REQUEST AIRGAS SPECIALTY GASES, OWNER, CONTAINING A SAVINGS
CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER
PROVISIONS RELATED TO THE SUBJECT.
WHEREAS Airgas Specialty Gases, owner, filed an application for a Conditional
Use Permit to allow for Petroleum or Petroleum Product Extraction, Refining,
Manufacturer, or Bulk Storage, on certain property, said property being legally
described in the original applications for amendment attached hereto and made a part
hereof for all purposes as Exhibit "A and more graphically depicted in the location map
attached hereto and made a part hereof for all purposes as Exhibit "B and
WHEREAS, on the 21 day of March, 2011, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the City,
the affidavit of publication being attached hereto and made a part hereof for all
purposes as Exhibit "C said call and notice being in strict conformity with provisions of
Section 1.2.2.2 of Ordinance No. 2000T; and

WHEREAS, on the 21 day of March, 2011, the Planning and Zoning
Commission of the City submitted its report and recommendation to the City Council
regarding the proposed Conditional Use Permit application Airgas Specialty Gases,
owner, whereby the Commission recommended approval of the Conditional Use Permit,
said recommendation attached hereto and made a part hereof for all purposes as
Exhibit "D and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of
the Planning and Zoning Commission at a regular meeting on April 11, 2011; and
WHEREAS, the City Council, having fully heard the testimony and argument of
all interested parties, and having been fully advised in the premises, finds that in the
case of the application of Airgas Specialty Gases, owner, presented which, in the
judgment of the City Council, would justify the approval of said application; now,
therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section I. The following described property located within the corporate limits of
the City of Pearland, Texas, and presently classified as Heavy Industrial (M -2), is
hereby granted a Conditional Use Permit allow for Petroleum or Petroleum Product
Extraction, Refining, Manufacturer, or Bulk Storage in the Heavy Industrial (M -2) zoning
district; such property being more particularly described as:

29.43 acres of land, being a part of the H.T. B. R.R. Company survey, section 27,
abstract 308. The G. C. Smith survey, section 28, abstract 551, City of Pearland,
Brazoria County, Texas, and being part of lots 172 and 173 of the Zychlinski
subdivision recorded in volume 29, page 9, deed records of Brazoria County, Texas,
and being all of that certain 14.7071 acre tract described in a deed to Airgas
Specialty Gases, Inc. recorded in Clerk's File 2007 000736 and all of that certain
14.7075 acre tract described in a deed to Airgas Specialty Gases, Inc. recorded in
Clerk's File 2007 000739
This Conditional Use Permit specifically waives the Unified Development Code
requirement for a thirty -foot (30') front landscaped buffer along the front property line
of said property only where buildings exist currently.
Section 11. The City Council of the City of Pearland finds and determines that the
recitations in the preamble hereof are true and that all necessary prerequisites of law
have been accomplished. The City Council further finds and determines that there has
been compliance with the mandates of law in the posting and presentation of this matter
to the Planning and Zoning Commission and to the City Council for consideration and
decision.
Section 111. The City Council of the City of Pearland finds and determines that
the approval herein granted promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
Section IV. If any section, subsection, sentence, clause, phrase, or portion of
this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining
portions thereof.

Section V. All rights and remedies, which have accrued in the favor of the City
under this Ordinance and its amendments thereto, shall be and are preserved for the
benefit of the City.
Section VI. This Ordinance shall become effective after its passage and
approval on second and final reading.

Airgas Specialty Gases is located at 4344 South Main Street in Pearland, TX 77581. Airgas
Specialty Gases is applying for a Conditional Use Permit as the first step in a process to more
fiilly utilize their 29.4 acres where their current storage and filling operations for flammable
products have been safely conducted for the past 19 plus years. Further development of a
portion of their property will consolidate two other local fill operations for flammable products,
Houston and La Porte.
Airgas Specialty Gases in Pearland fills the following flammable gases (DOT hazard class 2.1):
Propane, Propylene, N- Butane, Isobutane, Butene -1, lsobutylene, 1,3 Butadiene, 2- Butenes, Cis
2 Butene, Trans -2 Butene. The Pearland facility also fills two flammable liquids (DOT hazard
class 3): N- Pentane Isopentane.
The expanded development will incorporate the filling of additional flammable gases (2.1):
Methane, Ethane, Ethylene, Ethyl Chloride, Methyl Chloride. Carbon Monoxide (2.3) will
also be filled in the new area. Ammonia (2.2) trailers will be stored on site, but not filled.
The Conditional Use Permit will specifically address non conforming issues, as requested by the
City of Pearland, so that Airgas Specialty Gases is in compliance moving forward.
We look forward to working with the City of Pearland professionals, staff, and elected officials
in an effort to meet the objectives of both Airgas Specialty Gases and the City of Pearland.

POSTING OF ZONING NOTIFICATION SIGNS
ON PROPERTY UNDER CONSIDERATION
FOR A ZONE CHANGE (OR CONDITIONAL USE PERMIT)
Any person, firm or corporation requesting a zoning change, a conditional use permit (CUP),
or a variance shall be required to erect and maintain a sign(s), to be inspected by the City,
upon the property for which a variance or zoning change has been requested.
Such sign(s) shall be located as follows:
(1) One (1) sign per street frontage shall be located within thirty feet (30') of the abutting
street, or as determined by the City.
(2) So as to be clearly visible and readable from the public right -of -way and not
obstructed in any manner.
(3) So as not to create a hazard to traffic on the public rights -of -way abutting the property,
(4) On the subject property at least ten (10) days prior to the hearing of such zoning
change request by the Planning and Zoning Commission, and to remain continuously
on said property until final action by the City Council or withdrawal of the case by the
applicant. Removal of the sign by the applicant prior to a recommendation by the
Planning and Zoning Commission and /or a final decision by the City Council shall
constitute a withdrawal of the request.
(5) The signs shall be as follows:

Conditional Use Permits (CUP)
'Application, filled out completely, and signed by the owner of the property to be
considered for the conditional use permit.
If the applicant is the designated agent, the application shall include a written
statement from the property owner authorizing the agent to file the application on
his behalf. Section 1.2.1.1 (a) of the Unified Development Code.
V Metes and Bounds Description, (Survey, or a Plat of the property that contain the
metes and bounds description).
Parcel map, printed from the City of Pearland website, indicating the location and
boundaries of the subject property.
V etter of Intent, explaining the conditional use permit request in detail, specifying
proposed uses, specific operations of the use, square footage of buildings,
unique characteristics of the property, and any other necessary information
dApplication fee of $250.00, by cash, check made payable to the City of Pearland,
or credit card (Visa and MasterCard only)
S ite Plan or Plot Plan showing the proposed layout of the subject property,
including any proposed buildings, parking, landscaped areas, detention ponds,
fences, and any other relevant information

After staff presentation and a discussion regarding types of chemicals being moved to this
site, as well as precautions taken to prevent accidents, Commissioner Richard Golden
made a motion to approve the Conditional Use Permit (CUP).
The motion was seconded by Commissioner Henry Fuertes. The vote was 5 -0 and the motion
passed.
