A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE
ALL INSTRUMENTS AND MAKE ALL PAYMENTS NECESSARY
FOR THE PURCHASE OF 7.298 ACRES OF LAND OUT OF
THE W.D.C. HALL SURVEY, ABSTRACT 70, PEARLAND,
BRAZORIA COUNTY, TEXAS; AND CONTAINING OTHER
PROVISIONS RELATING THERETO.
WHEREAS, the City Council has heretofore determined and
deems it advisable that the City acquire additional real property
for the purpose of future expansion of certain City facilities;
and
WHEREAS, the City Council is of the opinion that purchase of
future development property at this time would be in the best
interest of the citizens of the City for years to come; and
WHEREAS, AARON PASTERNAK, Trustee, has agreed to sell to the
City a certain tract of land, which is favorably suited for the
future expansion needs of the City; and
WHEREAS, the City has determined, by appropriate appraisal,
that the sales price for the land tendered for purchase is within
current market values; and
WHEREAS, the City Council hereby declares that time is of
the essence of this Contract for purchase;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PEARLAND, TEXAS:
I.
That the Mayor of the City of Pearland, Texas, is hereby
authorized to purchase from Aaron Pasternak, Trustee, 7.298 acres
of land out of the W.D.C. Hall Survey, Abstract No. 70, Pearland,
Texas, as more particularly described by metes and bounds in
Exhibit "A" attached hereto and made a part hereof for all pur-
poses, for the total consideration of Seventy -Two Thousand Nine
Hundred Eighty & No/100 ($72,980.00) Dollars.
II.
The total consideration herein specified shall be paid to
the Seller upon the closing of title and the delivery of a good
and sufficient Warranty Deed conveying a good and marketable title
to the premises free from all encumbrances, together with an
owner's title policy to be furnished by Seller.
III.
The Mayor is hereby authorized to execute all instruments
and make all payments necessary to carry the foregoing resolution
into effect, and to accept all documents, duly executed, which
are or may be necessary for the transfer and conveyance of the
real property described in Exhibit "A" attached hereto.
IV.
That this resolution shall be effective on and after its
passage on first and final reading.

FIELD NOTE DESCRIPTION OF A 7.298 ACRE TRACT OF LAND,
Out of the W.D.C. Hall Survey, Abstract No. 70, Pear-
land, Srazoria County, Texas.
BEGINNING at a 1/2" iron rod found marking the Northwest corner of a Pearland Independent
School District 20 acre tract recorded in Volume 944 at Page 359 of the Srazoria County
Deed Records;
THENCE S. 42° 16' W. along the Westerly line of said 20 acre tract at a distance of 871.20
feet passing a 1/2" iron rod found marking its Southwest corner and continuing in all a
total distance of 901.20 feet to a 1/2" iron rod set for corner;
THENCE N. 47° 44' H. a distance of 346.92 feat to a 1/2" iron rod set for comer in the
East line of a public road (50' R-0-4 leading from F.M. Road No. 518 to a City of Pearl and
Parksite;
THENCE N. 41° 31' 50" E. along the East line of said public road, a distance of 901.27
feet to a 1/2" iron rod set for corner;
THENCE S. 47° 44' E. , a distance of 35 .55 feet to the PLACE OF BEGINNING and containing
7.298 Acres of Land.
