A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING A CONTRACT FOR ENGINEERING DESIGN
SERVICES ASSOCIATED WITH THE BELLAVITA WATERLINE INTER-
CONNECT PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract for engineering design services associated with
the Bellavita Waterline Inter - connect Project, a copy of which is attached hereto as Exhibit
"A" and made a part hereof for all purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest a contract for engineering design services associated with
the Bellavita Waterline Inter - connect Project.

CONTRACT FOR PROFESSIONAL SERVICES
THIS CONTRACT is entered into on j 1- 1a t a011 , by and between the City of
'Pearland ( "CITY ") and Freese and Nichols, In. ( "CONSULTANT ").
The CITY engages the CONSULTANT to perform professional services for a project known and
described as Bellavita Water Line Inter - Connect ( "PROJECT "). (Project # WA0809)
SECTION I - SERVICES OF THE CONSULTANT
The CONSULTANT shall perform the following professional services to CITY standards and in
accordance with the degree of care and skill that a professional in Texas would exercise under
the same or similar circumstances:
A. The CONSULTANT shall provide professional design engineering services as
described herein. See Exhibit A, attached, for a detailed SCOPE OF WORK and
PROJECT schedule. The PROJECT schedule shall be submitted in digital and
hard copy form in the Microsoft Project for Windows format.
B. The CONSULTANT shall prepare and submit a detailed opinion of estimated cost
of the PROJECT.
C. The CONSULTANT acknowledges that the CITY (through its employee
handbook) considers the following to be misconduct that is grounds for
termination of a CITY employee: Any fraud, forgery, misappropriation of funds,
receiving payment for services not performed or for hours not worked,
mishandling or untruthful reporting of money transactions, destruction of assets,
embezzlement, accepting materials of value from vendors, or consultants, and/or
collecting reimbursement of expenses made for the benefit of the CITY. The
CONSULTANT agrees that it will not, directly or indirectly; encourage a CITY
employee to engage in such misconduct.
D. The CONSULTANT shall submit all final construction documents in both hard
copy and electronic format. Plans shall be AutoCAD compatible and all other
documents shall be Microsoft Office compatible. The software version used shall
be compatible to current CITY standards. Other support documents, for example,
structural calculations, drainage reports and geotechnical reports, shall be
submitted in hard copy only. All Record Drawings electronic files shall be
submitted to the CITY in TIF format.
E. The CONSULTANT recognizes that all drawings, special provisions, field survey
notes, reports, estimates and any and all other documents or work product
generated by the CONSULTANT under the CONTRACT shall be delivered to the
CITY upon request, shall become subject to the Open Records Laws of this State.

F. The CONSULTANT shall procure and maintain for the duration of this
Agreement, insurance against claims for injuries to persons, damages to property,
or any errors and omissions relating to the performance of any work by the
CONSULTANT, its agents, employees or subcontractors under this Agreement,
as follows:
(1) Workers' Compensation as required by law.
(2) Professional Liability Insurance in an amount not less than $1,000,000 in
the aggregate.
(3) Comprehensive General Liability and Property Damage Insurance with
minimum limits of $1,000,000 for injury or death of any one person,
$1,000,000 for each occurrence, and $1,000,000 for each occurrence of
damage to or destruction of property.
(4) Comprehensive Automobile and Truck Liability Insurance covering
owned, hired, and non -owned vehicles, with minimum limits of
$1,000,000 for injury or death of any one person, $1,000,000 for each
occurrence, and $1,000,000 for property damage.
The CONSULTANT shall include the CITY as an additional insured under the
policies, with the exception of the Professional Liability Insurance and Workers'
Compensation. Certificates of Insurance and endorsements shall be furnished to
the CITY before work commences. Each insurance policy shall be endorsed to
state that coverage shall not be suspended, voided, canceled, and /or reduced in
coverage or in limits ( "Change in Coverage ") except with prior written consent of
the CITY and only after the CITY has been provided with written notice of such
Change in Coverage, such notice to be sent to the CITY either by hand delivery to
the City Manager or by certified mail, return receipt requested, and received by
the City no fewer than thirty (30) days prior to the effective date of such Change
in Coverage. Prior to commencing services under this CONTRACT,
CONSULTANT shall furnish CITY with Certificates of Insurance, or formal
endorsements as required by this CONTRACT, issued by CONSULTANT'S
insurer(s), as evidence that policies providing the required coverage, conditions,
and limits required by this CONTRACT are in full force and effect.

