RESOLUTION NO. 75-20
A RESOLUTION AUTHORIZING THE GIVING OF NOTICE
TO BIDDERS AND INTENTION TO ISSUE TIME WARRANTS
FOR THE REPAIR OF WATER WELL NO. 4; PROVIDING
THE DETAILS RELATING THERETO; AND CONTAINING OTHER
PROVISIONS RELATING TO THE SUBJECT AND DECLARING
AN EMERGENCY.
WHEREAS, on May 15, 1975 the City Manager was advised of
a water pump failure on City Well No. 4, and
WHEREAS, without the water production from Well No. 4,
the reliability of the City's water system is greatly impaired, and
WHEREAS, on May 21, 1975 the pump was removed from the
well by Singer -Lane Texas Division and taken to their shop for
evaluation, and
WHEREAS, on May 23, 1975 the City Manager was advised by
the Singer representative that the condition of the pump and its
components were beyond economical repair, and
WHEREAS, the City Manager reported such findings to the
City Council at its meeting on May 27, 1975 and recommended that a
new pump and components be purchased to replace the ones removed
from Well No. 4, and that such new pump be financed by the issuance
of Time Warrants, and
WHEREAS, the City Council finds that the repairs heretofore
described create an emergency and further finds that such emergency
repairs should be made so as to protect the general health and wel-
fare of the citizens of the City of Pearland, Texas by assuring them
an adequate supply of potable water, and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PEARLAND:
SECTION 1.
That the facts and recitations contained in the preamble
of this resolution are hereby found and declared to be true and
correct.
SECTION 2.
That the City Secretary is hereby authorized and directed
to cause to be published in the manner required by law a notice of
intention to issue Time Warrants in substantially the following
form to wit:
NOTICE TO BIDDERS AND NOTICE OF INTENTION
TO ISSUE TIME WARRANTS
To Bidders and to the Qualified voters of the City of
Pearland, Texas, whose names appear in the last approved tax rolls
of Property Taxpayers, and to all other interested persons:
Notice is hereby given that sealed bids, in duplicate,
addressed to the City Council of the City of Pearland, Texas will
be received at the Pearland City Hall until 7:30 P. M. on June 23,
1975 at which time they will be publicly opened and read aloud,
for furnishing all labor, materials, supplies, machinery, equipment,
tools and superintendence, F. 0. B. Well site, for the repair of
the City Water Well No. 4, to wit:
A. To furnish one (1) new deep well turbine pump unit, complete,
exclusive of motor, with the following specifications:
1. 500 GPM @ 250 foot Total Dynamic Head
2. Open impeller
3. 320 feet of pump setting
4. 6 inch pump column
5. Oil lubricated drive shaft; 1 3/16 inch minimum
6. 10 foot tail piece
B. To furnish'all necessary equipment, labor, materials, supplies,
machinery, tools, and superintendence,to install the pump unit in
Well No. 4 and connect it to the existing discharge piping.
C. To furnish all necessary labor, materials, supplies, machinery,
equipment, tools and superintendence to sterilize and perform
production test on the newly installed pump unit.
A Cashier's Check, Certified Check or Bid Bond payable
without recourse to the City of Pearland, Texas, in an amount not
less than five percent (5%) of the largest possible total for the
bid submitted must accompany such bid.
In case of ambiguity or lack of clearness in stating
prices in the proposal, the City reserves the right to adopt price,
written in words, or to reject the proposal. No bid may be withdrawn
after the scheduled closing time for the receipt of bids or for (30)
days thereafter, and any bid received after the closing time will be
disqualified and will be returned to the sender unopened. The
City reserves the right to accept any bid

deemed most advantageous and to reject any or all bids and to
waive any informality.
It is the intention of the City Council to pay for all of
the costs of repair to Water Well No. 4 by the issuance of Time
Warrants in the maximum amount of $12,000.00 bearing interest at a
rate not exceeding six and one-half percent (6 1/2%) per annum,
and maturing serially over a period of years not to exceed three (3)
years from their date or dates, with maximum maturity date not later
than July 1, 1978.

SECTION 3.
That the notice set forth in Section 2 of this resolution
shall be published in the News, once a week for two (2) consecutive
weeks prior to June 23, 1975, the date of the first publication to
be at least fourteen (14) days prior to June 23, 1975. It is hereby
found and declared that the News is the official newspaper for the
City of Pearland, and is a newspaper of general circulation within
the City of Pearland, Texas. A copy of said notice shall also be
posted at least fourteen (14) days prior to June 23, 1975.
SECTION 4.
That this resolution shall take effect from and after its
passage.
