AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, RECEIVING AND
ANNEXING AS A PART OF SAID CITY OF PEARLAND, TEXAS, THE
FOLLOWING TERRITORY LYING ADJACENT TO THE CITY OF PEARLAND,
TEXAS:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, DULY ASSEMBLED:
SECTION 1. WHEREAS, on the 7th day of June, A. D. 1962, there
was filed with the Mayor and City Council of the City of Pearland, Texas, the
foLLowing instruments:
1. A petition for Annexation of the hereinafter described property
executed by Briton Ryan, Jr., as the record owner and soLe
owner of the hereinafter described property to be annexed;
2. The compliance Bond guaranteeing the buil ding of the roads in
the Subdivision in accordance with the minimum requirements
pertaining to subdivisions, executed by two or more good and
sufficient sureties and the principal, guarantees the compliance
of such agreement;
3. The metes and bounds description of the tract sought to be
annexed.
WHEREAS such petition in Paragraph No. 1, above indicated and
evidenced that the soLe owner of such property was Briton Ryan, Jr, and in
accordance with the provisions of Article 974g of the Revised Civil Statutes
of Texas; that such petition should be filed with the City Council and Mayor
of the City of Pearland and remain on file not Less than five nor more than thirty
days prior to action of acceptance or rejection by the City Council of the City
of PearLand; That said Bond and Petition was filed on the 7th day of June,
A. D. 1962, and proper notice thereof made upon the minutes of the City
Council of the City of PearLand, Texas, and providing in substance that a
special meeting be called after the expiration of five days for determination
of the Council on the finaL acceptance of or rejection of said application for
annexation. That sai d special meeting was called by the Mayor for the 18
day of June, A. D. 1962 at 7:30 o'clock P. M. with the foLLowing Councilman
in attendance:

SECTION 2:
WHEREAS at said meeting the following Ordinance was adopted:

That I, E. T. GIBBONS, the duly elected and qualified Mayor of the
City of Pearland, Texas, do hereby certify that on the 7th day of June, A. D.
1962, there was filed with me as Mayor of said City in open meeting, the
following instruments:
1. Application of Annexation;
2. Certificate of Ownership of the property sought to be annexed
by Briton Ryan, Jr„ as the sole owner of the property sought
to be annexed;
3. Bond of Petitioner executed by the record owner as principal
and two good and sufficient sureties conditioned that said streets
would be completed in accordance with the minimum specification
pertaining to the building of roads in the subdivision.
That an examination of the above described instruments and Petition
and application revealed that Briton Ryan, Jr. was the sole and exclusive
owner of the property sought to be annexed; that said property was adjacent to
the City of PearLand and did not exceed one-half mile in width and that the
same has remained on file for a period of not less than five days prior to the
following action on the part of the City Council as to the applicant's petition
for annexation of the territory described in the petition to the City of PearLand.
That the above described territory adjoining the City of PearLand, Texas, is
now legally susceptable of annexation to the City of Pea

SECTION 3: That aLL of the above mentioned instruments have been
fiLed with the Mayor and City Secretary of the City of PearLand, Texas, and
the City Council of said City of PearLand, having examined the same and
having inquired into the facts and circumstances surrounding all of said pro-
ceedings and being fully advised of the premises, hereby finds that all of the
statements therein contained are true and correct and that the procedure
initiated, prosecuted and concluded by the applicant and petitioner of said
territory was, in all respects, proper and in keeping with the taws of this
State and particularly Article 974g of the Revised Civil Statutes of Texas,
prescribing such procedure and that there has been performed and consum-
mated every Legal prerequisite necessary to a valid and susceptabLe annexation;
of said territory as a part of the City of PearLand, Texas,
SECTION 4: The City Council finds as a fact that such property
was owned solely by petitioner and that he had filed his petition requesting
annexation to the City of PearLand.
SECTION 5: That said territory described in said proceedings
ties adjacent and contiguous to the City of PearLand and does not at any
place extend one-half mile or more in width.
SECTION 6: There is hereby received and annexed as a part of the
City of PearLand, Texas, the following territory being the same as described
in the petition for annexation hereinabove set out, to -wit:
Being a tract of Land lying and being situated in Section 13, in the
HT&B RR Company Survey, Abstract 240, Brazoria County, Texas,
to -wit:
BEGINNING at an iron pipe Located in the North line of an existin
County Road, same point being Located in the West line of Lot 19 and
North 30' from the South Line of said Section 13, Abstract 240;
THENCE North 89 deg. 57 min. East along the �7orth Line of an

