AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING THE POWER OF EMINENT DOMAIN TO
ACQUIRE FEE SIMPLE TITLE TO CERTAIN PROPERTY, BEING A 1.162
ACRE PARCEL OF LAND, LOCATED IN THE DERRIL H. M. HUNTER
SURVEY, ABSTRCT NO. 36 AND THE TOMAS J. GREEN SURVEY,
ABSTRCT 290 OF HARRIS COUNTY, TEXAS, BEING A PORTION OF
LOT 1 OF SECTION G OF THE ALLISON RIVHEY GULF COAST HOME
COMPANY PART OF SUBURBAN GARDENS, A SUBDIVISION OF
RECORD IN VOLUME 4, PAGE 48, MAP RECORDS OF HARRIS
COUNTY, FOR THE CONSTRUCTION OF ROAD, DRAINAGE AND
UTILITY IMPROVEMENTS ON CERTAIN REAL PROPERTY DESCRIBED
HEREIN; AUTHORIZING THE CITY ATTORNEY, OR HIS DESIGNEE, AND
OTHER CITY OFFICIALS TO TAKE SUCH ACTIONS AS ARE
NECESSARY TO ACQUIRE SAID PROPERTY, LOCATED WITHIN THE
CITY, BY DONATION, PURCHASE, OR BY THE EXERCISE OF THE
POWER OF EMINENT DOMAIN.
WHEREAS, the City Council recognizes that a public convenience and necessity
exists for the location, construction, operation, and maintenance of road, drainage and
utility improvements on certain real property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the
public's best interest to acquire fee simple title to certain property for the construction of
road, drainage and utility improvements on said property; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public
convenience and necessity exists for the construction of road, drainage and utility
improvements on certain real property located in Harris County, Texas.
Section 2. The public convenience and necessity requires the acquisition of right
of -way, by donation, purchase, condemnation, or otherwise, of certain real property located
within the City and situated in Harris County, more particularly described in Exhibits "A" and
"B" attached hereto and incorporated herein for all purposes.
ORDINANCE NO. 1455
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to
acquire the property, described in Exhibits "A" and "B" and any improvements thereon,
either by donation, purchase or the exercise of the power of eminent domain.

(H.C,M,R.), said Lot 1 conveyed from John Alexander to John Alexander Family Limited Partnership

Official Public Records of Real Property of Harris County, Texas (H,C.O.P.R,R,P.) and being out of

Code Number 014095, H.C.M.R., same being the north corner of sald 0.6529 acre tract, said point
being on the common survey line of said Derril H. M. Hunter Survey, Abstract No. 36 and the
George McDougal Survey, Abstract No. 564 of said Harris County;
South 48° 25' 25" East, along the northerly line of said 0.0529 acre tract and the southerly line
of said Unrestricted Reserve "B" and along said common survey line, 129.28 feet to a 5/8 -inch
