RESOLUTION NO. R83-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ACCEPTING THE PROVISIONS AND PROPOSAL OF MINUTE ORDER NUMBER 81169 000S4, PASSED AND APPROVED BY THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION ON AUGUST 2S, 1983. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: The City of Pearland, Texas, by the adoption and passage of this Resolution, does hereby accept and agree to the terms and provisions of Minute Order 81169 00054 passed by the State Depart- ment of Highways and Public Transportation of the State of Texas, on August 25, 1983, a copy of which is attached hereto and made a part of this Resolution for all purposes as Exhibit "A". II. The City of Pearland wishes to have the following consid- ered in the design and construction of the said roadway, being more particularly defined as follows: (a) That the roadway elevation be maintained to assure utilization during disaster condition; (b) That the roadway be widened to five (5) lanes in the existing right-of-way with center lane designated for continuous two-way left turns; (c) That the roadway be constructed as a curb and gutter section. III. That the Mayor and City Secretary are hereby authorized and directed to execute and deliver any and all documents and to do any and all other things necessary and convenient to carry out the terms of this Resolution or Minute Order Number 81169 00054. Furnish all required right of way clear of obstructions with acquisition proce- dures to be in accordance with applicable Federal and State laws governing the acquisition policies for acquiring real property. 2. Provide for the adjustment of utilities as may be required. 3. Maintain that portion of the work which is its responsibility in accor ance with present maintenance agreement greement and agree to regulate traffic and prevent encroachment on the right of way,. all in accordance with governing policies and regulations of the Department. Prepare construction plans aic ";;-specifications. 2. Provide for Widening Grading, Structures and Surfacing at an estimated cost of $1,100,000 as authorized in the 1983-1986 Urban System Program. 3. Maintain that portion of the work which is its responsibility in accordance with present maintenance agreement.
