GENERAL NOTES
Reflectorized signs s ; constructed of retro-reflective sheeting in
conformance with pro1.,.,t specifications and shall be maintained to
meet the appearance, color and reflectivity requirements of those
specifications. Paints and coloration of signs shall be equal to the
Department's standards. Signs shall comply with the general
requirements specified in the "Standard Specifications for Construc
tion of Highways, Streets and Bridges" In effect at the time of
contract award.
All traffic control devices shall conform with the "Texas Manual on
U niform Traffic Control Devices for Streets and Highways." Contrac-
tors shall furnish a copy of a certification from the manufacturer of
the lights that the warning lights meet the requirements of the ITE
Standard for Flashing and Steady Burn Warning Lights as contained
in the latest edition of the "Texas Manual on Uniform Traffic Control
Devices for Streets and Highways' .
All signs shown have black letters and borders on a reflective orange
background except the R20-3, R4-7b, R4-8b, and G20 6 signs which
have a reflective white background.
S igns erected on portable supports for use on construction projects
n ormally mean signs which are used during the day to warn or guide
traffic through and/or around the actual construction area, but at the
e nd of the workday such signs are either removed or turned away from
the view of traffic. Portable supports shall be as shown on this sheet
or as approved by the Engineer. The bottom of the sign shall be a
minimum of one (1) foot above the pavement sign Signs required for
n ighttime usage should not normally be mounted on portable
supports, except when approved by the Engineer.
Signs erected on fixed supports for use on construction projects nor-
mally mean signs that are to remain in place for both day and night
u sage to regulate, warn and guide traffic in advance of and within the
limits of the project including the crossroad approaches. However,
u nder certain conditions, such as where a sign may be required for a
few days duration and then is no longer needed or where a sign is
moved from location to location every few days or where it is not prac-
tical or desirable to provide a fixed mounting, such signs may be
e rected on a temporary type of support. Temporary supports shall be
as shown on this sheet or as approved by the Engineer. Signs erected
on temporary supports should be at a minimum height of three (3) feet
Signs erected on fixed supports should be at a minimum height of five
(5) feet in rural areas and seven (7) feet in urban areas and other rural
locations where sight distance obstructions are present. Regardless
of the type of support used, regulatory signs should not be erected at
height less than the 5 or 7 foot minimum specified above unless a
lower height is approved by the Engineer. Posts for fixed supports
should be set in the ground without concrete footings.
Where portable or temporary supports require the use of weights to
keep a sign or barricade from turning over, the use of some type of
sandbag is recommended. The use of pieces of concrete, rocks, iron,
steel or other solid objects will not be permitted.
For additional information and guidelines on barricades and construc-
tion signs see the Texas Manual on Uniform Traffic Control Devices.

AGREEMENT DATED APRIL 25, 1983, BETWEEN THE STATE

MADE A PART HEREOF, IN THE CITY OF PEARLAND; PRO-
VIDING FOR THE EXECUTION OF SAID AGREEMENT; AND
PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEAR-
LAND, TEXAS:
SECTION 1. That the certain agreement dated April 25,
1983, between the State of Texas and the City of Pearland, for the
installation, construction, existence, use, operation, and mainten-
ance of certain highway traffic signal at the location shown on
EXHIBIT 1, attached hereto and made a part hereof, in the City of
Pearland, be and the same is hereby approved, and Tom Reid is here-
by authorized to execute said agreement on behalf of the City of
Pearland, and to transmit the same to the State of Texas for appro-
priate action.
SECTION 2. That this Resolution shall take effect on
and after its passage on first and only reading this 25th day of
April, A. D., 1983.

WITNESSETH
WHEREAS, the City has authorized the installation, operation, and maintenance

AGREEMENT
NOW, THEREFORE, in consideration of the premises and of the mutual covenants
and agreements of the. parties hereto to be by them respectively kept and
performed, as hereinafter set forth, it is agreed as follows:
1. The State will furnish the nececssary funds for the actual construction,
prepare plans and specifications, install said highway traffic signal,
supervise construction, and upon completion of construction, will furnish the
power and operate and maintain said highway traffic signal ).
2. The City hereby consents to the construction of the highway traffic
signal* shown on EXHIBIT 1 by the approval of the location and manner of
construction as shown on the plans and described in the specifications. .

