Ord. 0058C-01 1971-05-243, ar— ORDINANCE NO. 58C-I AN ORDINANCE OF THE CITY OF PEARLAND, BRAZORIA AND HARRIS COUNTIES, TEXAS, AMENDING ORDINANCE NO. 58, ENTITLED SUBDIVISION REGULATIONS OF THE CITY OF PEARLAND, TEXAS, BY ADDING AND DELETING SPECIFIC PROVISIONS CONTAINED THEREIN AND REPEALING ALL ORDINANCE AND PROVISIONS OF ORDINANCES THAT CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION I That Section III, Subsection D, paragraph 4-L of Ordinance No. 58, entitled Subdivision Regulations of the City of Pearland, Texas, be and the same is hereby amended by deleting from said paragraph 4-L of Section III, Subsection D, the following sentence to wit: "If the engineer or surveyor who prepared the plat did not make the original boundary survey, this fact should be noted in the Certificate". Paragraph 4L of Section III, Subsection D as amended will read as follows: "L. A Certificate by the registered professional engineer, duly authenticated, that the plat is true and correct and in accordance with the determination of surveys actually made on the ground. Also, the Certificate should show whether or not the tract is within five (5) miles of the city limits of the City of Pearland, Texas, measured in a straight line from the nearest points on the city limits, unless the information is shown in suitable manner elsewhere on the face of the plat". SECTION II That Section IV, C -2a of Ordinance No. 58, entitled Subdivision Regulations of the City of Pearland, Texas, be and the same is hereby amended by deleting Section IV, C -2a which reads to wit: "a. Residential lots where served by public sewer should not be less than sixty (60) feet in width at the building line nor less than six thousand (6,000)", and adding thereto and inserting therein, the following new subsections to be known as Section IV C 2 -a-1 and Section IV C2-a-2 and to read as follows: 2. Lot dimensions shall be as follows: a. Residential lots served by public sewer. 1. Residential lots fronting on any City street, where served by public r% sewer, shall have a minimum width of not less than seventy (70) feet, a minimum depth of not less than one hundred (100) feet, and shall contain a minimum lot area of not less than eight thousand four hundred (8,400) square feet., (To comply with minute order dated February 6, 1964). 2. Residential lots fronting on any City cul-de-sac street, where served by public sewer, shall have a minimum front width of not less than thirty-five (35) feet, and shall contain a minimum lot area of not less than eight thousand four hundred (8,400) square feet. SECTION III That Ordinance No. 58, Section III - C (Preliminary Plat (Plan Plat), be and the same is hereby amended by adding the following new section to be known as Section III - C - 2 J and to read as follows: J. The proposed number and location of all street lights as shall be appropriate for the location of the subdivision and for the type of development and use contemplated. (Refer to Section V - B - 9). SECTION IV That Ordinance No. 58, Section V-B (minimum Standards) be and the same is hereby amended by adding the following new section to be known as Section V - B - 9, and to read as follows: 9. The City shall keep current and have available for distribution a written policy statement covering the following site improvements: 1. The policy of the city regarding their participation in the cost of streets, utilities and drainage improvements where City plans specify a facility designed to serve an area greater than that covered by the subdivision. 2. The policy of the city regarding street appurtenances such as street lights, signs, crosswalks, etc. 3. The particular arrangements governing the payment of charges incurred, or to be incurred, by both the city and subdivider on certain improvements. SECTION V r All ordinances and provisions of ordinances in conflict with amendments heretofore made are hereby expressly repealed to the extent of such conflict. SECTION VI This Ordinance shall take effect and be in force from and after its adoption on second and final reading. PASSED and APPROVED on first reading this Jg' day of A. D. 1971. All necessary easements for street lighting as recommended by the servicing power company and approved by the City Engineer will be shown on the final plat prior to approval by the Planning Commission. 4. An amount equal to two years rental will be deposited with the City prior to final subdivision acceptance. 5. The City will authorize installation of street lights after final subdivision acceptance. Pipe lines shall be tested before backfilling at joints, except when local conditions, in the opinion of the City, are such that the trenches must he backfilled immediately after laying the pipe, in which case the pressure tests may be made after backfilling has been completed but before 'replace- ment of permanent paving. - Ce) 1-5- . Leakage tests of asbestos -cement pipe shall be made only after the pipe has been filled with water for a minimum of 24 hours. (k) . Where practicable, pipe lines shall be tested in lengths between line -valves or plugs of not more than 1, 500 feet. (i Procedure for Testing. Each section of pipe line shall be chlorinated just prior to testing. Each section of pipe line shall be slowly filled with water and the specified test pressure, measured at the point of lowest elevation, shall be applied by means of a test pump connected to the pipe, in a manner satisfactory to the City. The test pump, • pipe connections and all necessary apparatus, gages and meters shall be furnished, installed and operated by the Contractor, at his expense. . Expelling Air Before Tests. During the filling of the pipe and before applying the specified test pressure, all air shall be ex- pelled from the pipe.line. To accomplish this, taps shall be made, if necessary, at point of highest elevation, and after completion of the test the taps shall be tightly plugged unless otherwise specified. Examination under Pressure. All exposed pipes, fit- tings, valves, hydrants, joints and asbestos -cement couplings will be care- fully examined. If found to be cracked or defective, they shall be removed and replaced by the Contractor with sound material at the Contractor's ex- pense. Examination of Individual Joints for •Leakage: All exposed pipes, fitti-ngs, valves, hydrants and joints shall be examined for leakage during the test._ Any joint found where the accumulated leakage of that joint exceedsthe rate of leakage specified in Table A shall be rejected by the City. A11wisible leaks at exposed joints, and all leaks evident on the surface -where joints are covered, shall be stopped and leakage minimized, regardless of total leakage as shown by test. 4. 4. Cast Iron Pipe: Pipe lines shall show leakage not exceeding •100 gallpns per 24 hours per inch diameter per mile of pipe. 61)+-8-4: - Asbestos -Cement Pipe: No pipe installation x ill be accepted until or unless the leakage for the section of line tested is less than the rate of leakage specified in Table A. In calculating leak- age the City will make allowance for added joints in the pipe line above those incidential to normal 13-foot lengths of pipe and for which Table A applies.
