AN ORDINANCE DISPENSING WITH THE OFFICE OF CITY MARSHAL;
CONFERRING THE DUTIES OF SUCH OFFICE UPON A POLICE OFFI-
CER; PROVIDING FOR THE APPOINTMENT, TERM OF OFFICE AND
QUALIFICATIONS OF POLICE OFFICERS, CITY SECRETARY AND
CITY TREASURER, REQUIRING POSTING OF BONDS BY SUCH PUB-
LIC OFFICERS; AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, Article 999A and other Articles of Chapter 3, Title 28 of the
Revised Civil Statutes of Texas authorizes the governing body of any city
or town operating under the general. laws of Texas, having less than five
thousand inhabitants according to the last preceding federal census, may
by ordinance dispense with the office of City Marshal, and at the same
time by such ordinance confer the duties of said office upon a city police
officer to be appointed as the City Council shall direct upon a city police
and further that the office of City -Treasurer and City Secretary shall here-
inafter be appointed rather than elected. Now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND:
SECTION 1. The office of City Marshal, City Secretary and City Treasur-
er, after the effective date of this ordinance, shall be filled by appoint-
ment by the City Council of the City of Pearland, Brazoria County, Texas.
SECTION 2. The duties, powers, rights and authority vested by law in
the City Secretary and City Treasurer, shall be the same as are conferred
upon such officers by Articles 1000 and 1001 of Chapter 3, Title 28 of the
Revised Civil Statutes of Texas , and shall be continued to be known and
referred to under such Title, and as such public officer and each of said
officers shall perform such other duties as may be required of him by
law, ordinance, resolution or order of the City Council.
SECTION 3. The City Police Officer, the City Secretary and City Treas-
urer shall be appointed for an indefinite period of time and shall be sub-
ject to discharge at the will of the City Council. Such officer filling such
position shall receive such compensation as the City Council shall fix from
time to time by ordinance or resolution and shall. first furnish such indem-
nity bond as may be required by law or by the City Council by ordinance
or resolution.
SECTION 4. The effective date of this ordinance shall be on the ‘th day
of April, 1960, at 12:91 o'clock A.M.
SECTION 5. If any part of any section, portion or section of the Ordin-
ance shall be held by a Court of competent jurisdiction to be void or un-
constitutional, the rest and remainder of such ordinance not held to be
void or unconstitutional shall continue to remain in full force and effect,
and any such partial illegity shall not affect the same as a whole.
