AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, AMENDING
CHAPTER 27, SECTION 27.S (7)(a) 1. AND SECTION 27.S
(8) (a) OF THE CODE OF ORDINANCE OF THE CITY OF PEARLAND,
TEXAS; PROVIDING AN EFFECTIVE DATE, A SEVERABILITY
CLAUSE, AND CONTAINING OTHER PROVISIONS RELATING TO THE
SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND
TEXAS:
Section I.
That Section 27.S (7) (a) I. of Chapter 27 of the Code
of Ordinances of the City of Pearland, Texas, codified under "Sub-
divisions", be and the same is hereby amended and said section
shall henceforth read as follows:
"7. Sanitary Sewers.
(a) Ail subdivisions coming under the provisions of
these regulations and reasonably accessible to a public sanitary
sewer shall provide each lot within the subdivision with access to
such sanitary sewer The design of such sanitary sewer shall be in
accordance with the city's sanitary sewer plan. The minimum size
of mains shall be eight (8) inches,
1. Unless otherwise directed in writing by the
City Manager, the subdivider and/or developer, shall extend the
sanitary sewer service line from the main line to the property line
of each building lot. The subdivider and/or developer shall be
entitled to receive compensation for such sanitary sewer service
line installation in the amount of two-thirds (2/3) of the City
sewer tap fee. Said compensation to be paid by the City at such time
as the property owner applies and pays for the Sanitary Sewer tap
fee~as prgscribed by the Cit~ Council."
Section II.
That Section 27~5 (8) (a) of Chapter 27 of the Code of
Ordinance of the City of Pearland, Texas, codified under "Subdivisions",
be and the same is hereby amended and said section shall henceforth
read as follows:
"8~ Water Lines.
(a) Where an approved public water supply is reasonably
accessible or procurable, each lot within the subdivided area shall
be provided with access to such water supply. The layout of the
system shall be designed to form a loop. No main shall be smaller
than six (6) inches and the minimum size service lines of two (2)
inches will be permitted, provided it is looped and the maximum length
is approved by the city.
Unless otherwise directed in writing by the City Manager,
the subdivider and/or developer, shall extend the water supply service
line from the main line to the property line of each building lot.
The subdivider and/or developer shall be entitled to receive com-
pensation for such water supply service line installation in the amount
of two-thirds (2/$) of the City water tap fee. Said compensation
to be paid by the City at such time as the property owner applies
and pays for the water supply tap fee as prescribed the the City
Council."
Section III.
If any section, paragraph, clause, or sentence shall be
declared void or unenforceable or unconstitutional, it is hereby
declared the intention of the City Council of the City of Pearland,
Texas, that the remainder of such ordinance shall remain in full
force and effect.
Section IV.
It is the intention of the City Council, and is is
hereby ordained, that the provisions of this ordinance shall be made
part of the Code of Ordinances, City of Pearland, Texas, and the
sections of this ordinance may be renumbered to accomplish such
intention.
Section V,
Ail provisions of the Code of Ordinances of the City
of Pearland, Texas, in conflict with amendments herein made are
hereby expressly repealed to the extent of such conflict.
Section VI.
This ordinance shall be effective on and after its
passage, approval and adoption upon second and final reading.