G. The CONSULTANT shall indemnify and hold the CITY, its officers, agents, and
employees, harmless from any claim, loss, damage, suit, and liability of every
kind for which CONSULTANT is legally liable, including all expenses of
litigation, court costs, and attorney's fees, for injury to or death of any person, for
damage to any property, or errors in design, any of which are caused by the
negligent act or omission of the CONSULTANT, his officers, employees, agents,
or subcontractors under this CONTRACT.
H. All parties intend that the CONSULTANT, in performing services pursuant to this
CONTRACT, shall act as an independent contractor and shall have control of its
own work and the manner in which it is performed. The CONSULTANT is not to
be considered an agent or employee of the CITY.
SECTION I1 - PERIOD OF SERVICE
This CONTRACT will be binding upon execution and end upon completion of construction.
SECTION III - CONSULTANT'S COMPENSATION
A. The method of payment for this CONTRACT is payment by installments. Total
compensation for the services performed shall not exceed $143,790.00.
B. The CITY shall pay the CONSULTANT in installments based upon monthly
progress reports and detailed invoices submitted by the CONSULTANT subject
to the following limitations:
1. Prior to approval of the final design documents, payments to the
CONSULTANTS shall not exceed 60% of the total CONTRACT amount.
The final approval and payment will be made within a reasonable period
of time regardless of the project construction schedule.
2. If the scope of work of this CONTRACT includes the preparation of
studies, design concepts, or other investigations, progress payments shall
not exceed 90% of the total CONTRACT amount prior to submittal of the
final report deliverables.
B. The CITY shall make payments to the CONSULTANT within thirty (30) days
after receipt and approval of a detailed invoice. Invoices shall be submitted on a
monthly basis.

SECTION IV - THE CITY'S RESPONSIBILITIES
A. The CITY shall designate a project manager during the term of this CONTRACT.
The project manager has the authority to administer this CONTRACT and shall
monitor compliance with all terms and conditions stated herein. All requests for
information from or a decision by the CITY on any aspect of the work shall be
directed to the project manager.
B. The CITY shall review submittals by the CONSULTANT and provide prompt
response to questions and rendering of decisions pertaining thereto, to minimize
delay in the progress of the CONSULTANT'S work. The CITY will keep the
CONSULTANT advised concerning the progress of the CITY'S review of the
work. The CONSULTANT agrees that the CITY'S inspection, review, acceptance
or approval of CONSULTANT'S work shall not relieve CONSULTANT'S
responsibility for errors or omissions of the CONSULTANT or its sub -
consultant(s) or in any way affect the CONSULTANT'S status as an independent
contractor of the CITY.
SECTION V - TERMINATION
A. The CITY, at its sole discretion, may terminate this CONTRACT for any reason -
with or without cause -- by delivering written notice to CONSULTANT
personally or by certified mail at Freese & Nichols, Inc., 11200 Broadway St.
#2332, Pearland, TX 77584. Immediately after receiving such written notice, the
CONSULTANT shall discontinue providing the services under this CONTRACT.
B. If this CONTRACT is terminated, CONSULTANT shall deliver to the CITY all
drawings, special provisions, field survey notes, reports, estimates and any and all
other documents or work product generated by the CONSULTANT under the
CONTRACT, entirely or partially completed, together with all unused materials
supplied by the CITY on or before the 15 day following termination of the
CONTRACT.
C. In the event of such termination, the CONSULTANT shall be paid for services
performed prior to receipt of the written notice of termination. The CITY shall
make final payment within sixty (60) days after the CONSULTANT has delivered
to the CITY a detailed invoice for services rendered and the documents or work
product generated by the CONSULTANT under the CONTRACT.
D. If the remuneration scheduled under this contract is based upon a fixed fee or
definitely ascertainable sum, the portion of such sum payable shall be
proportionate to the percentage of services completed by the CONSULTANT
based upon the scope of work.

