(9-a. i AN ORDINANCE OF THE CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS, FOR THE POLICIES OF THE OPERATION OF THE STREET AND BRIDGE DEPARTMENT OF SAID CITY, AS ADOPTED ON JANUARY 22nd, 1960. 1. RIGHT -OF -WIDTH FOR CITY STREETS: All new City streets are to have a minimum right-of-way width of sixty (60) feet. No additional construction of improvements will be made to existing City streets with less than 60' right-of-way width. 2. DRAINAGE DITCHES CROSSING EXISTING STREETS: Formal applications must be filed with the City Engineer who will make his recommendation to the Board of Aldermen. Generally concrete or metal structures with concrete headwalls will be required. 3. PIPE LINES CROSSING F.XTSTING CITY STREETS: Formal applications must be filed with the City Engineer who will make his recommendations to the Board of Aldermen, unless prior authority is granted by law. 4. RIGHTS -OF -WAY ACQUISITIQN: Through the City Engi- neer and in accordance with law. 5. TEMPORARY UTILITY OR PIPE LINE PERMITS: Upon formal application to the City Engineer for a Temporary Utility or Pipe Line Permit, the City Engineer is authorized to grant these permits providing such will not impair road safety, maintenance or con- struction or necessitate the expenditure of City Street and Bridge Department Funds by reason of the temporary permit. 6. MINERAL EXPLORATION PERMITS ON CITY STREETS: Re- quests for mineral exploration permits to operate from City Streets shall be denied. 7. SUBDIVISIONS: a) These policies and any and all future additions thereto and changes thereof, will be binding on all new sub- divisions or re -subdivisions in the City of Pearland. Said rules, regulations and requirements must be complied with before approval or acceptance of the streets or roads, of a subdivision or re - subdivision in the City Street System by the Board of Aldermen. b) All plats must be made on tracing linen with India ink in sizes 12" x 18", 18" x 24", 18" x 36", 18" x 48" or 24" x 36". This original tracing is to be filed with the City Secretary as a permanent record. If the applicant requires a duplicate original of the plat with signatures, he must submit a reproduced tracing along with the original. He must also furnish a print of the plat for the City Engineer's file. In the upper right hand corner the plat must provide a small scale key map showing the location of the subdivision with reference to well- known fixed points in the City. c) All streets indicated on the plat are to have a minimum width of 60' and dedicated to use of the general public. The form of dedication must be approved by the City Attorney. d) The plat and plans as submitted for approval and filing must show the line and grade of proposed streets and side ditches, drainage ditches, utility easements and the course and location of all existing pipelines or pipeline easements through such proposed subdivision. The plat must provide a note stating that all existing pipelines or pipeline easements through the proposed subdivision have been shown or that there are no existing pipelines or pipeline easements within the limits of the proposed subdivision. e) It shall be the duty of the developer or his engineer to see that layout and construction follow the plans as presented with the final subdivision plat. f) A certificate from each tax collector of a political subdivision in which the property is located must accompany the plat to be recorded, showing that all taxes owing to the State, County, School District, and/or any other political subdivision, have been paid in full to date. g) The Board of Aldermen will not approve any map or plat of any subdivision or re -subdivision unless such map or plat is accompanied by a bond, the amount of which shall be determined by the Board of Aldermen, payable to the City Treasurer, to the effect that the owner or owners will construct the roads or streets therein shown in accordance with the specifications adopted, in lieu of the above bond, the Board of Aldermen may, at its discretion, require the subdivider to furnish the City with a signed copy of a Performance Bond executed by a surety company authorized to do business in Texas, together with a copy of the contract upon which said bond is written. Form of bond must be approved by the City Attorney. h) The City Street and Bridge Department and the City Engineer are hereby directed to refrain from doing any grading, shelling, paving or work of any kind on the streets, alleys, and other dedicated properties shown thereon except by majority vote of the Board of Aldermen. When a subdivider wishes to have the streets, alleys or other properties in a subdivision maintained by the City, then the said subdivider must improve said streets, alleys, and other properties to meet the specifications set out herein and then upon the recommendation of the City Engineer, the Board of Aldermen will vote to maintain the said streets, alleys, and/or other properties in said subdivision dedicated to the use of the general public. This policy shall further apply to all future sub- divisions not now of record with the City Secretary or the City Engineer, The streets in previously developed subdivisions which have not been taken into the City Street and Bridge System shall be considered on individual merits. i) The plat must be signed by the owners of the subdivision and presented to the City Engineer for his approval at least seven (7) days prior to the Board of Aldermen meeting at which time the plat is to be approved and ordered �lfiled for record.
