Ord. 0034 1960-10-27r e \ SPEED ZONE ORDINANCE /1Jo35t Cs a/-r AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 8 CT ARTICLE 827a, VERNON'S TEXAS PENAL CODE, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREEPS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF PEARLAND, AS SET OUT IN THIS ORDINANCE; AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200 FOR THE VIOLATION OF THIS ORDINANCE. WHEREAS, Section 8 of Article 827a, Vernon's Penal Code of the State of Texas, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and condition of thelpaavemee and other circumstances on such portion of said street of highway, usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, now therefore, BE IT ORDAINED BY THE BOARD OF ALDERMEN CT THE CITY OF PEARLAND, TEXAS: Section 1. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 8 of Article 827a, Vernon's Texas Penal Code, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: (a) 0n Main Street (State Highway No. 35) from the Pearland North City Limit to a point 1,585 feet south of the Pearland North City TAmit, a distance of approximately 0.300 mile, 50 miles per hour for north- bound traffic, and 60 miles per hour during the daytime and 55 miles per hour during the nighttime for southbound traffic; (b) On Main Street (State Highway No. 35) from a point 1,585 feet south of the Pearland North City Limit to a point 1,930 feet north of Orange Street, a distance of approximately 1.289 miles, 60 miles per hour during the daytime and 55 miles per hour during the nighttime; 0n Main Street (State Highway No. 35) from a point 1,930 feet north of Orange Street to a point 100 feet north of Orange Street, a distance of approximately 0.347 mile, 50 miles per hour; (d) On Main Street (State Highway No. 35) from a point 100 feet north of Orange Street to a point 100 feet south of Third Street, a distance of approximately 1.161 miles, 35 miles per hour; (c ) )Ja3 (e) On Main Street (State Highway No. 35) from a point 100 feet south of Third Street to a point 1,640 feet south of Third Street, a distance of approximately 0.292 mile, 50 miles per hour; (f) On Main Street (State Highway No. 35) from a point 1,640 feet south of Third Street to the Pearland South City TAmit, a distance of approximately 0.830 mile, 60 miles per hour during the daytime and 55 miles per hour during the nighttime; (g) On Broadway (Farm Road Highway No. 518) from the Pearland West City Limit to a point 100 feet west of Austin Street a distance of approximately 0.721 mile, 50 miles per hour; (h) On Broadway (Farm Road Highway No. 518) from a point 100 feet west of Austin Street to a point 365 feet west of Old Galveston Road, a distance of approximately 0.949 mile, 35 miles per hour; (i) On Broadway (Farm Road Highway No. 518) from a point 365 feet west of Old Galveston Road to a point 100 feet east of Walnut Street, a distance of approximately 0.339 mile, 50 miles per hour; (j) On Broadway (Farm Road Highway No. 518) from a point 100 feet east of Walnut Street to the Pearland East City limit, a distance of approximately 3.595 miles, 60 miles per hour during daylight and 55 miles per hour during nighttime; (k) 0n Broadway (Farm Road Highway No. 518) from a point 100 feet east of Houston Avenue to a point 50 feet east of Galveston Avenue, 20 miles per hour School Zone when so signed, 35 miles per hour at all other times. Section 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than Two Hundred ($200.00) Dollars. nNi PASSED AND APPROVED THIS 56 / day of ®C 7 , 19 f�0 .