E. In the event this CONTRACT is terminated, the CITY shall have the option of
completing the work, or entering into a CONTRACT with another party for the
completion of the work.
F. If the CITY terminates this CONTRACT for cause and/or if the CONTRACTOR
breaches any provision of this CONTRACT, then the CITY shall have all rights
and remedies in law and /or equity against CONSULTANT. Venue for any action
or dispute arising out of or relating to this CONTRACT shall be in Brazoria
County, Texas. The laws of the State of Texas shall govern the terms of this
CONTRACT. The prevailing party in the action shall be entitled to recover its
actual damages with interest, attorney's fees, costs and expenses incurred in
connection with the dispute and /or action. CONSULTANT and CITY desire an
expeditious means to resolve any disputes that may arise between under this
CONTRACT. To accomplish this, the parties agree to mediation as follows: If a
dispute arises out of or relates to this CONTRACT, or the breach thereof, and if
the dispute cannot be settled through negotiation, then the parties agree first to try
in good faith, and before pursuing any legal remedies, to settle the dispute by
mediation of a third party who will be selected by agreement of the parties.
SECTION VI — ENTIRE AGREEMENT
This CONTRACT represents the entire agreement between the CITY and the CONSULTANT
and supersedes all prior negotiations, representations, or contracts, either written or oral. This
CONTRACT may be amended only by written instrument signed by both parties.
SECTION VII — COVENANT AGAINST CONTINGENT FEES
The CONSULTANT affirms that he has not employed or retained any company or person, other
than a bona fide employee working for the CONSULTANT to solicit or secure this
CONTRACT, and that he has not paid or agreed to pay any company or person, other than a
bona fide employee, any fee, commission, percentage brokerage fee, gift, or any other
consideration, contingent upon or resulting from the award or making of the CONTRACT. For
breach or violation of this clause, the CITY may terminate this CONTRACT without liability,
and in its discretion, may deduct from the CONTRACT price or consideration, or otherwise
recover, the full amount of such fee, commission, percentage brokerage fee, gift, or contingent
fee that has been paid.

SECTION VIII- SUCCESSORS AND ASSIGNS
This CONTRACT shall not be assignable except upon the written consent of the parties hereto.

In response to your comments received on July 20, 2011 and subsequent phone conversations,
we are pleased to submit this revised proposal for providing professional engineering services
to the City of Pearland for the Bellavita Water Line Inter - Connect project.
Freese and Nichols (FNI) will render professional services in connection with the development
of the Project as defined in Exhibit A, Utilities Scope of Service for Bellavita Water Line Inter -
Connect and the Supplemental Scope of Services with Attachments.
FNI proposes to furnish our services as described herein in accordance with Attachment CO,
"Compensation ". The total fee shall be computed on the basis of Attachment CO but shall be a
not -to- exceed fee of one hundred forty -three thousand seven hundred ninety dollars
($143,790).

BASIC SERVICES: The Consultant shall render the following professional
engineering services to the OWNER in connection with the construction of the
Project.
Preliminary Design Phase Services (NOT APPLICABLE)

