R74-22 12-23-74RESOLUTION NO. 74-22 A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR A GRANT FOR ACQUISITION OF A 50 ACRE TRACT OF LAND OUT OF THE W. D. C. HALL SURVEY, ABSTRACT 70, BRAZORIA COUNTY, TEXAS, FOR A COMMUNITY PARK, DESIGNATING RESPONSIBLE OFFICERS FOR THE PROJECT: CERTIFICATION OF FUNDS, AND 'DEDICATION OF SAID PARKSITE AS A PUBLIC PARK. WHEREAS, the Act of the 59th Texas Legislature, Regular Session, 1965, approved May 6, 1965, entitled Senate Bill 165 (V.A.C.S. 6081 r), as amended authorizes the Texas Parks and Wildlife Department to make grants to municipalities and counties to assist them in carrying out programs of outdoor recreation to preserve an adequate amount of rapidly disappearing land; and WHEREAS, it has been found and determined that there exists in this locality a need for a program of public outdoor recreation; and WHEREAS, Title VI of the Civil Rights Act of 1964 prohibits discrimination of the basis of race, color, or national origin under any program or activity receiving Federal financial assistance and Executive Order 11063 prohibits discrimination on basis of race, color, creed or national origin in the acquisition, development and usage of public parks and facilities: NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1.. That an application be filed with the Texas Parks and Wildlife Department on behalf of the City of Pearland for a public parksite grant under authority of the Acts of the 59th Texas Legislature, Regular Session, 1965, approved May 6, 1965, entitled Senate Bill 165 (V.A.C.S. 6081 r), as amended, for one-half (50%) of the cost of acquisition of a 50 acre tract of land, out of the W. D. C. Hall Survey, Abstract 70, Brazoria County, Texas, for a Community Parksite, which cost is presently agreed to be $200,000.00 and located in the area designated and specially described in such application. Mayor Carlton McComb is hereby authorized and directed to execute and file such application and to provide such additional information and furnish such documents as may be required by the Texas Parks and Wildlife Department and to act as the authorized representative of the City of Pearland; that James 0. DeShazer, City Treasurer, is hereby authorized to execute and file requistion for funds and to act as the authorized fiscal representative of the City of Pearland in said acquisition of this public parksite and that James 0. DeShazer is hereby authorized and directed to execute and supervise such contract or contracts as may be necessary for said acquisition for which this grant is being prepared. SECTION 2. That the United States of America and the Texas Parks and Wildlife Department be, as they hereby are, assured of full compliance by the City of Pearland, Texas, with regulations of the Texas Parks and Wildlife Department effectuating Title VI of the Civil Rights Act of 1964 and applicable Executive Orders. SECTION 3. That the City of Pearland has available a source of obtaining the necessary funds to finalize this parksite acquisition pending distribution by the Bureau of the one-half (50%) grant -in -aids matching funds. SECTION 4. That the City of Pearland shall for all intent and purpose, dedicate said parksite as a public park and recreational area for the general public.
