RESOLUTION NO. R82-21 A RESOLUTION PROVIDING FOR THE APPROVAL OF THE AGREE- MENT DATED MAY 24, 1982, BETWEEN THE STATE OF TEXAS AND THE CITY OF PEARLAND, FOR THE INSTALLATION, CON- STRUCTION, EXISTENCE, USE, OPERATION, AND MAINTENANCE OF HIGHWAY SIGNAL PROJECT AT THE LOCATION SHOWN ON EXHIBIT 1, ATTACHED HERETO AND MADE A PART HEREOF, IN THE CITY OF PEARLAND; PROVIDING FOR THE EXECUTION OF SAID AGREEMENT; AND DECLARING AN EMERGENCY. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1. That the certain agreement dated May 24, 1982 between the State of Texas and the City of Pearland, for the installation, con- struction, existence, use, operation, and maintenance of certain high- way traffic signal at the location shown on EXHIBIT 1, attached hereto and made a part hereof, in the City of Pearland, be and the same is hereby approved, and Tom Reid is hereby authorized to execute said agree- ment on behalf of the City of Pearland, and to transmit the same to the State of Texas for appropriate action. SECTION 2. That this Resolution shall take effect on and after its passage on first and only reading this 24th day of May, A. D., 1982. PASSED, APPROVED and ADOPTED this 24th day of May, A. D., 1982. WITNESSETH WHEREAS, the City has authorized the installation, operation, and maintenance • Resolution of highway traffic signal( by Oxamaaaa 400410dokR, passed on the 24th clay of May , 19 82 , at the location) shown on EXHIBIT 1, attached hereto and made a part hereof; AGREEMENT NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed, as hereinafter set forth, it is agreed as follows: 1. The State will furnish the nececssary funds for the actual construction, prepare plans and specifications, install said highway traffic signal(R), supervise construction, and upon completion of construction, will furnish the power and operate and maintain said highway traffic signal(R). 2. The City hereby consents to the construction of the highway traffic signal() shown on EXHIBIT 1, by the approval of the location and mann-r of construction as shown on the plans and described in the specifications. AGREEMENT (TRAFFIC SIGNAL - TYPE 1A) • 2-82 1-4 I Y 3. The City will exercise no cdhtrol whatsoever over the operation, maintenance, use, or existence of the highway traffic signal(R) without written authority from the State Department of Highways and Public Transportation. 4. The State shall have the authority to make such changes in the design and operation of the highway traffic signal( as it may deem necessary and advisable to promote the safe, convenient, and orderly movement of traffic. 5. The City will be responsible for the police enforcement required for securing obedience to the highway traffic signal(sx). 6. In the event the signal() installed in accordance with this Agreement become unnecessary or are removed for any reason, this agreement shall terminate. 7. Indemnification The City agrees to indemnify the State against any and all damages and claims for damages to adjoining, abutting or other property for which the State is or may be liable arising out of, incident to or in any way connected with the installation, the construction, the existence, the use of such project and does hereby agree to indemnify the State against any and all court costs, attorneys' fees and all expenses in connection with suits for such damage and shall, if requested to do so in writing, assist or relieve the State from defending any such suits brought against it. Nothing in this agreement shall be construed to place any liability on the City for personal injury arising out of the construction of such project. Furthermore, it is not the intent of this agreement to impose upon the City the liability for injury to person or property arising out of the construction of the project by the State's contractor unless the State itself would be liable for such injury or damage. AGREEMENT (TRAFFIC SIGNAL - TYPE 1A) 2-82 2-4 Z/ Nothing herein contained shalt be 'construed to place upon the State any manner of liability for injury to or death of persons or for damage to or oss of property arising out of or in any manner connected with the use of the project, and the City will save the State harmless from any damages arising from said main- tenance and/or use of said project. It is further understood and agreed between the parties hereto that the 1 improvement of the project by the State is for the sole purpose of providing the • travelling public a more adequate travel facility and shall never be the basis of any claim for State assumption, or participation in the payment, of any of the obligations of the City incurred in the improvement, past or present, of any street project. 8. Contractors shall furnish a copy of a certification from the manufacturer of the lights that the warning lights meet the requirements of the ITE Standard for Flashing and Steady Burn Warning Lights as contained in the lastest edition of the "Texas Manual on Uniform Traffic Control Devices for Streets and Highways" All signs shown have black letters and borders on a reflective orange back- ground except the R20-3, R4-7b, R4-8b, and G20-6 signs which have a reflective white background Signs erected on portable supports for use on construction projects normally mean signs which are used during the day to warn or guide traffic through and/or around the actual construction area, but at the end of the workday such signs are either removed or turned away from the view of traffic. Porta- ble supports shall be as shown on this sheet or as approved by the Engineer. The bottom of the sign shall be a minimum of one (1) foot above the pave- ment edge. Signs required for nighttime usage should not normally be mounted on portable supports, except when approved by the Engineer Signs erected on fixed supports for use on construction projects normally mean signs that are to remain in place for both day and night usage to regu- late, warn and guide traffic in advance of and within the limits of the project including the crossroad approaches. However, under certain conditions, such as where a sign may be required for a few days duration and then is no longer needed or where a sign is moved from location to location every few days or where it is not practical or desirable to provide a fixed mounting, such signs may be erected on a temporary type of support. Temporary supports shall be as shown on this sheet or as approved by the Engineer. Signs erected on tem- porary supports should be at a minimum height of three (3) feet. Signs erected on fixed supports should be at a minimum height of five (5) feet in rural areas and seven (7) feet in urban areas and other rural locations where sight distance obstructions are present. Regardless of the type of support used, regulatory signs should not be erected at height less than the 5 or 7 foot minimum specified above unless a lower height is approved by the Engineer. Posts for fixed supports should be set in the ground without con- crete footings. Where portable or temporary supports require the use of weights to keep a sign or barricade from turning over, the use of some type of sandbag is recommended. The use of pieces of concrete, rocks, iron, steel or other solid objects will not be permitted.