SUPPLEMENTAL SCOPE OF SERVICES
ARTICLE I
BASIC SERVICES: Freese and Nichols, Inc. (FNI) shall render the following professional services in
connection with the development of the Project described as: Bellavita Water Line Inter - Connect. Project
limits are: 1) a 12 -inch Water Line, approximately 3,600 feet long, identified as Alternative Route B in the
Bellavita Water Line Route Study Technical Memorandum submitted by FNI, 2) a connection to the existing 8-
inch water line at the intersection of Romero Dr. and San Conero Dr. in Villa D'Este subdivision, and 2) a fl-
inch Force Main to be installed parallel to the proposed water line beginning at the Longwood WWTP on Dixie
Farm Road, continuing for a distance of approximately 1,500 feet and terminating at a location to be
coordinated between the City and Harris County.
A. DESIGN PHASE SERVICES
Based on previously approved Water Line Route Study and authorization from the CITY, FNI shall
provide professional services in this phase as follows:
a) Prepare Construction Plans and Specifications
i. Attend a Design Phase kick -off meeting with the CITY.
ii. Conduct design related site visits.
iii. Attend up to five (5) progress meetings throughout the design phase to report progress and
discuss and resolve final design issues.
iv. Prepare construction plans including cover sheet, layout sheets, horizontal and vertical control
sheets, detailed plan /profile sheets to 1"=20' (H) and l"=2' (V) scale, connection to existing
facilities, cased and uncased bores, details, gathering of standard details, and other associated
drawings.
a. Submit five (5) sets (1 full size + 4 half size) of 60 %- complete plans to the CITY for
review and comments. Attend meeting to discuss comments. FNI will provide a
response to CITY's comments in writing.
b. Upon receipt of 60 %- complete comments, continue further development of construction
plans and details to 90% level.
c. Submit five (5) sets (1 full size + 4 half size) of 90 %- complete plans, technical
specification and contract documents to the CITY for review and comments. Attend
meeting to discuss continents. FNI will provide a response to CITY's comments in
writing.
d. Upon final approval by the CITY, FNI will provide CITY five (5) sets of "Final" plans
and construction documents. In addition, FNI will provide the CITY with pdf copies of
the plans and specifications on a CD.
v. Prepare stormwater pollution preventions plans and details for the Project.
vi. Assemble TxDOT project related standard traffic control sheets to be included in the plans.
vii. FNI will perform a structural evaluation of the existing bridge located along Dixie Farm Road
at Clear Creek. Create necessary details to connect the proposed 12 -inch water line and fl-
inch force main to the existing bridge once the evaluation determines this is possible.
viii. Coordination with Harris County Flood Control District, BDD#4, and Pipeline Companies, as
necessary to facilitate design and construction.

B. BID PHASE SERVICES
Upon authorization from the CITY, FNI will proceed with the performance of services in this phase as
indicated in Exhibit A, "Utilities Scope of Services for Bellavita Water Line Inter - Connect."
C. CONSTRUCTION PHASE SERVICES
Upon separate Authorization from the CITY, and upon completion of the bid phase services, FNI will
proceed with the performance of construction phase services as described Exhibit A, "Utilities Scope
of Services for Bellavita Water Line Inter - Connect." FNI will endeavor to protect CITY in providing
these services however, it is understood that FNI does not guarantee the Contractor's performance, nor
is FNI responsible for supervision of the Contractor's operation and employees. FNI shall not be
responsible for the means, methods, techniques, sequences or procedures of construction selected by
the Contractor, or any safety precautions and programs relating in any way to the condition of the
premises, the work of the Contractor or any Subcontractor. FNI shall not be responsible for the acts or
omissions of any person (except its own employees or agents) at the Project site or otherwise
performing any of the work of the Project.
D. ADDITIONAL SERVICES
1. Conduct Phase 1 Environmental Site Assessment for the proposed route of the Project. This
service will be performed by FNI. See Attachment 1 for detailed scope.
2. Conduct Environmental Permitting Evaluation and Wetland Delineation for the proposed route of
the Project. This service will be performed by FNI. See Attachment 2 for detailed scope (Tasks 1
thru 4).
3. Prepare an Environmental PCN for the proposed route of the Project. This service will be
performed by FNI. See Attachment 2 for detailed scope (Task 5). (Separate Authorization)
E. SPECIAL SERVICES
Upon authorization from the CITY, FNI provide the following Special Services:
1. Conduct topographical field survey, mapping, necessary boundary and preparation of parcel taking
descriptions for right -of -ways /easements for the Project. See Attachment 3 for detailed scope
from sub - consultant.
2. Conduct geotechnical investigation for the Project consisting of 6 borings of which 4 will be 20'
deep and 2 will be 10' deep. See attachment 4 for detailed scope from sub - consultant.
3. Reimbursable project expenses such as printing, deliveries, mileage, outside printing of plans and
construction document for all phases of Project.
ARTICLE II
ADDITIONAL SERVICES: Services that are not specifically listed in above Supplemental Scope of
Services or Attachments shall be considered as Additional Services to be performed by FNI, if authorized by
CITY and will be paid for as stated in the Compensation Attachment, Item D.2.