2610' to an iron pipe for corner Locatd in the West line of a shelled
County Road, same point being Located Northao' and 30' West of the

THENCE North along the West Line of an improved County Road
and along a line Located West 30' from and paraLLeL to the East tine
of said Section 13, Abstract 240, a distance of 1342.36' to an iron pipe
on the West bank of Mary's Creek;
THENCE South westward along the top edge of the West bank of
Mary's Creek with its meanders in a Southwest direction the following

THENCE South along the West Line of said Lot 19, Section 13,
Abstract 240 a distance of 451.5' to the place of Beginning, containing
in all 57.429 acres of Land;
SECTION 7: That said territory and any inhabitants that may re-
side therein shall hereafter have and enjoy all the rights, privileges and
obligations incident to and flowing with the annexation of said territory and its
incorporation in and within the corporate Limits of the City of PearLand.
SECTION 8: The Corporate Limits of the City of PearLand are
hereby extended so as to include and there is hereby included within said
Corporate Limits, the above described territory.
SECTION 9: This Ordiance shalt take effect immediately upon its
passage and approval by the City of Pearland City Council and thence forth
said territory shall be and remain a part of the City of PearLand, Texas,
as fatty and to all intents and purposes as if said territory were included
within the Corporate Limits of the City of Pearland as originally incorporated.

That an examination of the above instruments and petition reveal. that
an appLication was filed for incorporation of thehereinafter described terri-.
1 tory to the City of Peartand, Texas, on the 7th day of June, A. D. 1962, and
that such petition appeared to be in proper order and that said land compris-
ing the addition was owned wholly by Briton Ryan, Jr., and was filed Under
Article 974g of the Revised Civil Statutes of Texas and was properly filed
and certified such action to me as Mayor of the. City of Pearland, Texas.
That the territory described in the Petition is adjacent to the City of
Peartand and is now Legally susceptable of annexation to the City of Peartand,

PETITION FOR ANNEXATION
TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF PEARLAND,TEXAS;
I, the undersigned, being the owner of the hereinafter described
territory, which adjoins the City Limits of the City of Pearland.. and
is not more than one-half mile in width, do hereby petition you Honor-
able Body to extend the present City Limits so as to include the.
following described territory as a part of the City of Pearland,Texas,
to -wit:
Beginning at a point where the present Pearland City Limits
intersects the north right of way line of County Road #388, same
point being located north 30 feet from the south line of H.T.&B.. R.R.
Co. Survey, Section 13, abstract 240 of Brazoria County, Texas;
Thence South 89° 574 West, along the north line of said
County Road, a distance of 2510 feet to a point for corner in the
centerline of said abstract 240;
Thence North, along the centerline of said abstract 240, a
distance of 441.5 feet to the top of the South bank of Maryls Creek;
Thence in a Northeasterly direction along the south bank
of Maryvs Creek, following its courses and meanders to the intersec-
tion of the present Pearland City Limits;
Thence South along the present Pearland City Limits to the
place of beginning and containing in all 57.429 acres of land known
as Ryan. Acres.
I, the undersigned, being the owner of the above described
territory have expressed my choice by affixing my signature to the
petition under the appropriate heading listed below.

said State and County, on this day personally appeared Britton Ryan, Jr.
well known to me and who after being duly sworn, depose and say: he is

the matter of annexing said territory to the city of Pearland, and that
