R72-22 12-24-72RESOLUTION NO. 72-22 ORDER ESTABLISHING PROCEDURE FOR CITY OFFICERS' ELECTION (SPECIAL ELE'CTI'ON) THE STATE OF TEXAS CITY OF PEARLAND On this the 4 day of December , 1972, the City Council of the City of Pearland, Texas, convened in regular session at the regular meeting place thereof with the following members present, to -wit: Carlton McComb , Mayor E. A. Wasek , Councilman Gene E. Sanders - , Councilman B. J. Frank Dorothy L:Cook and the following absent: , Councilman , Councilman , Councilman , City Secretary Cecil W. Griffin , con- stituting a quorum, and among other proceedings had were the following: Councilman Sanders introduced a resolution and order and moved its adoption. The motion was seconded by Councilman Frank , and the motion carrying with it the adoption of the resolution and order prevailed by the follow- ing vote, AYES: Councilman Wasek, Councilman Sanders, Councilman Frank NOES: none Motion passed unanimously The resolution and order are follows: Whereas, James O. DeShazer, Councilman Position Number 4, has heretofore submitted his formal resignation from the City Council of the City of Pearland, Texas, effective November 29th, 1972; and Whereas, the City Council of the City of Pearland has accepted saidresignation and thereafter has declared an official vacancy in the office of Councilman Postition Number 4; and Whereas, the City Charter of the City of Pearland and Article 4.09 of the Election Code of the State of Texas provides that a ppecial election shall be ordered by the City Council to fill the unexpired term of a vacated elected Civil office, and Whereas, the City Council of the City of Pearland, wishes to proceed with the ordering of the special election for the purpose of filling the heretofore described vacancy; and Whereas, the City Charter of the City of Pearland and the laws of the State of Texas provide that the Election Code of the State of Texas is applicable to said special election, and in order to comply with said charter and code, an order should be passed establishing the procedure to be followed in said election, and designating the voting place for said election; Therefore, Be It Ordered by the City Council of the City of Pearland, Texas: I That a special election shall be held in the City of Pearland, Texas on the 20 day of January , 1973, for the purpose of electing the following official for said City: CITY COUNCILMAN - POSITION NUMBER 4 II The said election shall be held at the following place in said City: Drama Room, Pearland High School 2337 North Galveston Avenue Pearland, Texas with Mrs. Josie Heflin as Presiding Judge, and Mrs. Mary Lee Miller as Alternate Presiding Judge, and said Presiding Judge shall appoint the necessary clerks to assist, which -shall not exceed five (5) clerks. Dorothy L. Cook is hereby appointed clerk for absentee voting, and Dorothy Thompso and Mabel Salyer are hereby appointed Deputy Clerks for the absentee voting. The absentee voting for the above designated special election shall be held at the City Hall, 2335 North Texas Avenue, Pearland, Texas, and said place of absentee voting shall remain open for at least eight (8) hours on each day for absentee voting which is not a Saturday, a Sunday, or an official State holiday, beginning on the 20th day and continuing through the fourth -day preceding the date of said election. Said place of voting shall remain open between the hours of 8:00. .o'clock A.M. and 5:00 o'clock P.M. on each day for said absentee voting. The above described place for absentee voting is also the Absentee Clerk's mailing address to which ballot applications and ballots voted by mail may be sent. III That said election shall be held in accordance with the Election Code of this State and only resident qualified voters of said City shall be elegible to vote at said election. IV That the ballots of said election shall bear no party designation and shall conform to the requirements of the Election Code of the State of Texas (Chapter 492, Acts. of 52nd Legislature of Texas, Regular Session, 1951, as amended). V That all independent candidates for the office of Council- man Position Number 4 must file their applications to become candidates with the City Secretary of the City of Pearland, at the City Hall, 2335 -North Texas Avenue, Pearland, Texas, on or before 6:00 o'clock P.M. of the thirty-first (31st) day before the date of said election. That all of said applications shall be substantially in the following form, to -wit: To The City Secretary of the City of Pearland, Texas: I hereby request that my name be placed upon the official ballot for the election to be held on the 20th day of January, 1973, as a candidate for City Council- man Position Number 4. I hereby certify that I am a citizen of the United States of America and that I am eligible to hold office under the Con- stitution of the State of Texas. I have resided in the State of Texas for twelve (12) months next preceding the date of said election, and resided in the County of Brazoria and/or Harris County for months next preceding the date of said election, and have resided in the City in which 1 offer myself as a candidate for months next preceding the date of said election. City Secretary, Pearland, Texas All candidates shall file with said application the loyalty affidavit required by Article 6.02 of the Election Code; and all applications filed by candidates must be accompanied with a filing fee of Ten & No/100 ($10.00). Dollars, as required by Article 4.10 of the Election Code. VI. The City Secretary shall give notice of said special election in accordance with the terms and provisions of Article 4.05 of the Election Code and Article 29e R.C.S. and the City Secretary is hereby instructed to have said notice posted and published in accordance with said Article 4.05 and 29e. VII The order in which the names of the candidates for the office of City Councilman Position Number 4 are to be affixed or printed on the ballot and shall be determined by a drawing by the City Secretary as provided by Article 6.0.5c, Subd. 3 of the Election Code. VIII The City Secretary is hereby authorized and instructed to provide and furnish all necessary election supplies to con- duct said election. IX The Mayor shall issue all necessary orders, writs, and notices for said election, and immediately after said election is held, the officers holding the same shall make returns of the results thereof to the Mayor of this City as required by the Election Code of this State. OFFICERS ' ELECTION THE STATE OF TEXAS, CITY OF PEARLAND I, CARLTON McCOMB, in my capacity as Mayor of the City of Pearland, Texas, do hereby order that an election be held in said City on the 20 day of January , 19 73 for the purpose of electing the following officials for said City: ONE (1) City Councilman Position Number 4 . That in accordance with an order adopted by the City Council of said City, said election shall be held at the follow- ing place in said City, and the following named persons are here- by appointed officers for said election, to-wit: In Brazoria County Election Precinct Nos. 11, 12, 16 , 26 , 28 and 29 at: Drama Room, Pearland High School 2337 North Galveston Avenue Pearland, Texas In Harris County Election Pr.ecent No. 76 at: Drama Room, Pearland High School 2337 North Galveston Avenue Pearland, Texas with Mrs . The polls at the above designated polling place shall on said election day be open from 7 :00 o'clock A.M. to 7 :00 o'clock P.M. Dorothy L. That immediately after said election is held, the officers holding the same shall make returns of the result thereof to the Mayor of this city as required by the Election Code of this State.