ARTICLE III
TIME OF COMPLETION: FNI is authorized to commence work on the Project upon execution of this
AGREEMENT and agrees to complete the services in accordance with the following schedule:
1. Design Phase: Upon authorization by the CITY, FNI shall proceed with performance of
professional services defined as Design Phase, to submit Final plans and construction document
within 120 calendar days after date of authorization. Approval period by the CITY and other
agencies have not be accounted for.
2. Bid & Construction Phases: Upon authorization by the CITY, FNI shall proceed with
performance of professional services defined Bid and Construction Phases until completion of the
Project.
If FNI's services are delayed through no fault of FNI, FNI shall be entitled to adjust contract schedule
consistent with the number of days of delay. These delays may include but are not limited to delays in CITY or
regulatory reviews, delays on the flow of information to be provided to FNI, governmental approvals, etc.
ARTICLE IV
RESPONSIBILITIES OF CITY: CITY shall perform the following in a timely manner so as not to delay the
services of FNI:
A. Designate a person to act as C1TY's representative with respect to the services to be rendered. Such
person shall have contract authority to transmit instructions, receive information, interpret and define
CITY's policies and decisions with respect to FNI's services for the Project.
B. Provide all criteria and full information as to CITY's requirements for the Project, including design
objectives and constraints, space, capacity and performance requirements, flexibility and
expandability, and any budgetary limitations; and furnish copies of all design and construction
standards which CITY will require to be included in the drawings and specifications.
C. Assist FNI by placing at FNI's disposal all available information pertinent to the Project including
previous reports and any other data relative to design or construction of the Project.
D. Arrange for access to and make all provisions for FNI to enter upon public and private property as
required for FNI to perform services.
E. Attend the pre -bid conference, bid opening, preconstruction conferences, construction progress and
other job related meetings and substantial completion inspections and final payment inspections.
F. Give prompt written notice to FNI whenever CITY observes or otherwise becomes aware of any
development that affects the scope or timing of FNI's services, or any defect or nonconformance of the
work of any Contractor.

ARTICLE V

D. COMPENSATION TERMS
1. "Sub- Consultant Expense" is defined as the expense that is incurred by FNI in employment of others
in outside firms for services in the nature of foundation borings, testing, surveying, process design
and similar services that are not included in the Basic Services.

2. "Direct Non -Labor Expense" is defined as that expense for any assignment incurred by FNI for
supplies, transportation and equipment, travel, communications, subsistence and lodging away from
home and similar incidentals in connection with that assignment.
E. BASIC SERVICES:
1. Upon authorization from the CITY, FNI shall proceed with the services outlined in each phase of the
project. For the purposes of preparing monthly statements, FNI shall submit to the CITY payment
requests in proportion to that part of the service which has been accomplished as evidenced by
monthly statements. Final payment shall be due upon the completion of defined services.
2. If other Additional Services are required and authorized by the CITY, FNI shall be compensated as
follows:
a. Where the services of individuals are supplied by FNI, as authorized by CITY, payment for these
services will be based on Hourly Rate Schedule attached.
b. Services for direct non -labor expense and sub - contract expense provided by FNI shall be
reimbursed at actual cost times a multiplier of 10 %.

