R76-21 12-13-76RESOLUTION NO. 76-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE SALE, TO THE GENERAL PUBLIC, OF CERTAIN PUBLIC REAL PROPERTY; DIRECTION PUBLICATION OF NOTICE OF INTENDED SALE; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. That the following described real in fee simple by the CITY OF PEARLAND, hereby offered for sale to the general property, presently owned TEXAS, be and the same is public, for a value not less than the fair market value as determined by the appraisal prepared on behalf of the City, to -wit: SURFACE AND SURFACE ESTATE ONLY: That Notice of Lots Twenty (20), Twenty -One (21), Twenty -Two (22), Twenty -Three (23), Twenty -Four (24) and Twenty -Five (25), Block Fourteen (14) of PEARLAND TOWNSITE, Brazoria County, Texas, according to the duly re- corded map of plat of said Pearland Townsite of record in Volume 29, Page 41, Deed Records, Brazoria County, Texas; and The South one hundred twenty-five feet (S-125') of the South one half of that certain strip of land, fifty feet (50') in width, more or less, running parallel and adjacent to the G.C. & S.F. Right -of -Way and located between such G.C. & S.F. Right -of -Way and Block Fourteen (14) of the Pear - land Townsite, City of Pearland, Brazoria County, Texas, according to the duly recorded map or plat thereof as recorded in the office of the County Clerk of Brazoria County, Texas, and being the same land described in that certain Deed dated January 12, 1963, executed by Myrtle Herridge et al to Connor Herridge, recorded in Volume 840, Page 4 of the Deed Records of Brazoria County, Texas, to which Plat, the Deed and the records thereof reference is here made for all purposes. II. the City Secretary is hereby directed to publish a this intended sale by the City, and to prepare all notices and bid procedures as prescribed by Article 5421-C-12 of the Revised Civil Statutes of Texas, as amended, and all other applicable laws. III. That all net proceeds, received by the City of Pearland from the sale of the afore described public property, shall be utilized by the City Council, at its discretion, for the funding of the following described public projects, to -wit: 1. The moving of the "old Pearland Depot" from its present location to Independence Park, and/or new City Hall property, and/or such other proper location as may be hereafter determined by the City Council. and development 2. The purchase/of sufficient properties in the Western sector of the City for the development of neighborhood parks. IV. This resolution shall become effective after its Passage, Approval and Adoption.
