R-1964-03 05-22-64 A P~ESOLUTION AUTHORIZING THE GIVING OF NOTICE TO BIDDERS AND OF INTENTION TO ISSUE TIME WARRANTS; PROVIDING THE' DETAILS RELATING THERETO; AND CON- TAINING OTHER PROVISIONS RELATING TO THE SUBJECT THE STATE OF TEXAS ~ COUNTY OF BRAZORIA ~ The City Council of the City of Pearland, Texas, convened in special session at the regular meeting place thereof within said City on the ~ day of May, 1964, with the following members present, to-wit: E. Shukanes Alderman Gene Sanders Alderman John Kegley Alderman Victor Nolen Alderman and ~ocrctary with the following member(s) absent, to-wit: ~ ~#~,~ , when the following business was transacted: The Mayor introduced a resolution and moved that it be adopted. The resolution was read in full. The motion for adoption was seconded by Alderman ~)~/ and carried by the following vote: AYES: Mayor Gibbons, Aldermen Shukanes, Sanders, Kegley, ~ and Nolen. NOES:None° The resolution thus adopted follows: A RESOLUTION AUTHORIZING THE GIVING OF NOTICE TO BIDDERS AND OF INTENTION TO ISSUE TIME WARRANTS; PROVIDING THE DETAILS RELATING THERETO; AND CON- TAINING OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, the City Council of the City of Pearland, Texas, has determined, and hereby determines and declares, that it is necessary and desirable for said City to construct permanent improvements~ including the purchase of necessarysites therefor additions and extensions/to the City's waterworks system, and that it is also necessary and desirable to issue the time warrants of said City for the purpose of evidencing the indebtedness of the City to pay all or a part of the cost of said improvements, including per- sonal and professional services to be rendered in connection there- with and other incidental expenses in connection therewith; and WHEREAS, the City Council wishes to proceed with authorizing the giving of notice to bidders and of the City's intention to issue such time warrants; Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1: That the facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct. Section 2: That the City Secretary is hereby authorized and directed to cause to be published in the manner required by law a notice to bid- ders and notice of intention to issue time warrants in substantially the following form: NOTICE TO BIDDERS AND NOTICE OF INTENTION TO ISSUE T]~iE WARRANT__S TO BIDDERS AND TO THE QUALIFIED VOTERS OF THE CITY OF PEARLAND~ TEXAS~ WHOSE NAMES APPEAR ON THE LAST APPROVED TAX ROLLS OF PROPERTY TAXPAYERS, AND TO ALL OTHER INTERESTED PERSONS: Notice is hereby given that sealed proposals addressed to the City Council of the City of Pearland, Texas~ will be received at the Pearland City Hall until 10:00 o'clock A~Mo~ June 12~ !96~, at which time they will be publicly opened and read aloud, for ~urnishing all labor, materials, supplies, machinery, equipment, tools, and superintendence for ~nstr~cting permanent waterworks system improvements for said City, to-wit: (1) a water well~ (2) a water storage tank; (3) a water treatment plant; and (~) a water distribution system° Bids may be made on one or more items. Bids received after closing time will be returned unopened. A cashier's check or certified check, payable to the City of Pearland, Texas~ in an amount not less than five per cent (5%) of the largest possible total for the bid submitted, must accompany such bid° Instructions to bidders, proposal forms, and plans and specifications may be examined without charge in the office of the City Secretary at the City Hall within said City, and may be procured from the said City Secretary or from the City's engineers, Walsh & McLaren, Consulting Engineers, Angleton, Texas, upon making the required deposit. Each successful bidder respectively receiving the award of a contract shall furnish (a) a performance bond in the amount of one hundred per cent (100~) of the total contract price conditioned upon the faithful performance of the work in accordance with the plans, specifications and contract documents, and (b) a payment bond in the amount of one hundred per cent (1OO%) of the total contract price, for the protection of all claimants supplying labor and material in the prosecution of the work provided for in each said respective contract, for the use of each such claimant, as provided by Article 5160, Vernon's Texas Civil Statutes, as amended. Each such bond shall be executed by corporate surety or sureties duly authorized to do business in the State of Texas. Attention is called to the fact that this is a public works project, and that there must be paid on the same not less than the general prevailing wages which have been established for the City of Pearland, and which are on file in the office of the City Secretary. In case of ambiguity or lack of clearness in statin~ prices in each respective proposal or proposals, the City reserves the rightto adopt prices written in words, or to reject the proposal. No bids may be withdrawn after the scheduled closing time for the receiPt of bids and for thirty (30)days thereafter, and any bid received a~ter such Closing time will be disqualified and Will be returned to the sender un- opened° The City reserves the right to accept any bid or combination of bids deemed most advantageous and to reject any or all. bids and to waive any informality. It is the intention of the City Council to pay for all or a part of the cost of constructing permanent improvements, additions and extensions to the City's wate~ works system, including personal and professional services~o,~,~$~r~,~co~ct~/n therewith and other incidental expenses in connection ther~%~ith~-in the maximum amount o~ $150,O00, bearing interest at a rate not exceeding five per cent (5%) per annum, and maturing serially over a period of years not to exceed thirty (30) years from their date or dates, with maximum maturity date not later than July l, 1994. BY ORDER OF THE CITY COUNCIL OF THE CITY OF PEARLAND~ TEXAS. Section 3: That the notice set forth in Section 2 of this resolution shall be published in The Alvin Sun once a week for two (2) con- secutive weeks prior to June 12, 1964, the date of the first pub- lication to be at least fourteen (14) days prior to June 12, 1964. It is hereby found and declared that The Alvin Sun is a newspaper published within the City of Alvin, Texas, and is a newspaper of general circulation within said City of Pearland, Texas, there being no newspaper published within said City of Pearland. A copy of said notice shall also be posted at the door of the City Hall of said City of Pearland, and the same shall be posted at least fourteen (14) days prior to June 12, 1964.