PHASE I ENVIRONMENTAL SITE ASSESSMENT
SCOPE OF WORK
The following Scope of Services describes tasks and responsibilities for Freese and Nichols, Inc.
to conduct a Phase I Environmental Site Assessment (ESA) for the proposed City of Pearland
Bellavita Waterline project, which includes the installation of approximately 3,600 linear feet of
I 2-inch waterline inter- connect between Dixie Farm Road and Bellavita Subdivision.
A Phase 1 ESA is a preliminary evaluation of the potential for chemical contamination which
involves the review of historical land use records for the site, a site visit, and interviews with
property owners and tenants. It does not involve the collection and analysis of samples from
soils, groundwater, or other environmental media. If a Phase I ESA identifies a significant
potential for the occurrence of environmental concerns, then a Phase II ESA is typically
recommended to verify the presence or absence of chemical contamination.
PHASE I ESA SERVICES:
This Phase 1 ESA will be conducted based on standards published by the Environmental
Protection Agency All Appropriate Inquiries (AAI) Final Rule and ASTM International (ASTM)
under Standard Guideline E1527 -05, "Standard Practice for Environmental Site Assessments:
Phase I Environmental Site Assessment Process."
As a note, a Phase I ESA can reduce, but not eliminate, the level of risk for unidentified
environmental contamination. No Phase I ESA can guarantee the absence of contamination.
Only sampling and analysis can confine the presence or absence of chemical contamination at a
site. Sampling and analysis are beyond the Scope of Services for this Phase I ESA. Additionally,
this Phase I ESA does not include an investigation or survey for the presence of mold or
asbestos.
In the absence of any standards, the opinions and conclusions found in the Phase I ESA will be
based on caution and conservatism by an experienced professional. Environmental regulations
are continually changing, and a site determined to be uncontaminated based on current
regulations and/or technical standards could be considered a contaminated site in the future
based on new or amended regulations or standards.
Freese and Nichols shall render the following professional services in connection with
completion of the Phase I ESA:
1. Historical Land Use Review
Perform an investigation into prior ownership and past land uses on the subject property.
Freese and Nichols will attempt to identify obvious uses of the subject property from the
present back to the property's first developed use, or back to 1950, whichever is earlier.
To accomplish this task, Freese and Nichols will review the following records (if
available):
a. Interviews with City representatives and property owners /tenants.
b. Historical aerial photography.
c. City directory abstracts.
d. Sanborn fire insurance maps.
e. Recorded environmental easements or liens on the subject property.
2. Regulatory Agency Records Review
Freese and Nichols will review information found in federal and state regulatory records
for the subject property, including records related to environmental- related permits,
notices -of- violation, and incidents involving use, disposal, or accidental release of
hazardous substances, petroleum products, or other waste materials. Local records, if
available, related to the subject property will also be reviewed for indications of
environmental concern.
3. Site Reconnaissance Visit
Freese and Nichols will perform a site reconnaissance visit to the subject property.
Existing environmental conditions will be documented on the site. Freese and Nichols
will look for potential indicators of environmental concerns such as stained soils or other
surfaces, stressed vegetation, exposed piping, and evidence of improper use or disposal of
regulated substances. Freese and Nichols will document the condition of each property
using photographs. Copies of photographs will be included in the report.
4. Report Preparation
Following the completion of Tasks 1 through 3, a report will be prepared for the subject
property documenting our findings. The report will contain a narrative of our findings,
recommendations for additional environmental investigations, as needed, and copies of
all data obtained relevant to each subject property. The report will contain appropriate
maps, figures, and photographs.
ADDITIONAL ENVIRONMENTAL SERVICES:
Additional services to be performed by Freese and Nichols, if authorized by the CLIENT, which
are not included in the above described basic Phase I ESA services, may include the following.
Other tasks may be necessary which are not included in this list:
A. Preparation of a Phase II ESA. If a Phase I ESA identifies a significant potential for
environmental concerns, then a Phase II ESA is typically recommended to verify the
presence or absence and the extent of contamination. Phase I1 ESAs involve a limited
site investigation involving sampling of environmental media and analysis for suspected
chemicals of concern (COCs). If contamination is confirmed at a subject property, there
are multiple options available through the Texas Commission on Environmental Quality
(TCEQ) to further investigate and address any environmental concerns found.
B. Review of files at Texas Commission on Environmental Quality (TCEQ) or U.S.
Environmental Protection Agency (EPA) offices. If a record of a potential
environmental concern is found on the subject property or an adjacent site, additional
information and actual reports regarding site conditions can often be found in public
records maintained by regulatory agencies. These detailed records are not available in
the general review of databases maintained by regulatory agencies.
C. Meetings with the CLIENT or their designated representatives.
RESPONSIBILITIES OF THE CLIENT:
A. Obtain access to the properties /proposed right -of -way for Freese and Nichols to conduct
site visit.
B. Provide Freese and Nichols with access to any environmental records or other
information possessed by the Client regarding the subject property, including but not
limited to permits, confirmation sampling results, hazardous substance inventories,
disposal records, records of spills or complaints, etc.

