adult Reading Center, Inc., owner, presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section I. The following described property located within the corporate limits of the City of Pearland, Texas, and presently classified as Old Townsite Residential (OTR), is hereby granted a Conditional Use Permit to allow for the operation of an Institution of Religious, Educational, or Philanthropic Nature in said zoning district; such property being more particularly described as: ORDINANCE NO. 2000CUP -55 Lot Twenty -five (25), lot Twenty -six (26), lot Twenty -seven (27), lot Twenty -eight (28), lot Twenty -nine (29), lot Thirty (30), and lot Thirty -one (31), Block One (1), of PEARLAND TOWNSITE, an addition in Brazoria County, Texas, according to the map or plat thereof recorded in Volume 29, Page 41, of the Plat Records of Brazoria County, Texas Located at 2246 N. Washington, Pearland, TX Section 11. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. Section 111. The City Council of the City of Pearland finds and determines that the approval herein granted promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. Section IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. Washington Avenue Pearland, TX 77581 Dear Dale, I am summarizing our discussion regarding the best zoning option for the Adult Reading Center in the following pages. The property is currently zoned (Old Townsite Residential (OT -R) zone that requires a Conditional Use (CUP) for the proposed use classified under Institution of Religious, Educational, or Philanthropic Nature. Since a CUP has not been approved for the use, it is currently non conforming. The property was zoned Neighborhood Services (NS) prior to its classification as OTS -R, during the adoption of the new zoning map in 2006. The current use is a permitted use under the NS zone. There are two options: a. Get the property re -zoned to prior classification of NS, or b. Apply for a CUP. The OTS zoning was created in 2006 to encourage development of new uses and expansion of existing uses in OTS. The OTS designation recognized that while the quadrant was predominately residential, a number of other uses existed in Old Townsite, thereby lending a desirable mixed use character. The OTS —R zone, that the North West quadrant of Old Townsite is zoned, allows uses permitted in an Office Professional (OP) district by CUP to ensure that the non residential uses are compatible and would not adversely affect the existing residential uses in the quadrant. The UDC states: The purpose of the Old Townsite District (OT) is to: (1) Promote good building and streetscape design. (5) Promote multiple types of development and uses, (6) Set forth general provisions and architectural regulations to ensure quality Of streetscape and building construction, (7) Allow reduced parking ratios, shared parking and flexibility to encourage re -use of existing buildings. (8) Allow flexibility in building codes and facade requirements to encourage relocation and re -use of existing buildings, (9) Emphasize mixed uses and focus on the atreetscape and public spaces to create pedestrian friendly mixed -use developments. Specifically, for this site, the OTS allows greater flexibility, as compared to other nonresidential zones (NS, OP, GB etc.) in the following manner: OTS zone allows reduction of required parking spaces by 50% for existing uses. The UDC states: Non residential uses in existing structures may be permitted to reduce by fifty percent (50 the number of parting spaces required by the UDC for that use. The number of parking spaces may be reduced even further as determined by a traffic report and approved by the City of Pearland. All new additions, and existing and now multi- family uses, shall meet the parking requirements in chapter 4 of the UDC, unless specified herein. 2. Unlike other zones, OTS allows sharedparking between properties within (500'), without the approval of a special exception by ZI3A. Any time the property expands in size, shared parking provision can be utilized without getting approvals from ZBA for each expansion. The UDC states; Shared parking between properties shall be permitted as long as the total number of parking spaces meets the requirements of subsection 2 above for each use and all parking spaces as required under subsection 2 above are located within five hundred (500) of the building. T.inlike other zones, OTS allows "head -on" parking from the street. This would permit the existing parking to continue, with cars backing into the street. The UDC states; Parking spaces or parking areas located within the Old Townsite may use adjoining public or private streets for maneuvering room, provided; a. No parking space encroaches upon any right -of -way, public or private; b. No parking space Is located closer than ten feet (10) to a ROW intersection; c, The design and construction of the parking spaces compiles with the standards found in Section 4,2.1.3; and 2 Sincerely, d. Due to these provisions, and examining the purpose of the OILS district and CUP, it seems that a CUP with th,; existing OTS -R zone would be beneficiary and appropriate for the site. Additionally, both zone change and CUP would need additional special exceptions to address existing non conformities, if any exist on site.
