A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE
A CONTRACT BY AND BETWEEN THE CITY OF PEARLAND
AND CALAME, LINBARGER & GRAHAM.
BE IT RESOLVED by the City Council of the City of Pear-
land, Texas that the Mayor be, and he is hereby authorized to
execute for and in behalf of the City, a Contract by and between
the City of Pearland and Calame, Linbarger & Graham for the pur-
pose of delinquent tax collection.

CONTRACT FOR THE COLLECTION OF DELINQUENT TAXES
THE STATE OF TEXAS ) (

This contract is made and entered into by and between the CITY OF
PEARLAND , acting herein by and through its governing body, hereinafter
styled First Party, and the law firm of CALAME, LINEBARGER & GRAHAM, 5432
South I . H. 35, Austin, Texas , hereinafter styled Second Party.
I •
First Party agrees to employ and does hereby employ Second Party to
enforce by suit orthe collection of all delinquent taxes ,
penalty and interest owing to First Party; provided , however, that
current year taxes falling delinquent within the period of this contract
shall become subject to its terms on the first day of July in the year in
which the taxes become delinquent .

Second Party is to call to the attention of the collector or of er
officials any errors , double assessments or other discrepancies comi g
under its observation during the progress of the work, and is to
intervene on behalf of First Party in all suits for taxes hereafter iled
by any taxing unit on property located within its corporate limits .

First Party agrees to pay to Second Party as compensation for the
services required hereunder fifteen (15) percent of the amount collected
of all delinquent taxes , penalty and interest for the years covered by
this contract , actually collected and paid to the collector of taxes
during the term of this contract , as and when collected . All
compensation above provided for shall become the property of Second Party
at the time payment of the taxes , penalty and interest is made to the
collector. The collector shall pay over said funds monthly by check.
Iv
This contract is drawn to cover a period of two years , beginning . •
March 1 , 1982 and ending February 28, 1984, provided, however, this
agreement may be terminated by First Party by the giving of thirty (30)
days written notice thereof to Second Party. Second Party shall have six
months following termination of the contract to reduce to judgment all
suits filed prior thereto . In consideration of the terms and
compensation herein stated , Second Party hereby accepts said employment
and undertakes the performance of said contract as above written.
This contract is executed on behalf of First Party by the presiding
officer of its governing body who is authorized to execute this
instrument by order heretofore passed and duly recorded in its minutes .
WITNESS the signatures of all parties hereto in duplicate originals

the Mayor of this City at the City Hall , 2335 N . Texas Avenue , Pear-
land, Texas , on or before 30 days before the date of said election .
The earliest day for filing applications shall be 30 days before the
deadline for filing.
That all candidates for the Regular Election shall file with
said applications the loyalty affidavit required by Article 6 . 02 of
the Texas Election Code .
That the City Secretary of the City shall , in accordance
with the terms and provisions of Article 13. 32 .of the Texas Election
Code , post in her office the names of all independent candidates who
have filed their applications in accordance with the terms and pro-
visions of this Resolution and Order, and said names shall be posted
at a conspicuous place in said office for at least 10 days before
said Secretary orders the same to be printed on the Official Ballot
for said election . The order in which the names of the candidates
are to be printed on the ballot shall be determined by a drawing by
the City Secretary as provided by Article 6 . 05 (c) , Subdivision 3 of
the Texas Election Code .
The City Secretary is hereby authorized and instructed to
provide and furnish all necessary election supplies to conduct said
election .
Notice of appointment of Presiding Judge of election shall
be in accordance with Section 3 . 09 of the Election.- Code .