Scope of Services for an Environmental Permitting Evaluation
for the
City of Pearland
Bellavita Water Line Project
SCOPE OF SERVICES
The City of Pearland (City) proposes to construct the Bellavita Water Line Project from
southeast of Dixie Farm Road to the vicinity of North Rivera Circle in Pearland, Texas.
The water line will include at least one crossing of waters of the U.S.; therefore,
construction will likely require Section 404 permit authorization. Nationwide Permit
(NWP) 12 authorizes utility lines, which applies to the Bellavita Water Line Project, as
long as certain conditions associated with NWP 12 and NWPs in general are met.
This scope is to delineate wetlands and other waters of the US in the project area to
determine whether the project can be constructed under NWP 12 and, if so, whether the
submittal of a Preconstruction Notification (PCN) to the U. S. Army Corps of Engineers
(USACE) is required. If the proposed project can be designed and constructed without
the preparation of a PCN, the reasons supporting this decision would be documented. If
it is determined that the proposed project cannot meet NWP terms and conditions without
requiring a PCN, the preparation of a preliminary jurisdictional determination report
(PJD) and PCN for submittal to the USACE would be prepared upon client's
authorization. FNI proposes the following scope of services to address these
requirements.
To assess whether the requirements under NWP 12 can be met for the development of the
Bellavita Water Line Project without submitting a Pre - Construction Notification (PCN)
to the U.S. Army Corps of Engineers (COE), and whether there are any issues to be
further addressed, Freese and Nichols, Inc. (FNI) proposes the following scope of
services:
Task 1. Compile Information
FNI will assemble data such as aerial photos, ROW limits, and project limits in digital
format for the site visit and create a data dictionary for the GPS data logger for data
collection.
Task 2. Site Visit/Wetland Delineation.
FNI environmental scientists will conduct a site visit to delineate and document existing
wetlands and other waters of the US in the project area and assess project impacts along
the proposed water line. The presence and general locations of waters of the U.S.,
including potential wetlands; potential threatened /endangered species habitat; and
vegetation cover types will be identified in the proposed ROW and adjacent areas.
Task 3. Prepare Wetland Delineation Report/Preliminary Jurisdictional
Determination (PJD)
FNI will prepare a PJD documenting the results of the field study. The PJD will include
the results of the wetland delineation. This report would be submitted to the USACE only
if it is determined that a PCN is required and would be part of the PCN submittal. If a
PCN is not required, the PJD report would be submitted to the client as documentation
supporting the decision not to submit a PCN. The document would be submitted to the
City for review prior to submittal to the USACE. Note: only the USACE can make the
final determination regarding the jurisdictional status of a water body.
Task 4. Meet with City
FNI environmental scientists will attend one meeting with the City to discuss the project,
the City's comments, and the environmental permitting process.
Task 5. Prepare Preconstruction Notification — PCN (Optional Task)
If the results of the Wetland Delineation and PJD indicate that the proposed project
requires authorization under Section 404 of the Clean Water Act and that a PCN is
required to be submitted to the USACE, FNI will, with the client's approval, prepare the
PCN for submittal to the USACE. The document would be submitted to the City for
review prior to submittal to the USACE.
ADDITIONAL SERVICES:
Projects sponsored by public entities that affect a cumulative area greater than five acres
or that disturb more than 5,000 cubic yards require advance consultation with the Texas
Antiquities Committee according to Section 191.0525 (d) of the Antiquities Code of
Texas. Because the project engineer has stated that the proposed project is not expected
to exceed these thresholds, coordination with the Committee would not be required. If
the City determines at a later date, FNI will prepare a letter to the Texas Historical
Commission describing the project and requesting the Committee's review as an
additional service.
Freese and Nichols will notify the City if any of the following services will be necessary
to comply with permit requirements. The following services can be provided upon
written authorization by the City:
1. Formal consultation with the U. S. Fish and Wildlife Service.
2. Wildlife studies required by the U.S. Fish and Wildlife Service.
3. Preparation of a detailed wetland delineation and jurisdictional determination
report.
4. Preparation of a pre - construction notification (PCN) for nationwide or regional
general 404 permit coverage.
5. Preparation of a formal written request for USACE authorization under a letter of
permission procedure.
6. Preparation of a standard individual Section 404 permit application.
7. Preparation of Environmental Information Document, Environmental Assessment,
or an Environmental Impact Statement.
8. Meetings or consultation with the USACE or other resource agencies, except as
specifically noted in the scope of services.
9. If required by the USACE, FNI can assist the City with holding a Public Hearing
by preparing public notices, submitting notices to local newspaper(s); providing
verbatim transcript services, attending the public hearing; and incorporating the
hearing record into the EA.
10. Presence /absence surveys for federally listed threatened/endangered species.
11. Preparation of a mitigation plan to compensate for impacts to waters of the U.S.
12. Application to Texas Commission on Environmental Quality for individual 401
Water Quality Certification.
13. Application for General Land Office easements.
14. Application for Texas Parks & Wildlife Department Sand and Gravel Permit.
15. Additional field investigations or analysis required to respond to public or
regulatory agency comments.
16. Expert representation at legal proceedings or at contested hearings.
17. Mitigation monitoring if required by permit conditions.
18. Monitoring for compliance with permit conditions.
19. Additional modifications to the compensatory mitigation plan.
20. Assist with the payment of an EID processing fee if levied by the USACE.