3. The City will exercise no control whatsoever over the operation,
maintenance, use, or existence of the highway traffic signal(0 without written
authority from the State Department of Highways and Public Transportation.
4. The State shall have the authority to make such changes in the design and
operation of the highway traffic signal(1) as it may deem necessary and advisable
to promote the safe, convenient, and orderly movement of traffic.
5. The City will be responsible for the police enforcement required for
securing obedience to the highway traffic signalO. .
6. In the event the signal(g) installed in accordance with this Agreement
become unnecessary or are removed for any reason, this agreement shall terminate.
7. Indemnification -
The City agrees to indemnify the State against any and all damages and
claims for damages to adjoining, abutting or other property for which the State is
or may be liable arising out of, incident to or in any way connected with the
installation, the construction, the existence, the use of such project and does
hereby agree to indemnify the State against any and all court costs, attorneys'
fees and all expenses in connection with suits for such damage and shall, if
requested to do so in writing, assist or relieve the State from defending any such
suits brought against it.
Nothing in this agreement shall be construed to place any liability on the -
City for personal injury arising out of the construction of such project.
Furthermore, it is not the intent of this agreement to impose upon the City the
liability for injury to person or property arising out of the construction of the
project by the State's contractor unless the State itself would be liable for such
injury or damage. - -

Nothing herein contained shall be construed to place upon the State any
manner of liability for injury to or death of persons or for damage to or loss of
property arising out of or in any manner connected with the use of the project,
and the City will save the State harmless from any damages arising from said main-
tenance and/or use of said project..
It is further understood and agreed between the parties hereto that the
improvement of the project by the State is for the sole purpose of providing the
travelling public a more adequate travel facility and shall never be the basis of
any claim for State assumption, or participation in the payment, of any of the
obligations of the City incurred in the improvement, past or present, of any
street project.
8. The department will not incur any financial obligation to the city as a
result of this agreement.

construction as shown on the plans and described in the specifications.

3. The City will exercise no control whatsoever over the operation,
maintenance, use, or existence of the highway traffic signal(90 without written
authority from the State Department of Highways and Public Transportation.
4. The State shall have the authority to make such changes in the design and
operation of the highway traffic signal(g) as it may deem necessary and advisable
to promote the safe, convenient, and orderly movement of traffic.
S. The City will be responsible for the police enforcement required for
securing obedience to the highway traffic signal().
6. In the event the signal(g) installed in accordance with this Agreement
become unnecessary or are removed for any reason, this agreement shall terminate.
7. Indemnification
The City agrees to indemnify the State against any and all damages and
claims for damages to adjoining, abutting or other property for which the State is
or may be liable arising out of, incident to or in any way connected with the
installation, the construction, the existence, the use of such project and does
hereby agree to indemnify the State against any and all court costs, attorneys'
fees and all expenses in connection with suits for such damage and shall, if
requested to do so in writing, assist or relieve the State from defending any such
suits brought against it.
Nothing in this agreement shall be construed to place any liability on the
City for personal injury arising out of the construction of such project.
Furthermore, it is not the intent of this agreement to impose upon the City the
liability for injury to person or property arising out of the construction of the
project by the State's contractor unless the State itself would be liable for such
injury or damage.

Nothing herein contained shall be construed to place upon the State any
manner of liability for injury to or death of persons or for damage to or loss of
property arising out of or in any manner connected with the use of the project,
and the City will save the State harmless from any damages arising from said main-
tenance and/or use of said project.
It is further understood and agreed between the parties hereto that the
improvement of the project by the State is for the sole purpose of providing the
travelling public a more adequate travel facility and shall never be the basis of
any claim for State assumption, or participation in the payment, of any of the
obligations of the City incurred in the improvement, past or present, of any
street project.
.8. The department will not incur any financial obligation to the city as a
result of this agreement.
