Ord. 0045 1961-11-02• ORDINANCE AN ORDINANCE MAKING IT UNLAWFUL TO DAMAGE OR DESTROY ANY TREES, BUILDINGS OR OTHER PUBLIC PROPERTY AND FIXING A PENALTY FOR VIOLATIONS. BE IT ORDAINED by the City Council of the City of Pearland, Texas: SECTION 1) Destroying Trees and Plants: It shall be unlawful for any person to injure or destroy any shade or ornamental tree, or other plant growing or planted along any street, sidewalk, or alley, or within any public grounds or property of the City of Pearland. SECTION 2) Defacing Property: It shall be unlawful for any person to injure, deface, damage or destroy any kind of public property, or any property belonging to the City of Pearland. SECTION 3) Miscellaneous Violations: (A.) Damaging streets and sidewalks: It shall be unlawful for any person to dig up, remove, or carry away, any turf, gravel, dirt, sand, or paving material from any street or other public property of the City of Pearland, or to construct, alter, or destroy any street, sidewalk, curb or gutter in the City of Pearland, with- out permission from the City Commission. (B.) Signs and Pictures: It is unlawful for any person to place or paint any sign, picture, character or other advertisement upon any sidewalk, pavement, curbstone, public bridge, public building or other public property, or to remove and mutilate or deface any traffic sign, signal or marker with- -1- out permission from the City Commission. (C.) Street Lights: It is unlawful for unauthor- ized persons to tamper with, damage, break, or destroy any street light, white way light, signal light, power line, elec- tric light line, light pole, transformer, or guy-wire support- ing or steadying any light pole, or other equipment of the City of Pearland, Texas. (D.) Animal Life: It is unlawful to interfere with, injure, capture, or kill any squirrel, bird, fowl, or other an- imal life within any public park, driveway, highway, or other public property of the City of Pearland, except by permission of the City Commission. Provided that this subsection shall not apply to harmful rodents, or insects. (E.) Blasting: Blasting or demolition with dynamite or any other explosive, within the City of Pearland is unlawful, except upon permission from the City Commission. (F.) Show-windows: Marking or defacing show-windows, or doors with soap or other substance is unlawful. SECTION 4) Penalty: Any person violating any of the provisions of this Article, shall, upon conviction, be fined in any sum not to exceed Two Hundred ($200.00) Dollars.