Bella Vista Waterline Design Project (Alternate Route B)

Dear Mr. Herndon:
In accordance with your request, Geotest Engineering, Inc. is pleased to submit
this proposal for the referenced project. The project (Alternate Route B) consists of
installation of approximately 3,600 linear feet of 12 -inch new waterline. The Alternate
Route B begins with a connection to the end of an existing 16 -inch waterline in front of
the Longwood WWTP. The aligmnent then heads north -east, parallel to Dixie Farm
Road until it reaches Clear Creek. At Clear Creek Crossing, the proposed waterline will
be attached to the existing concrete bridge. Once across the Creek, the alignment heads
west towards the existing pipelines. A conventional cased bore is recommended under
Dixie Farm Road, and uncased bores will be utilized to across associated pipelines
located in the project vicinity. Additional uncased bores are recommended in the area
where aerial imagery shows the potential for wetlands. To avoid any additional
environmental impacts, the proposed alignment will follow the existing bank of Clear
Creek. The waterline is proposed to be installed by open -cut method along the top
embankment of two detention ponds. Additional uncased bores are necessary near the
north -west portion of the alignment to avoid disruption to the property owner in the
Bellavita Subdivision near the connection point to the existing 8 -inch waterline.

Purpose and Scope
The purpose of this study is to perform a geotechnical investigation at the
proposed waterline installation. The scope of this study is based on the information
provided to us and will include the following:
• Drilling and sampling:
■ 4 — 20 -foot borings with one each at each trenchless location and at
Clear Creek Crossing
■ 2 — 10 -foot borings for open cut
• Performing appropriate laboratory tests in accordance with ASTM methods on
selected samples to develop engineering properties of the soil.
• Perform engineering analyses to develop geotechnical recommendations for
the design and construction of the water line installation.
• Prepare a geotechnical report. The report will include all field data, laboratory
test data and geotechnical recommendations.
It is assumed that the borings will tie -in by you or your surveyors.
Project Schedule
The study will commence within one week after receiving your written
authorization. The field work should be completed in about two (2) days. Bad weather
may require additional time. The laboratory tests will be completed in about one (1)
week after completion of field work. The final report, which will include field and
laboratory data and geotechnical recommendations, will be submitted in about seven (7)
weeks after the receipt of written authorization.

Cost
Based on the scope of work outlined above, the cost of the field investigation,
laboratory testing, engineering analyses and a geotechnical report will be a lump suns of
$8,738.00. A cost breakdown is provided in Attachment No. 1.
